I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
 In my original complaint I have the wrong name for the dealer I purchased the new motor from. It is [redacted] not [redacted]. The rest of his resolution response is completely different than my phone conversations with [redacted]. I need to wait for completion of what he has informed me he will do to correct this situation and close this case. Per our phone conversations he has agreed to pay for the repairs to the new motor and reinstall the trim tabs correctly including repair of the fiberglass of the original install . He did offer additional financial compensation but that is not necessary since I do believe the Old motor did need to be replaced.

18 August 2015 : This will be the last response The Boat Grotto will share with public, after this, we will file a lawsuit, along with all receipts, and encourage folks if you have a dissagreement with any business, call them . Work it out. Communicate. Dont let people write a bunch of bt on you so you HAVE to give in...its not right!  Businesses have legal rights as well agaisnt bashing. This is one of the biggest bt complaints I have ever been part of ! seriously..it is! Dont hesitate to call me or email me, or text, my phone is on 24hrs a day, 7 days a week!  PERSONAL CELL#  (619) 840-1977We have been in business since 1999, thats over 16 years... 2 service complaints in 16 years !  in my eyes, I would say thats a wonderful history !Also, both proven non associated damage after dealer had marine survey completed . The results are posted. ok [redacted],                 Here we go again....We WILL GIVE YOU a 100% refund IF [redacted] produces documentation of these $500 yamaha full engine services you so-called had done at a local yamaha authorized dealer in san diego. 100%. You wrote it , PROVE it now.Understand, Changing a water pump and changing 4 spark plugs is NOT a yamaha FULL authorized service for an 150hp 4 stroke engine with 2100 hours, its MORE indepth. alot more work, alot more parts. We EMAILED him receipt/invoice of all work preformed and completed , engine service, parts, gas removal, sea trial before he picked up his boat , also when he picked up boat , and paid he received hard copy of paid in full invoice/receipt.No adjustments will be made unless documentation of this (so called) $500.00 authorized yamaha service completion is faxed or emailed. The second engine purchased from "[redacted] should of been sea tested . On [redacted] sea test, the trim tabs would of been deemed installed incorrectly. 
And  IF INDEED the trim tabs where installed incorrectly that they where involved in the engine failure , they should of notified you immediately, simple protocol. If a sea test was not done, we dont know if the trim tabs where actually the direct cause of this catastrophic engine failure sir. we would of made the changes of install. Sea tests are mandatory for new engine installs ,This is REQUIRED on all new installs from manufacturer. We need sea trial test results in writing from dealer. we record all sea trials on new engine installs. 
 
we are an authorized dealer in san diego, we go by these guidelines. 
 
(our sea test, our sea trial)  August 2013, On Mr [redacted] mercury  ENGINE,  We immediately turned around because we realized the engine was "missing". The engine was not running correctly and we informed the customer that immediately., thats why he brought his boat to another dealer to get a second opinion, and apparently they said the same thing, he needed an engine replacement. 
 
Now, Outboard engines have a cowling , the cowling protects the engine from engine and boat water spray. Mr [redacted] outboard engine(first outboard) was too heavy . Heavy outboard lowers the water line, thus water enters into the cowling of engine.  We did NOT install this engine on Mr [redacted] boat. Whom ever did this, they are responsible. customer was made aware of this. 
 
[redacted] IMPORTANT NOTE :  trim trabs lift the rear of the boat , they do not drop the stern down, they lift the stern up. So stating the "trim tabs " where installed incorrectly is simply incorrect. We follow strict manufacturers installation guide lines on trim tab installation. And to be quite frank, they are very easy to install. They guideliens for install is very simple. 
 
The Boat Grotto will remove the trim tabs and refund the monies if customer is not satified with the trim tabs. 
 
We will contact the trim tab  manufacturer concerning this issue because the boat grotto has protocol to contact the manufacturer of this complaint. 
 
Please be advised, we will need the following for our investigation:
 
We will need the boat to complete a thorough investigation on allegations that boat trim tabs where installed incorrectly causing new outboard engine failure. 
We also need [redacted]'s statement that the trim tabs caused the new engine failure directly on brand new engine.
We need year make and model of new outboard purchased from [redacted]
 
Please understand, these are serious allegations, serious steps will be taken to ensure a proper investigation and steps to understand what has happened. 
 
we will co operate to fullest extent because being accused of installing trim tabs incorrectly simply sounds like finger pointing to a devastating engine failure. 
 
we have been in business for over 16 years, I promise we will find out what exactly happened and everyone will be able to see report of findings.

08-15-2015: RE: 2005 150hp outboard yamaha 4 stroke engine boat was NOT running on all 4 cylinders when arrived. We tested fuel pressure and fuel itself and found Salt water in excess of over a gallon was found in fuel tank. and all fuel was taken out and disposed , salt water destroys all...

components such as fuel injectors. The engines fuel injectors where all checked and the recommendation was replacement of all four because the others follow. The last thing an engine needs while running wide open is a fuel injection failure and then a $12,000 engine fails because the dealer replaced one or two injectors and the others failed. This happens alot! all of his injectors suffered salt water damage, two failed, others weakened. Not an even flow on any. This was explained. The labor of fuel injectors where as follows: we removed all four injectors, taken down to injection shop, injection shop said they where not rebuildable,ordered new injectors from factory, re-installed new injectors, taken boat to gas station add new fuel,sea trialed boat and brought back to shop, cleaned boat and got ready for delivery. this took over 6 hours. customer complained that we charged him for that? For fully making sure boat was operational and sea tested?Being we are the authorized yamaha service center dealer, and not an independent non authorized, non compliant shop, yamaha motor corp recommends an even fuel flow in a combustion engine, we replaced all four injectors with the customer authorization BEFORE we proceeded. I personally expalined Every thing to customer in detail,costs of parts and service, then he authorized to me on phone more than twice we spoke on phone concerning the issues, once authorized, we proceeded , then completed, and sea tested and boat engine runs at 100% , all fully  authorized by customer. We had the boat for over a week. customer upset for the cost of service of engine, we had not changed our prices in 5 years standard service for engine $475.00 plus parts for powerhead service , $289.00 plus parts for lower end service. Thats for a full authorized dealer service for 4 stroke outboard from 70hp to 250hp outboard engine. has not changed for 5 years. The invoice was emailed to customer before he picked up vessel. In closing, the boat grotto has a signed work order from when he checked in.I personally spoke to customer on all costs, parts and service.parts and service was completed, boat was sea trialed, engine was rinsed, boat was washed, and delivered to customer in one week.after all was completed, customer taken boat, now he complains of costs afterwards. never once did he voice concerns of costs when they where explained and itemized to him by me on phone, he just did not add up all the costs when he authorized. Here is my last response. I was at the business a few years ago, and it was ran by an older gentleman. I don’t know if it was your dad or not. I looked at all the complaints that happened in the last three years, and it seems like you’re piling up the complaints very fast since you took over.
In front of the judge I will ask when and where did you send my fuel injectors for testing? And who said they all failed and are not able to rebuild? I need to talk to the three employees that worked on my boat. Good luck sir.

In your words boat was NOT running on all 4 cylinders
when arrived, if all injectors failed, the boat shouldn’t run at all, I owned
the boat for 11 years and I know my boat, it ran 75% of its power on the last
trip. I asked Neal the president of H2O Marine how much for the labor to
replace 1 injector and 4, he said the price should be the same. My boat have 4
injectors and you charged 5.5
x $125 = $687.50 for labor.
Any one read this can call any small outboard boat
owners, any boat dealers, and ask for the price of tune up and water pump. The
price is around $600. You charged me $1,021.71
Do you have the receipt of the specialist you hired to
clean my fuel tank? Please save all documents of my boat service. I’m sure you
lied about the water in my gas tank so you can do the tune up, you pocketed $475
and do nothing because there was no water in the tank. I should pay you parts
and labor for 2 injectors only. This was what my boat needed.
I read two other complaints in this Revdex.com website, they
said the same thing. You lied to your customers, you did unnecessary repairs,
and over charged.
