The Kaplan Group Reviews (24)

We are very pleased with the collection results obtained through The Kaplan Group. We would recommend any business with a collection issue to seek the services of The Kaplan, a reputable and efficient collection agency.

The Kaplan group did a great job on a difficult deal. We were nervous because we have never used a collection agency before to collect on debts owed. Their process was clear and they keep in touch throughout the process. Highly recommended.

After many failed attempts at collecting payment from a difficult client, The Kaplan Group was recommended to us. Not only were they able to secure a payment plan from client, they kept us informed at every stage of the process and always replied promptly to emails requesting information.

Review: [redacted] of the The Kaplan Group contact me in October 2014 concerning a debt for my business, Creative Compliance. He was collecting o/b/o Springer, a publisher. My business, Creative Compliance provides a service of arranging licenses to use third-party materials. In this particular case, Creative Compliance was contracted by Pearson to obtain licenses, one of which was for use of content from Springer. I explained to Mr. [redacted] that Creative Compliance was not liable. Pearson was the licensee and payee. I gave Mr. [redacted] a contact at Pearson. Mr. [redacted] proceeded to contact me months later. And again claimed that Creative Compliance was liable for the debt. I imagine this is because Pearson canceled the book and the licenses (including Springer) and they thought they would try harassing me to get the money. Here is the last email I sent to Mr. [redacted] and I supplied emails from Pearson, the true party responsible. He continues to email me.On Tue, Dec 30, 2014 at 1:11 PM, Jenn Kennett [email protected] wrote:[redacted],Creative Compliance is in NO way possible responsible for this debt and after this email, I am done communicating with you on this. Pearson hired Creative Compliance to obtain licenses for on their behalf. Pearson is publisher, licensee of the content, and the payee period. We would never even have been in touch with Springer, if wasnt for Pearsons direction, as they contracted us for those services, specifically. You have no idea what youre talking about on this book, it was put on hold a few times, then eventually cancelled. I have attached the last email correspondence with Pearson, canceling the project since emails seem to mean so much to you. Pearson said they would cancel the invoices. By the way, Pearson never used the content, nor published the book. But if you still feel entitled to payment, you need to pursue it with Pearson, not Creative Compliance. Now if you continue to harass me, I will contact my attorney.Desired Settlement: A written statement that Creative Compliance is not responsible for the Springer license and to cease all collection activity.

Response:

The complaint leaves out a few details. As Jennifer explained, she gave us a contact

at [redacted] and we discussed the matter with [redacted] got back to us and said they do not

believe they were responsible and felt Creative Compliance was the responsible

party. We then contacted our client

Springer for more information, which they provided, including an email from

Creative Compliance where they ordered the service. When we contacted Jennifer a couple months

after the initial conversation, we provided this documentation and explained

why our client felt Creative Compliance was liable and asked us to continue to

pursue the balance owed.

After Jennifer filed this complaint, I as President of the

company contacted her. During that

discussion, Jennifer offered to provide additional documentation on this

matter. Upon receipt of this new

documentation, we reviewed the information and shared it with our client Springer. Springer has now responded that based on this

new documentation, we should discontinue our collection efforts against

Creative Compliance.

This is the first complaint in 24 years of business. Had Jennifer provided this other

documentation earlier, or asked to discuss this with a manager at our company,

I’m sure it would have been resolved without requiring a complaint. All we needed was the documentation to

support her position. We believe this matter is now resolved but await confirmation.
