On 9/24/15 the customer spoke with the sales rep and told him that as long as the spa was delivered in 3-4 weeks they would still take it. The husband called the spa department later that same day to say he changed his mind and wanted to proceed with canceling the order. The woman in the office he spoke with asked him if there was anything she could do, he said no to still cancel it. It was again explained that all fair sales are final and it was past the 3 day cancellation time frame, that both Mr. and Mrs. signed a contract explaining, which means there wouldn't be a refund on the deposit. The husband still chose to continue with the cancellation. Copies of all signed paperwork were given to the customers at the time of sale.

Tarson Pools has been in contact with [redacted] regarding the issues with the concrete by the steps of her pool. As per contract, the concrete warranty of 1 year is covered by the mason that installs. However, the mason in this case refused, and out of good will Tarson Pools has agreed to cover the...

cost of the repair. Several estimates have been obtained for this purpose by other masons. As of today, 10-16-15, a mason has been contracted by Tarson Pools for the repair work, and will notify [redacted] of the date the work will be done. Response will follow when the repairs have been completed.

To whom it may concern:On 8-11-14 Ms. [redacted] signed a quote for the amount of $8650.00. This was a quote and a quote only.No work had been started at this time. You will find the quote she signed attached. It clearly states thereis no warranty on the repair work. And painting/sanding of the coping...

Ms. [redacted] was notcharged any more than the quote she signed.On 5-1-15, Ms. [redacted] called and stated her liner was torn and out of the coping. The liner floated andthe foam lifted up over the winter. [redacted] was unavailable to take her call for a couple hours and insteadof waiting, she screamed, swore and berated the other office staff until [redacted] returned, making multiplephone calls from different numbers and calling different people repeatedly. Tarson informed her, within3 hours of her original phone call, someone needed to come look at the pool, and sent a tech out onSaturday 5-2-15. Ms. [redacted] also verbally assaulted him until he left her property. She has laterapologized for her actions. At no time did anyone tell her it was her fault. We explained in order for thefoam behind the liner to defy gravity and "float" there had to have been water behind there. The poolrepair had no warranty, however as a courtesy, Tarson agreed to re-adhere the foam to the walls andreset the liner.On 5-14-15, Tarson reset the liner. Ms. [redacted] was happy when we left.Reasons this complaint is invalid:1. Ms. [redacted] had no warranty on the pool repair done in August of 2014.2. Liners, especially new, frequently come out of the coping and need to be "retucked". It does notindicate any issue with the size of the liner or the quality of installation.3. Ms. [redacted] calls were answered and/or promptly returned. No one ignored her.4. The quote indicates the coping would only be sanded and painted. Not replaced.5. This is the only written quote Ms. [redacted] had received from Tarson . At the time she was given averbal quote, she was told it was a rough estimate and she would be given a written quotebefore and money was exchanged or work was started. At the time she signed the writtenquote, if she felt the price was too high, she could have taken her business elsewhere.6. The problem has been remedied and the customer has rescinded her complaint

Due to the circumstances, Tarson Pools and the customer have agreed to cancel the contract and refund the deposit. The pool has been returned, the yard returned to a rough grade, and the deposit refunded. To the best of our knowledge the customer is satisfied with this resolution.

This should not be a Revdex.com complaint.  This is not an issue with service or products, this is a legal issue.  The customers signed a legal contract at a show event.  All contracts for that event have the “Special Event All Sales Are Final” stamped on them prior to the event even...

beginning.  Customers also signed the document “Invoice and Notice of Right to Cancel” which explains the 3 day cancellation policy.  This sale was done at the NYS Fair.  We do not “promise” 2 week delivery times on any spa sale because it takes us over a week just to break down the event at its conclusion.  When the customer called to cancel the spa they were informed during that conversation that they would not receive their deposit back, they chose to continue with the cancellation regardless.  They did a charge back on their credit card with [redacted] on 3 different occasions (10/29/15, 2/9/16, and 3/9/16).  With each charge back dispute, under legal circumstances, [redacted] went in our favor on the deposit they paid.

I would like to continue with the arbitration. I am not at all satisfied with Tarsons saying they r not responsible for my liner to my pool.
