I am rejecting this response because:Dear [redacted],On the first page of my contract (which was not included in your attachment) in bold it states I can cancel my contract with [redacted]or any reason with a 60 day written notice with a $75 cancellation fee, I have attached page one of our contract which is the same for my son and daughter for  your review.  [redacted] had a free month and [redacted] had two weeks free of instruction we won at the Auburn County Fair.  We informed [redacted] in October 2013 we will no longer be attending there facility due to financial reasons and pay a cancellation fee of $150 at the martial arts center and sent a written notice for both [redacted] and [redacted] just as the contract instructed us to do.  It is [redacted] responsibility  to notify you of the cancellations of both [redacted] and Connor’s contracts because our contract only states we have to notify Joslin’s. I also did make a payment of $100 each  which our bank statement reflects for [redacted] and [redacted] directly to Educational Funding Company.  I have tried to answer Educational funding Company’s phone calls to our home phone only to hear a recorded message wanting me to call them and when I called them  I would get another recording telling me to leave a message.  After going around and around with the recordings I stopped calling.   I am not asking Educational Funding Company to cancel my contract because I have already done so with [redacted] October 2013.  I am asking for them to stop sending statements for due amounts when I do not owe anything.  Sincerely, [redacted]

06.07.2013 and made 2 payments of $129 for the months of July and August of year 2013.·        The original contract was for 23 months ( a copy of which is attached hereto)·        The student can cancel this contract if she were to meet and fulfill the criteria’s clearly explained in the points (3), (4), (5) & (6) of “Notice of Consumer Rights” section on the contract.·        However the student failed to prove none of these stated conditions beyond any reasonable doubt neither to school nor to Educational Funding Company.·        The fact that she claims to have not been able to get in touch with anyone at Educational Funding Company for all this time cannot neither be justified nor be proven.·        However, in the interest of goodwill, the school is willing and offered to cancel this contract completely only if the student agrees to pay a 90 day penalty fee ($129 * 3 = $387) for breaking the contract·        However the student refuses accept that offer·        The authority she has given to the school is binding and is still in effect. Therefore the school has every right to take the student to a Small Claims Court to recover their monies·        Considering above issues, please note that the Educational Funding Company is neither authorized nor in a legal position to proceed with the requested cancellation of this contractYours sincerely, Susika D[redacted]

I am rejecting this response because of the reasons listed in the letter that is attached to this complaint. (The text would not fit in the space provided). Please review the attached document. The points made by Educational Funding service do not address the complaint. There have been no lapse in payment during the time the contract was in effect (dates of debits provided in the letter), there is confirmation that a cancellation request was received and an exit interview was provided on 09-16-2015 but funds continued to be debited from my account, the amount the school is requesting as a "cancellation fee" would not apply if the contract was cancelled in September 2015. As per the agreements between the school and the student, the school is willing to cancel the account upon receipt of current past due amount of $579.00. However the school refuses to freeze the account or to cancel prior to receiving this said past due balance.Since we are a third party billing company, we can only advise the school on these issues regarding the best course of action under given circumstances  but the school retain the right of a final decision.

I am rejecting this response because: I have read many cases which make it clear that EFC have more control over the contracts than they are acknowledging here, as in cases where they refuse to cancel contracts EVEN THOUGH the school is okay with it.It is counterintuitive to hold us to ransom when we are unable to meet the demands, if there is no hope of resolving the issue, which there isn't while charges continue to mount, then there is little incentive to start paying towards it.I gave two options which result in us being able to pay the balance and move on and that is being rejected, this is not of benefit to any party.
