December 9, [redacted] ** [redacted] *** Subject: Response to Revdex.com Case #: [redacted] StonegateMortgage Corporation Loan #: [redacted] RESPONSE Dear Mr [redacted] Please accept this Ietter asStonegate Mortgage Corporation’s (hereafter, “Stonegate”) official response tothis complaint This letter is intendedto respond to and address the concerns related to the charge for the appraisalon the propertyYou sought a loan through Stonegate and it was our understandingthat [redacted] , the mortgage advisor who assisted you with yourapplication, was authorized to speak with your girlfriend about the loan This understanding was based on yourinstruction to Mr [redacted] while both you and your girlfriend were on the phoneline Regarding your contention that Stonegate did not inform you thatthe loan was subject to the appraisal, it appears there is a misunderstandingof the process An option to obtain aFHA streamline refinance was discussed, and that option would not have requiredan appraisal However, the FHAstreamline loan’s payment terms were not as favorable and you elected to seek aconventional loan The conventional loanhad more favorable payment terms but was contingent on an appraisal showingthat the value of the home supported the loan amount Unfortunately, the appraisal did not supportthe loan amount and therefore you did not qualify for a conventional loan Regarding your request to have the appraisal amount of $416refunded to you, Stonegate’s policy is that the applicant for the loan bearsthe cost of the appraisal if the appraised value does not allow the loan toproceed to closing However, as itappears from your complaint that you misunderstood the fact that you wereresponsible to pay for the appraisal in these circumstances, Stonegate willagree to refund the cost of the appraisalEnclosed is a check for $Stonegate believes that this adequately addresses all of the concernsraised in your complaint Stonegate Mortgage Corporationreserves the right to supplement this response as more information becomesavailable Should you require furtherinformation, please do not hesitate to contact [redacted] ***, Corporate Counseldirectly at 317-663- [redacted] with any questions or concernsSincerely, [redacted] Chief Administrative Officer Stonegate Mortgage Corporation Enclosure: OriginalComplaint; CC: Barb Cutillo, MikeMcElroy, Robert Meachum, Jeremiah Wean, David Kress, File

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID ***, and find that this resolution would be satisfactory to me However, this mistake would have been better handled if they had corrected it at the time of the erroneous escrow payment For the whole year I thought I was paying the correct amount so to come up suddenly with the owed amount with no prior knowledge that there had been a mistake only made the resolution more difficult and was not budgeted for The tax resolution was to have been understood at the closing so I am glad to be able to get that resolved as well Unfortunately, the situation put me on the defense since I thought I had been misled during the closing and by the lowered payment over a year's time Thank you for your help in getting things worked out

is paid in full. This timeline would allow us until March 25th to place theescrow refund into the mail. As a courtesy, I have escalated your request for the refund and it iscurrently in process scheduled to be placed in the mail on Monday, March 21st.

The increase in the escrow portion of your mortgage payment was not the result of an error on the part of Stonegate. The increase in the escrow portion of your payment was the result of an increase in the taxes for your property. When reanalyzed on January 30, 2015, you were sent a statement...

advising of the payment increase from $813.35 monthly to $1,117.91 monthly effective with the April 1, 2015, payment.  This was due to an escrow shortage of $2,127.41 caused by increases in your property tax. The increase in your real estate tax was a progressive process that resulted from the local taxing authorities increasing your taxes after the completion of the construction of your home. New construction is taxed initially on the value of land only. Once the notice of completion is filed with the local authority the tax value is reconsidered and adjusted for the enhanced value of the property. Escrow shortages can be spread over a period of time for repayment or eliminated by lump sum payment. On April 13, 2015, you spoke to [redacted]s who offered to spread your escrow shortage over 36 months to minimize the impact of your payment increase.  This offer was rejected.  You advised you are seeking resolution through loss mitigation options offered by Stonegate.  Our loss mitigation department will contact you again shortly as your application for assistance is incomplete.   As a courtesy Stonegate applied the payment received April 10, 2015, in the amount of $940.63 as the April 01, 2015, installment. Arrangements must be made beforethe May 1, 2015, payment is received or the full amount due of $1,117.91 will be expected.
