In the call he told me I would get a decent size return back he did not state I would only receive the principal of the payment backHe also said he would pay them the loan to make sure I got my money back out of all the money I paid I received one payment of $back and that was itI called the [redacted] company and they told me the tax defense networks gave them strict orders to only give the principal and nothing else Complaint: [redacted] I am rejecting this response because: Regards, [redacted]

Dear Mr***,Thank you for bringing this complaint to our attention and allowing our responseThe case brought to us by the client involved taxes created by withdrawing funds from a retirement accountThe client felt he had extraordinary circumstances regarding his reason for accessing the
retirement funds, and due to these circumstances the tax should not be charged or at minimum should be reducedThe reason for pulling the funds, our client was purchasing a home and selling his current homeThe purchaser of his home encountered a delayWith this delay and the need for our client to purchase his new home, our client felt forced into the decision of pulling funds from his retirement accountIRS rules state, when funds are withdrawn from a retirement account the person withdrawing the funds has up to days to replace the fundsIf the individual misses this day window, the withdrawn funds are now taxableThis is the situation our client found himself exposed toWithdrawing funds due to a circumstance beyond his control and not replacing these funds within the day windowAgain, a situation beyond his controlWe were contracted to determine if the debt could be removed and if the debt remained we would establish an IRS resolutionIn my reviewing the complaint, my question was how? How did we get so seemingly off base with this case? Before I answer this question, I want to say I understand clients want to use all avenues available to them when attempting to resolve a tax issueThis was the case with this clientImmediately after we began our case, our client contacted his Senator, who directed him to contact the Taxpayer Advocates Service ("TPA")TPA is part of the IRSThey exist to help taxpayers answer questions or to act as an advocate for the taxpayerFor example, someone is being heavily levied by the IRS and the IRS seems non-responsive in removing the levyYou could call TPAJust always remember, it is still the IRSWhen a taxpayer involves TPA, everyone, including us as Power of Attorney, have to wait until TPA makes their determinationThis is the situation we found ourselves, waiting for TPA to make a rulingAfter three months, TPA ruled in favor of the IRSWe attempted to explain to the client TPA's positionI can only assume this is where the client felt we only told him the IRS was rightPlease remember, involving TPA was not our ideaThis was done by the clientTo speak to the contact issuesMy answer is I do not knowWhen you look at the call logs and email correspondence, I would say contact was goodBut of course the complaint says contact was poorAccording to records, the client was contacted regularlyWith there being only one gap in communication, roughly three weeksAnd this was a planned breakMy belief is it was the information given when the client was contacted and not the frequency of contactThe client did not like our answersWhich we understandThis was where the contact portion of the complaint originatedWe have spoke to the client regarding this complaint and have reached a resolutionRefunding back the unused portion of the fees paidWith this refund we do consider this complaint closed and resolvedThank you again for bringing this to our attentionPlease let me know if any additional information is neededSincerely, *** ***Director of Client RelationsTax Defense Network

just called me(good timing?) and asked me to please stop complaining to people and I told them that if they would give me a full refund I would except for to the IRS and whomever I had to hire to straighten out this mess they causedand only if I could type up my own hold harmless to sign and send to themthey said ok so as for right now I will go along with what they sayBut please keep this on your records as an official complaint to reference for other people so that they don't make the same mistake I did by hiring these frauds Revdex.com:

Dear Mr***,Thank you for bringing this complaint to our attentionThe ***'s did contract with Tax Defense Network ("TDN") to help resolve a state of California sales tax debtThe state has been garnishing Mr*** for over a year and recently began garnishing Mrs***Our goal for
the ***'s was to reduce or remove the wage garnishment, and establish a manageable repayment planWhen we contacted the state to begin negotiations the state informed us that there would be no negotiationsThe state's reason was the ***'s have ignored the state for several years, and have only recently responded once the state threatened to wage levy Mrs***The state cited the recent purchase of two vehicles and the opening of several credit cards as reasons for no negotiationsThe states position is the ***'s chose to incur more debt than address their delinquent sales taxAfter our conversation with the state we immediately contacted the ***'s and informed them of the conversation with the stateLetting them know the state's current position of no negotiations.TDN was direct and honest with the ***'s about our conversation with the stateInforming them that we did not feel the state would change their position regarding their caseIn this conversation the ***'s were informed on how to obtain a refund wit TDNAll refunds with TDN are handled by the Gold Star Client Care ("GSCC") departmentThe ***'s contacted GSCC Friday afternoon June regarding a refundThe GSCC representative discussed the issue with the clientThe GSCC representative requested until Monday to review the file and they would call the ***'s back to complete the refund requestThe ***'s agreed to allow for the reviewLater that day the ***'s filed this complaint with the Revdex.comThe complaint is written as if we contracted the ***'s case, took their money, did not solve their problem and then said no refundThe no refund part of the complaint is 100% not trueA refund was discussed with the ***'sThis was the conversation between the ***'s and our GSCC departmentWith this complaint, we do understand how the ***'s can be upset and disappointedThey hired a company to help solve their problem and the company was not able to solve the problemThese are the factsBut what is also a fact is that once the issue was realized, the ***'s were contacted and we discussed with them a refundWe have been in contact with the ***'s, and have made a refund offerAt this time, we are not in agreement regarding the refund amountThank you again for bringing this to our attention and allowing our responsePlease let me know if any additional information is requestedSincerely, *** ***Director of Client RelationsTax Defense Network

I have reviewed the response made by the business in reference to complaint ID ***, and find that this resolution is somewhat satisfactory to meThe reasoning and logic of the respondent appear to be faultyI contact them before, I was contacted by the Tax Payer Advocates officeThis contact was made by the advocate because of my US SenatorTDA was advised of this as soon as it happenedIf they defered to the IRS for whatever reason, then they should have stopped collecting their feesTDA was very clear in stating they could only do as much work as they were paid forOne half payment, one half the workMy situation went as far as them getting a transcript of my taxes, a copy of which I sent them at the beginning, and having forsenic tax expert look at what already known, the calculations made by the IRS was rightTo go to a service like TDA means to me that I was seeking a legal way to ease the findings against meI know now of other methods to do so, learned by meThat was their jobI should be happy to get some money back which I did, but I still stand disappointed that I put my trust in an organization highly rated by you and did not get what I paid forAnyone can make a mistake, simply acknowledge itTDA in its answer seems to acknowledge an unhappy customer but states it is really not our faultThe company is aware of customer disatifactions and even set up a special telephone number for this purposeToo bad this service did nothing to address my concerns before having to lodge a complaint with you

Mr***Thank you for bringing this complaint to our attention and allowing this response.Mr*** contracted with Tax Defense Network ("TDN") to complete the following services:Prepare Individual Federal Income Tax Returns to Compliance (compliance as defined by IRS is the filing of the six
most recent years)Prepare Individual State Income Tax Returns for 2007-2014, state of Maryland In total, between state and federal returns, TDN prepared fourteen returns for Mr***During the case Mr*** expressed many times his reason for hiring TDNHe wanted us to prepare his returns and wanted to pay the lowest tax amount possibleWe understood his request and began working with him to achieve this goalDocumentation is the biggest part of tax preparationDocumentation being W-2's, deductions, expenses, etcMr*** expressed he would have difficulty getting W-2'sHe said he could get some W-2's but not allAlthough that situation is not ideal, we said we would do our best with what he hadWith this understanding we moved forwardOur tax preparation department had many discussions with Mr*** regarding his returnsPreparing his returns on two separate occasionsAfter Mr*** expressed frustration with collecting expenses and documentation, we agreed to go through monthly bank statements to help him find expensesOur goal was to prepare for Mr*** the best possible tax return, given the limited information he was able to provideIn an effort to achieve this goal members of our tax preparation team had numerous emails and phone calls with Mr***, requesting documentation and keeping him informedIt is true Mr*** previously asked for a refundThis refund request was made months after we began his case and after our first completed attempt with his returnsAt the time of the request, Mr*** said he was not okay with the amount showing he owed and said he thought we would have helped moreWe explained these returns showed a higher amount because Mr*** had provided little to no informationWe also explained how the lack of providing information was hurting our effortsMr*** agreed to drop the refund request and committed to providing more information. The complaint states that after the refund request nothing changedThis is simply not trueAfter this request, we again prepared Mr***'s returnsWorking with him to find more expenses and deductions to offset several years of non taxed workWith this case, Mr*** was told on numerous occasions what we could accomplish and what we could not accomplishFrom the beginning we were transparent. We worked with Mr*** for several months attempting to prepare the best tax returns possiblePreparing fourteen tax returns that spanned several yearsMr***'s case was completed August 26, He was provided his returns and all his questions were answeredWe even offered to help in the future if he found additional expenses. each yearDuring our initial conversations, Mr*** expressed he had been fighting the *** for some time and had not been successful with requests to have tax removed or reversing the decision regarding disallowing deductionsDuring this initial call we informed Mr*** if he does not have any new evidence to submit to the *** then our scope of work regarding his case would be limited to assisting him with establishing a manageable way to address the tax debtWe would not be focused on reversing the deduction decision or reducing the tax debt, except for attempting to have some penalties removedMr*** expressed that he understood and it was mutually decided to move forward with services.
