I will accept a refund of the $26k paid to contractor less labor and materials for trusses and some of material used to frame the barnI will not accept deducting for lumber that was brought to the site and was already warped or material installed on the barn that has warped due to rain and contractors failure to install sheet metalSome of these materials must be replaced nowAlso, will consider some adjustment for sheetmetal delivered to siteHowever, contractor delivered 10' sheets not 12' sheets which is the height of the barnI will consider a reasonable refund based on the comments aboveI would like to see contractor provide a summary of costs with invoice verification and offer an amount that I can review and agree to
Also, let me add that contractor has not talked to me since he left the job site in JulyHe asserts his phone will not answer my phone number in particularContractor has made no other effort to contact me by another phone or mailDuring conversations prior to July contractor asserted weather was not an issue after getting barn framedHe asserted barn could be closed in and concrete poured laterWeather has not been an issue for six monthsI have already had concrete poured myselfNo issues

I originally was interested in building a pole barn structure and ended up finding a company called Countrywide BarnsAfter communication with the owner *** *** we received a call from Mr*** *** a project manager for Countrywide BarnsAfter further research we decided to stay away from Countrywide BarnsA couple of months went by and Mr*** *** gave me a call and asked if I was still interested in our projectHe informed us that he had left this company for a lot of the reasons we had already discoveredWe said sure and proceeded to move forward with the project after I called several of his supposed referralsWho knows who these people actually wereHe presented us with copies of his insurance and explained them to usHe ensured me that he was bonded and not many contractors are actually bonded (talked to several contractors and they said the same thing)As the project started I called the insurance companies to verify the information but they wouldn't disclose any information about these policies with meHere we are now out over $60,plus what is left in the budget to finish the project and we are really screwedIt is a sad situation that people can get away with this with no recourseThe homeowner has everything to loose in a construction situation while the bank and the contractor can recoup money relatively easilyLet me know if you need anymore information

I will explain the "relationship" between my company, "American BarnCrafters LLC" and Texas BarncraftersWe are not affiliatesWhen he learned of my choice for my company name, he decided to name his company similarlyWe both worked for the same company and left that company about the same timeI have built barns in other states but none in Louisiana or Texas, where *** lives
I was trying to help *** sell a couple of jobs to help him get startedThat turns out to have been a mistakeI did not actually provide the building quote or the contract*** obviously used my company name and logo by putting it on his contract but what you sent me is not my contract and *** has never had authority to sign a contract for meAmerican BarnCrafters, LLC has never applied for a builder licence in Louisiana or Texas
All contracts were signed by *** and all monies were sent or given to him
I, also, am not able to get *** to answer his phone or return a call
I am interested in helping *** with this situationI have never shuned her calls and always returned any call I missedMy problem is, I don't have funds to provide her, especially since I was not involved once the job was contractedAll business transactions were actually between *** *** and ***

Thank you for the response. I do not accept [redacted]'s documentation. It is inadequate in support of his costs and work performed. [redacted] did not set the posts, provide material, or frame the two lean two's on the barn. I have had to pay someone else to do this as well as replace some of the original barn frame due to warping. [redacted] did delivery some sheet metal to the site. However, he brought 10' panels for the barn sides instead of the 12' barn panels required. I have had to purchase the appropriate sized panels needed to finish the barn. Thank you, [redacted]

Just to provide you with some more information. He has refused to sign the mechanics release of lein because his lawyer has advised him that he should not sign it because he would be liable for the work that was done onsite.
