amounts change daily and are based on availability, specific apartment amenities and modate, it is the same type of pricing system that is used by airlines and hotelsOn whatever day a Craigslist ad was posted we would have had an apartment available that day for the advertised priceOn the next day, however, the price may be differentIn addition, we rent apartments on a first-come, first-hold money down basisAn apartment for which Mr*** saw an ad on Craigslist may have already been leased until he was at our office.We in no way forced him to sign a lease for an apartment that had higher rent than he wanted to payWe have many floorplans available all with different prices which our leasing consultant would have been happy to show.Very truly yours, Hope B***Regional Property Manager, Pennsylvania Region ***

I lived at Westgate for a year last year This place has the potential to be amazing but the management is awfulAll over the property there are signs threatening you with finesThere is a huge red sign on the garbage threatening a $fine for dumping, a sign that says not to solicit and a sign threatening to tow your car if you park in a certain spotAlso, if your dog goes to the bathroom in the wrong spot they will fine you $If you try to get out of your lease and find a replacement to take over your lease they will charge you $and keep your deposit just because they canOf course they don’t tell you any of this information up frontThis place is all about moneyThey treat their tenants with hostilityI found out later that they go around the parking lot and check people’s car registrations to make sure they are up to date? I have no idea why a landlord would do this? They are way too intrusiveAll a landlord needs to do is cash the rent checks and mow the grassEvery time it rains really hard there was a small flood in my kitchenThey refused to fix it and I guarantee the new tenant will be dealing with the floodingThey tried to simply caulk it but that doesn’t stop the puddles in my kitchen during a hard rainThere is clearly water damage on the roof somewhereAlso, during these rains the sidewalk turns into a river because they don’t have good drainageFor what I was paying in rent the kitchen cabinets were in terrible shapeThey had to have been made in the 70s at leastI had to get Velcro to keep the doors closedThey need new cabinets and they have a huge ant problem in the winter timeAs well as a mosquito problem in the summerThe reason for the mosquitoes is that behind the building is a river that they don’t seem to put any mosquito repellant into so they breed everywhereThis place has a massive Dog problemThere niche in the rental community in Indiana is that they have no weight limit on dogsTherefore tenants are forced to live in a dog kennelThere are enormous dogs all over the placeOn multiple occasions I got barked at and lunged at by these huge dogs just walking to the dumpster or to the mailboxMeanwhile these same dog owners do not hesitate to turn you into the office if your dog does anything wrong instead of just coming to you directly like an adult My next door neighbor had enormous dogs and woke me up every morning with their howling when she left for workNot barking but howling like a wolfThe managers refused to do anything about itFinally the parkingApparently I parked in the wrong spot one dayA spot that everyone used to park inIt wasn’t marked as no parking beforeNow it isThey stuck a huge sticker on my windshield as a resultA ticket from the landlord that was the size of a postcardThen it stayed in the sun for days bakingWhen I asked them to remove it they were nasty about itVery ignorant and they refusedI had an older car and I believe they would not have done this to some of the thousand dollar trucks in that same parking lotI appealed to the corporate office in York and the manager there was even worseShe dared me to press charges against Westgate stating that she knew the judge in Indiana County and implying that they would winI pressed the issue regardless of her ignorance and after weeks they finally sent maintenance out to remove the huge sticker from my car windshieldThis is a bad companyStay awayThe bottom line with Westgate Terrace is it was one thing after anotherI was in Indiana, Pa for college and the management was a constant distractionThey were just relentlessBelieve it or not I do not have any issues with my current landlord

June 16, 2016Dear Revdex.com,I received the letter dated Friday June 10, in regard to the additional concerns our customer has regarding this case.In the first letter I received on June 3, our customer stated that we “keep trying to charge us additional fees of $each month” and that “I have no doubt in my mind that they will continue to bill us for this every month.”In my response I explained in detail when and why the $was changed and verified that it was only charged once, not that we charged it on numerous occasions as the customer had alleged.In the letter dated June 10, the customer is now saying that his claim was not that he was charged twice but that there should never have been a charge to begin withThis is clearly not what he stated in his original complaint.I just want to reiterate that the $charge in dispute in not a fee or an “extra charge” as the resident is allegingIt is the result of the rent increasing on 05/27/when the new lease beganI have enclosed copies of the renewal letters that the resident received in February and in March These letters give several different lease term options for renewal and they state the dates that the lease will runAs you can see, on the letter dated February 20, the resident indicated that he wanted to do a month lease renewal with the dates running 06/1/155/26/After the renewal letter is brought back to the office we generate a new lease document using the rate and the dates that the resident indicated on their renewal letterThe resident also signed the lease agreeing to these dates.This year the resident received the letter dated March 3, and again indicated that he wanted to renewal for months at the $rate with the lease dates of 05/27/2016-5/22/He also signed the corresponding lease that followedIt wasn't until he received the transition letter that broke down how the rent of the month of May would be charged that he took issue with the lease datesWe went back and forth several times and, to satisfy his request, I agreed to redo the lease beginning 5/27/to end on 05/31/so that there would not be a transition month at the end of that lease termThe lease would still begin on 05/27/which meant the transition month would still be in effect this year, which I explained to the resident in the emails that I've enclosedI never agreed or promised that anything would be removed, since that is a rent charge and not a fee.I have also enclosed a copy of the resident’s charges and payments beginning on 4/1/As you can see, going in to the month of May he has a balance of $for a gas billOn 5/1/his rent charged in the amount of $764.00, giving him a balance of $On 5/1/he went online and made a credit card payment of $($in an actual payment and $in a credit card transaction fee), his Autopay was withdrawn for his rent in the amount of $and the $was withdrawn to cover the rent increase effective 5/27/Since he paid more than the amount of his gas bill this left him with a credit of $and then the credit for the lease renewal was also added to bring the total credit amount to $The intention was for that $credit to sit on the account until 5/when you see the lease renewal charge.The residents next gas bill charged on 5/09/in the amount of $Keeping in mind that he had already paid $of that bill with the credit he had, that would have brought his gas bill down to $On 6/1/he made a payment toward that bill of $8.86, along with a credit card transaction fee of $which is why you see the total payment of $With the balance on the gas bill being $and the payment being $that leaves a balance on the gas bill of $which I believe is what has confused the resident about why he still has a balance on his account.I have redacted the resident's name on all of the enclosed documents to protect his privacy but I am happy to provide original documents if neededI can assure you that there are no 'shady business practices happening in my officeWe have made changes to the renewal process in the recent years, include the staggering of the lease end dates so that all of our leases don't expire on the same dateThis is why the resident is saying that he never experienced a transfer month in the pastHowever, I think we did our duty in notifying the residents of the change by including the dates the lease will run on the renewal letterThe residents have a personal responsibility to read the renewal letters and leases they are signing and ask questions if there are things that don’t make sense to them or that they are uncomfortable with prior to signing those documentsThe residents always have the option to give their notice and move out if they are not happy with the terms of the renewalThat is why we send out the renewal letters well in advance of the lease expiring.If you need additional information please feel free to contact my office.Sincerely,Shannon R***Property Manager

June 7, 2016Dear Revdex.com,On Monday June 6, I received notification that a complaint had been filed against our office by one of our residents in regard to what he believes is a billing errorI have reviewed his account and found no such error.This resident had a lease that
expired on 5/26/For that lease term he was paying $per monthHe was sent a letter asking if he wanted to renew the lease effective 5/27/at $per monthHe agreed and signed the new lease documentsAfter the lease was signed he received a letter addressing the charges for the month on May when his lease renewed and the charges increasedWe refer to this as a transition letter and provide it to all of our residents when they renew their leases and the leases roll over some time during the monthThe transition letter showed that his rent would be prorated from 5/1-5/at the $he had been paying, for a total of $640.77, and then prorated from 5/27/16-5/31/at his new rate of $for a total of $When you add those figures together the total owed for the month of May was $This is $more than the resident is used to payingHe was upset when he received the letter and believed the $was an extra fee that he was being charged, rather than just a reflection of the increase in rent when the new lease began on 05/27/2016.This resident is part of our Autopay program and has his rent automatically withdrawn from a bank account on the 1st of every monthOn the first of May there were two payments withdrawnOne for $764, which was his regular rent for the last month of his lease, and one for $to cover the transition month increase that he received the letter aboutThe $was intended to sit as a credit on the account until 5/27/when the lease changed over and the computer system charged the additional rentHowever, this resident also received a gas bill on 5/9/in the amount of $I believe this resident saw the credit on the account and applied it to the gas bill rather than letting it sit there until the lease changed over on 5/When this resident saw the charge show up on the account he believed that we had charged him for it twice, which we did notThe $remaining balance on his account it simply a result of his using that credit toward the gas bill and therefore underpaying the gas bill by $6.12.When this resident contact me via email regarding the charges I directed him to contact our Resident Accounts representativeWe do not actually handle any billing or payments out of our office, everything is done at our corporate office and we direct any questions regarding accountsor billing to our representative thereHe came into the leasing office where he was directed to do the same thing by the leasing consultantsHe refused and very aggressively told the leasing consultants that they should do thatI then received another email where he stated he would not contact Resident Accounts because they don't work at our location and have no clue what is going onThis is not true as I actually contacted Resident Accounts myself to make sure I understood the billing since it is not something I directly deal with.I am happy to provide copies of this residents transition letter, leases or a copy of the transactions on his account so that you can see the $that is in dispute was in fact only charged onceIf you would like copies of these documents please contact my office.Sincerely,Shannon R***Property Manager

I am rejecting this response because:I NEVER AGREED TO BE CHARGED FOR A TRANSITION MONTH!  That is the whole reason I had them redraw the lease.  There was never any mention of any TRANSITION CHARGES.  When we signed the Renewal Options form, it made no mention of any such thing.  It stated only the new rental rate or $802 monthly.  When I received the letter about a transition month, well after all the lease documents had been signed, I then requested to have the lease redone because I DID NOT WANT to pay any further charges.  I REQUESTED to have the start and end dates BOTH CHANGED, but she denied and only changed the end date.  I never asked to have the lease term shortened and I NEVER AGREED  to pay any transition month charges of any kind.  Find any documents where I agreed to pay transition charges, THEY DON'T EXIST!!!!  The lease was changed, therefore there was no transition month and we should have never been charged.  She conveniently failed to enclose my email responses where I said I NEVER AGREED to pay any transition charges because they were supposed to be removed because I requested the lease to be changed both start and end dates for the last 2 years.  This just CAN'T BE LEGAL, we have to have some rights as consumers!  They need to disclose prior to signing any renewal documents about any additional charges.  If this had been done, I would have disapproved but would have paid the fee.  I am sick and tired of this back and forth, please just credit the $6.12 back so we can be done with this!!!!!!!
