Not a professional and reputable and reliable home builder at all, these people are scammers, who takes people money and do not do any construction work for several months and even year, I was waiting for my home to be built since last September, but till end of May nothing was started and I wasNot even given startdate at all even though I asked them numerous times, but I got careless answer from the sales person Kristen that I don't know , I don't know the date, these people didn't even pay for and got the permit from warrington township yet,I even got the mortgage commitment in march then also they didnt start anything, even I emailed their corporate office many times butNot even a single time they replied, and when I asked for my deposit back they replied they will put the lot on market fistand pnce they find the buyer they will refund me my 100% deposit, and I asked them to send me that in writing, and they never did, after weeks on putting a lot on market , Kristen a sales person who was working there for oakcreek at Warrington community,she replied that we have found a buyer now but builder is asking to hold $10,of my deposit from $56,total deposit I have given them , and I questioned this why I guys are backing out of your words by not refunding me my full deposit, and her answer was it's builder's decision, and I rejected that offer, and I told them I will go through my attorney for this matter, and when my attorney sent them a notice to refund me my full deposit they replied in a ridiculous manner that your client backed out of contract and settlement date was08/05/and he backed out in end of may, and it was too early, this absolutely annoying, unprofessional, careless, reckless reply and answer from them , now I will need to go through legal process and file a law suit against this scamming construction company

We have not been able to get a response fro the Cutler Group after submitting a written evaluation of ours home's issue with stucco that Cutler "repaired" ongoing since we bought our home We still have issues and they will not respond to our emails or phone calls We submitted our findings on 6/6/and again on 6/13/via email to their service department We followed up with numerous phone calls including on 6/8, 6/15, 6/as well as at least other phone attempts leaving messages with the receptionist and in B [redacted] 's voicemail box No return call/email whatsoever We have had issues with stucco since our very first month in the house and are still living with unsuccessful repairs for the Cutler Group We want our house repaired correctly

Complaint: [redacted] I am rejecting this response because: The Buyer, [redacted] , denies the Seller, David C***’s first response that the “Agreement stated that they were going to secure a conventional mortgage.” First, David C [redacted] was notified of the FHA mortgage type in NOVEMBER because Page 2, Paragraph of the Agreement of Sale states that “the Buyer Agrees to make written application for a mortgage within days of the execution of the Agreement and further agrees to furnish to David C [redacted] Group.” Here, the Official Letter of Commitment from [redacted] Mortgage was received and accepted by David C [redacted] Group on NOVEMBER 14, and as requested the Letter of Commitment was provided again on JULY 16, and David C [redacted] Group NEVER rejected the mortgage type or mentioned any issue with the FHA mortgage to the Buyer or to the Mortgage CompanyIn addition, Paragraph of the Agreement for Sale simply states that “the buyer is to obtain a conventional first mortgage ” It does not say the buyer SHALL or MUST have a conventional mortgage, thus making it acceptable and allowable to have a FHA mortgage which was always known, approved and accepted by David C [redacted] Group Next, the Buyer, [redacted] , denies the Seller, David C***’s second response concerning the “condo insurance issues.” First, it was the David C [redacted] Group that first notified the Buyer of an insurance issue the day before (September 23, 2014) the scheduled settlement date of September 24, and there is nothing the Buyer can do—this is solely the Seller’s issue to resolveThe email from the David C [redacted] Group stated that they “were informed about the insurance issue, actually from another Buyer settling Thursday This will delay settlement quite a long time since the Builder will need to send a written request to Danella Management Company to increase coverage and then it will need to be voted on by the [redacted] Walk Board Let us know what you want to do?” Thus, it is and always has been solely the Seller, David C [redacted] Group, that is unable to settle on this property due to its inadequate insurance coverage on a mortgage it reviewed, approved and accepted nearly a year agoIn addition, David C [redacted] sent an email on September 26, that “MWCO Insurance agency did satisfy [redacted] Mortgage and the closing is scheduled for September 29.” Then, on September 29, as the Buyer, [redacted] , drove from Maryland to Pennsylvania ready, willing and able to settle with the full amount of certified funds for closing, he was notified hours before closing that “adequate insurance needed to be provided” by David C [redacted] GroupThat same day, the Buyer was told that the builder was meeting with the board “to approve a new insurance carrier ” Finally, the Buyer, [redacted] , denies the Seller, David C***’s third response concerning a “dispute between the brothers as a real reason for the default.” The Buyer provided a sworn, notarized affidavit denying the false, slanderous and unethical misrepresentations made by David C [redacted] concerning the parents and brother’s feelings about the sale of this propertyDespite this, the family remains unitedWe respectfully ask David C [redacted] to cease and desist his attempt to destroy the Buyer’s family relationships because David C [redacted] is unable to settle on the property due to his inadequate insurance and breach of the Agreement of Sale for failure to go to settlement as noticed As a recap: *?The Agreement of Sale dated August 11, states that settlement is to take place on February 14, *?An Official Letter of Commitment from [redacted] Mortgage was sent to David C [redacted] Group on November 14, *?An updated Letter of Commitment from [redacted] Mortgage was sent to David C [redacted] Group on July 16, *?On August 11, a Notice of Firm Settlement date of September 24, was sent by David C [redacted] Group to the Buyer *?On August 25, a Settlement Notice was sent by David C [redacted] Group to the Buyer *?On September 8, and September 12, an Endorsement of Sale with the Settlement Date of September 24, was sent to the Buyer from David C [redacted] Group *?On September 23, at 1:PM EST an email confirmation of settlement was sent to the Buyer from David C [redacted] Group *?On September 23, at 4:PM EST David C [redacted] Group sent an email delaying settlement indefinitely and asking the Buyer what he wanted to do IN ACCORDANCE WITH THE AGREEMENT OF SALE, PAGE 1, PARAGRAPH THE SELLER SHALL RETURN ALL MONIES PAID ON ACCOUNT OF THE PURCHASE PRICE TO THE BUYER Regards, [redacted]

Terrible delays and no communication has resulted in a painful year and a half ordeal Last minute delays, even of supposedly "firm" dates This has resulted in thousands (if not more) of dollars lost, and more than a year and half later, still having delays on settlement Can't get them to respond to anything They send an email Friday afternoon postponing a settlement that is supposed to happen the following week, and then will not respond to email or phone calls They do not care about the customer, it is clear

We bought our house from David C [redacted] (name has now changed to Hudson Palmer Homes) on 4/27/This included prepayment of $for landscaping that had not yet been installed Builder failed to deliver landscaping In October I requested a refund of my $ David C [redacted] approved this refund on 10/7/and sent us a signed copy of the approved execution We have not received the refund I have sent numerous emails and left several messages on their voicemail with no response No one ever answers a phone there My husband visited their office twice and was told there was no one there he could talk to and no phone number he could call to resolve this

4.Grading Our firm does the first rake and seed It is the buyer s responsibility to establish a lawn and water their property

How is it that Revdex.com gives them a grade of an A+ when there is nothing but complaints on here? I complained back in initially We have been in a lawsuit with the David Cutler Group for over four years throwing money at a lawyer in hopes of fixing our defective home only to find out that they claimed bankruptcy today--Kids college accounts good-bye! Retirement goodbye! They don't care So unfair that when we turn to people for help that not one person can provide an answer Our house, our most valuable and costly possession is worth nothing--literally rotting! Our life savings will be wasted on this and Cutler gets to claim bankruptcy?!??! FURIOUS

The Cutler Group has failed to live up to their warranty for our home

In I settled on a home built by The David C*** Group Lot #** in *** *** I had a home inspection company who specializes in stucco issues inspect my home and found issues with the stucco applied to the exterior of my home I want this stucco which is failing removed from my home and replaced by with vinyl siding either by David C*** or my own contractor

David C*** failed to properly construct our home that was built in January The *** *** *** inspected our home on October 8, and they recommended that the entire house be remediated to correct the improper construction that has led to significant damage to our home David C*** breached our contract, breached our implied warranty of habitability, and violated the Unfair Trade Practices and Consumer Protection Law We have tried to contact him and his service department numerous times by phone and email regarding the issues with our home We have not received any response from Cutler or his service team Our concern for our family’s health and safety has forced us to hire an outside contractor to perform the work necessary to fix our home This will commence on March 28,

We have had problems with our stucco and window leaking since we first moved into our home in August The David Cutler Group has made several repairs to try and correct their poor workmanship when the house was first built Unfortunately, none of their "fixes" have solved the issue We recently had a new independent stucco evaluation of our home and their were multiple problems found Some were found where the Cutler Group had completed their most recent repairs We submitted our findings in writing on June and June 13, to *** We have also called at least times to their customer service department and have left messages with the secretary and on Barrett's voicemail In the past three weeks we have not received any response even acknowledging our report

These allegations are completely untrueThe buyers had an agreement of sale without any sort of mortgage contingencyThis agreement specifically stated that they were going to secure a conventional mortgageInstead, they applied for a FHA mortgage which requires 5% down vsa conventional
mortgage which requires at least 20% percent downThe condo insurance requirements for FHA are much different than for a conventional mortgage requiring the condo association to carry much more insurance than a conventional mortgage would requireIn fact there are settled homes in this neighborhood and none had any problems with the condo insurance limitsThey were all conventional mortgages.The Cutler Group was at the closing with a certificate of occupancy from *** Township and all other necessary pieces of paper to settle this homeThe buyers sole obligation was to settle which they did not doThis home is being bought by two brothers for their parents, A email chain would evidence that there was a dispute between the brothers thus the real reason for the default
