It is with full assurance that everyone involved would like this project to wrap up After working with this mason for many years, and observing the workmanship they provide, we are confident that the finished product will be enjoyed for many years to come All preparation work for the concrete pour has been completed The forms are in place but you cannot start pouring concrete without certainty that rain/weather won’t interfere Another date has been set for Saturday 11/4/ Weather permitting the pour should be completed Saturday

Tarson Pools has been in contact with [redacted] regarding the issues with the concrete by the steps of her poolAs per contract, the concrete warranty of year is covered by the mason that installsHowever, the mason in this case refused, and out of good will Tarson Pools has agreed to cover the cost of the repairSeveral estimates have been obtained for this purpose by other masonsAs of today, 10-16-15, a mason has been contracted by Tarson Pools for the repair work, and will notify [redacted] of the date the work will be doneResponse will follow when the repairs have been completed

Revdex.com:I have reviewed the response made by the business in reference to complaint ID [redacted] , and while I can agree that I missed a message in Early August from the Installer My husband made several attempts to contact the store to resolve throughout August and no one would answer or return our call My making a phone call to the Revdex.com is what prompted them to contact us?The installer did come out to our house days ago and they are not really sure what is under the liner My husband and I are certain that it is some packing material or something that was left by the installer It is impossible that it is a root This pool was put in the same spot that we lost our pool during 2015/winter Our previous pool was up for years Roots don't just re-appear The installers did not even replace the sand from out previous pool when they installed this new pool nor did they rake the area before installingPlease leave this case open until I contact you that it has been completed We have spent ALOT of time and effort trying to get this problem fixed all summer.thank you [redacted]

The installer who put their pool in did go out to their residence to look over the issue a couple of weeks agoHe called the customer, leaving her a message on her voicemail and asked that they clear up the pool because it was too green for him to see anything, and for them to call back once it was clear so he could come back out and look thenThe customer had never called back and once we contacted her she realized she never listened to her messagesThe installer went back out now and sees that it's a root in the ground causing the issueHe explained that he will be out on the 24th to pump out the water and pull the rootThis was easily rectified and this complaint was unnecessarily brought to the Revdex.com

I would like to continue with the arbitrationI am not at all satisfied with Tarsons saying they r not responsible for my liner to my pool

This should not be a Revdex.com complaint This is not an issue with service or products, this is a legal issue The customers signed a legal contract at a show event All contracts for that event have the “Special Event All Sales Are Final” stamped on them prior to the event even beginning Customers also signed the document “Invoice and Notice of Right to Cancel” which explains the day cancellation policy This sale was done at the NYS Fair We do not “promise” week delivery times on any spa sale because it takes us over a week just to break down the event at its conclusion When the customer called to cancel the spa they were informed during that conversation that they would not receive their deposit back, they chose to continue with the cancellation regardless They did a charge back on their credit card with [redacted] on different occasions (10/29/15, 2/9/16, and 3/9/16) With each charge back dispute, under legal circumstances, [redacted] went in our favor on the deposit they paid

In response to the complaint made by [redacted] , Tarson sincerely apologizes for any inconvenience the customer encountered during the install processA service crew has assembled the the solar reel and cut the cover to fit, as per the customers requestThe installer is currently completing service and will fix the liner by the steps in the next two weeks

I have spoken with [redacted] and we are requesting arbitration .The recorded message left shows the lack of wanting to work reasonable with Tarson.The pool was repaired yesterday 6-20-and can be filled with water and pool usedAs for the discolored liner it was caused by the homeowners negligence.Thank you

We sent a crew out on June 3rd and June 15th with parts needed to fix the heater issueHeater is working but now has another issue according to the customerWe spoke with the customer today (7/5) and we are sending the technician out on July 8th to check the heater again, but will be prepared to swap it out with a whole new heater if necessaryCustomer has a concern with the step area which will also be addressed on 7/Has been looked at once and tech thought it was ok but we will check it again and rectify it to the customers satisfaction

Revdex.com spoke with the consumer who advises that the pool liner has not been repaired Barb at company has stated there is a work order since June 1st Some work was done, however the liner remains in disrepair

It does not benefit Tarson Pools to postpone an installation, regardless of the location Sometimes it is necessary to delay an install due to ground water conditions in order to achieve a quality installation During the month of June, Carthage, NY received over inches of rain without
consecutive days of zero precipitation This did not leave ample time for the ground to dry Barb spoke to the customer on 7/2/reviewed the upcoming weather forecast, and decided on a date of install of 7/7/ All of us at Tarson understand the anticipation of getting a new pool installed, however we will not jeopardize the integrity of an install, on a product that will last the customers for years to come

Well, unfortunately the reply is not satisfactory.  I am not married to [redacted] and have never been married to him and I was not privileged to this information.  Additionally,  the "all sales final" stamp on the documents was not on the documents when we signed them.  Again, we noticed this after we got home.  We would not have signed the documents had this been on them.  We were never told by the sales person that all sales were final.  Right or wrong I feel that should the spa have not been available within two weeks as promised by Scott the sales person then we should have been called within the cancellation period and given the opportunity to cancel our order or continue.  This was not done.  This is a bad business practice and poor customer service.  It has been noted that they would have not promised delivery of our spa in two weeks, but unfortunately this is what we were told by Scott.  Tarson did not suffer any damage when the order was canceled.If there was an alternative offered at the time Tarson spoke with [redacted] I was not privileged to this information.  To my knowledge there was no further communication between Tarson and [redacted].  I was not personally contacted and do not want to pay the $1400+.  I feel, under the circumstances, they should refund the $.  If necessary, I will obtain legal counsel or proceed with small claims court, but I really don't want to have to do this.One additional note, the document about cancellation and notice....I never received a copy of...so how was I to remember this?  Again, poor business practices....To not be given any alternative or to have further communication with the purchaser is unacceptable.  I look forward to your reply.  If you require additional information please let me know.Regards,[redacted]
