I am rejecting this response because: TravelInsured failed to respond the the letter from my counsel with *** TravelInsured also failed to acknowledge that under the American Disability Act, policies are to be adjusted /changed when service animals are involved I requested their policy on service animals with no response Please provide me with that information as I represent one of thousands of individuals that require air transportation with their canines.Also, *** does not offer choice of insurers.This is my first experience flying with *** and my first time purchasing travel insurance There is no customer support representative available from TravelInsured when purchasing the insurance It is not with malicious intent that I have filed this claim The critical illness that my canine experienced was unexpected My canine is my companion, my protector, and my family He is allowed in any establishment, and is always by my side I have engaged numerous members of dog organizations that have contacted other travel insurance companies who confirmed that with a veterinarians statement of the canine's illness, which you have on file, the claim would be paid Your policy is discriminatory

The plan the insured purchased is captioned “Group Deluxe Protection Plan”. This plan provides an array of travel related benefits, including coverage for trip cancellations. This benefit is payable if a trip is cancelled due to specified reasons. The insured opted to purchase the Optional Cancel For Any Reason benefit that provides trip cancellation coverage irrespective of the reason for cancellation. The Optional Cancel For Any Reason benefit in the plan clearly states that “If you cancel Your Trip for any reason not otherwise covered by this plan, benefits will be paid for up to 75% of the Prepaid…Payments You paid for Your Trip Provided:…c) You cancel Your Trip hours or more before Your Scheduled Departure” The trip Terms & Conditions given to the insured also states “ CFAR coverage is 75% of the nonrefundable cost. Trip cancellation must be hours or more prior to scheduled departure” The plan policy is clear and unambiguous and the insured was or should have been aware of the hours requirementWe are not aware of any material fact that would justify payment of this claim

Travel Insured International (TII), is the claims administrator for the travel plan that includes short-term travel insurance benefits underwritten by *** *** *** *** ***, and we appreciate the opportunity to address the insureds concernsOur records indicate that the insured
purchased their travel arrangements and obtained their travel protection plan, the *** *** *** directly from a *** travel agency/tour operator, *** *** In their complaint, the insured is requesting reimbursement for the trip purchased because it was cancelled due to the fact that *** *** has apparently ceased all of its operations and they have submitted a claim under the *** *** *** plan for reimbursement. As we will explain in more detail below, a trip cancellation that was caused due to *** *** ceasing its operations is not an eligible covered reason under the plan issued to the insured. The *** *** *** plan provides Trip Cancellation benefits when the trip is cancelled due to a covered reason as defined in the plan. The *** *** *** plan reads, in its applicable part that: COVERAGE ATRIP CANCELLATION “Benefits will be paid, up to the Maximum Benefit Amount shown in the Confirmation of Benefits, to reimburse You for the amount of the Published Penalties and unused non-refundable Prepaid Payments You paid for the Travel Arrangements when You are prevented from taking Your Trip due to … “Bankruptcy or Default of an airline, cruise line, tour operator or other travel provider (other than the Travel Supplier, tour operator, travel agency, organization or firm from whom You purchased Your Travel Arrangements) causing a complete cessation of travel services more than days following Your Effective DateBenefits will be paid due to Bankruptcy or Default of an airline only if no alternate transportation is available.” As noted above, the insured purchased coverage from *** ***. Per the plan language quoted above, a trip cancellation caused by the Bankruptcy or Default of the travel agency or tour operator from whom coverage was purchased is not covered under the plan. Please note that the plan purchased does provide coverage for the reissue fee charged by the airlines as defined in the Trip Cancellation provision which states: “If Your Travel Supplier cancels Your Trip, a benefit will be paid for the reissue fee charged by the airline for the tickets”. However, since the airline tickets were not issued they are unable to be changed and therefore benefits are not payable Based on the foregoing, no benefits for this Trip Cancellation are payable under the plan issued to the insuredWe are sorry for the disappointing situation that has occurred as a result of the actions of *** *** and that the claimant was not satisfied with the outcome of the claim. However, we, as claims administrator, are required to adjudicate all claims in accordance with the terms and conditions of the applicable plan As an accommodation, we are willing to provide the insured with a refund for the travel protection plan purchased in connection with their trip in the amount of $368, which represents the plan cost paidThe refund will be mailed to the insured

purchased the plan via telephone on May 23, Our representative explained to the insured that the trip cancellation benefit would be effective at 12:a.mthe next day and all other benefits would go into effect on the date of departureThe insured stated that her initial trip deposit was made on 4/26/and our representative told her that she did not qualify for the pre-existing condition exclusion waiver as she did not purchase the insurance within the required time frame. The plan document was emailed to the insured on 5/23/ The insured filed a claim for trip cancellation benefits and stated that she cancelled her trip due to her mother’s sickness While the plan excludes any loss due to, arising or resulting from a pre-existing condition, upon review of this claim we recognize that in California, the exclusion applies only to persons scheduled or booked to travel as follows: A pre-existing condition is defined as an “illness, disease, or other condition during the day period immediately prior to the date Your coverage is effective for which You or Your Traveling Companion, Business Partner or Family Member scheduled or booked to travel with You: 1) received or received a recommendation for a test, examination, or medical treatment for a condition which first manifested itself through the occurrence of symptoms, had symptoms that worsened or became acute or had symptoms which would have prompted a reasonable person to seek diagnosis, care or treatment; or 2) took or received a prescription for drugs or medicine” Since the insureds mother was not schedule or booked to travel with her, the pre-existing exclusion does not apply Unfortunately the insureds claim was erroneously declinedWe have overturned the claim decision, approved the benefits, and issued payment in the amount of $for the airline penaltyWe apologize for the oversight and any inconvenience this has caused

I am rejecting this response because:As of January 1, 2014 health insurance companies are BARRED from declining people coverage due to a pre-existing condition. Why your organization, as a TRAVELERS insurance, feels it is within your right to continue this archaic practice is beyond me. And as I have said many times; My father in law WAS NOT AWARE he was ill until he DIED.  He received no treatment for his illness. He was admitted into the hospital and he DIED less than a week later.I did receive an update that they said they not have received the medical records and that our claim is being expedited, of which I am grateful. for. I am eager to see how this will be concluded.

The insured cancelled her trip due to a mental or nervous condition.    Benefits are not payable for any loss due to, arising or resulting from a mental or nervous condition, unless hospitalized for that condition while the policy is in effect for you.   We did not receive any...

documentation showing she was hospitalized for the condition while the policy was in effect; therefore, benefits are not payable.   The policy was sent to the insured immediately upon purchase. If the insured was not satisfied with the policy for any reason she could have cancelled the policy within 14 days of purchase and received a full refund of premium.   Unfortunately the sales call was not recorded; however, the representative that the insured spoke to is a senior representative and is aware that [redacted] is not covered unless hospitalized. At the time the insured contacted us to notify us of the claim, she had already cancelled the trip and she was not advised it was a covered reason for cancellation.
