The account was charged off due to the customer breaking the arrangements made between customer and C&F Finance Company The original arrangement made between the parties was that the customer was to make partial payments of $until the obligation was paid in full However, the payment that was set up to run on 07/02/was declined by the customers financial institution C&F Finance Company tried on several occasions to contact the customer regarding the account and no contact was made nor were calls returned from the customer C&F Finance does not accept partial payments and went beyond our business practice to assist the customer so that she could properly pay her obligation Since the payment was declined and no further contact was made, C&F Finance Company followed our policies and procedures to charge-off the account and pursue collection The account was charged-off on 07/10/ On 07/14/2014, customer called to the office and was advised of the account status and again agreed to make partial payments of $on the 30th of each month A payment was sfor 07/30/and was the last payment received to date Customer failed to make the 08/30/payment and has not answered calls or messages left Customer called the office on 09/30/2014, a new arrangement was made so the customer could pay $per month and an automatic deduction form was sent to customer As of 10/20/2014, the automatic deduction form has not been returned and calls made to the customer have not been returned

For the first complaint, the consumer filed Chapter bankruptcy on 12/5/13, case # ***, which was later dismissed 3/20/for failure to make planned payments. Ten days after dismissal, the account was placed for repossession for non-payment. The consumer then
again filed another Chapter bankruptcy on 4/18/14, case # ***, however the order extending the automatic stay was not signed until 5/13/14. When the debtors attorney contacted us on 5/12/to advise the motion to extend the automatic stay was granted we immediately arranged to have the car returned that day. We stayed in constant communication with the attorney and expedited the return of the collateral.
For the second complaint, representatives of C&F Finance Company delivered a blank envelope with only the customer’s name on the outside and a ‘Please Contact Us’ letter inside. C&F Finance Company has exhausted all avenues in order to reach the customer and have been unsuccessful. As per FDCPA guidelines, C&F Finance Company properly placed a letter in a blank envelope with no company identifying marks on the outside of the envelope, as to not disclose the possible affiliation with customer. The representatives would have left the envelope taped to the door had the minor daughter not answered the door

To whom it may concern, below is the timeline of the activities that were taken on *** ***'s account
October 14th-*** *** called the office and talked to a C&F Finance Company (C&F) representative. During this conversation, *** *** stated that she was going to
make a full car payment of $464.39 at a C&F Bank Branch on 10/14. *** *** would then make full payments, ($each installment) totaling $928.78, on 10/24. *** *** indicated that the reason she had fallen behind was due to starting a new job
October 17th-The payment of $464.39 was not made as *** *** indicated during her October 14th phone call. A decision was made by management to place the account out for repossession on 10/
October 21st-*** *** called the office, a C&F representative advised *** *** that she didn’t keep her initial arrangement from 10/and that is why the vehicle was placed out for repossession. *** *** indicated that her paycheck was late causing her not to be able keep the arrangement. The C&F representative advised *** *** that we did not receive a online payment. *** *** then indicated to the C&F representative that she or her husband would make a payment at a C&F Bank branch today and make a payment on 10/24. The C&F representative placed the account in a hold status until 10/22, so the vehicle would not be repossessed during this time period. A payment was made, at a C&F Bank branch, on 10/21 for $464.00, below the required monthly payment of $464.39. A C&F representative spoke to *** *** advising that the new amount of $needing to be paid on 10/24.
October 24th-*** *** called in to the office and spoke with a C&F representative indicating that the paycheck she was waiting on was mailed to the wrong address, but her employer is sending her another check via FedEx. *** *** stated that she should have the money by Monday at the latest and will pay then. The C&F representative agreed to allow *** *** until then to make the payment as agreed in prior conversations
October 28th-*** *** pays $at a C&F Bank branch, below the amount agreed too by both parties during the October 21st and October 24th conversations. However, this is enough to cancel the repossession activity, which was cancelled on October 29th
October 30th through November 10th-Phone calls, voicemails, and emails were placed to *** *** attempting to get her on the phone to resolve the past due status. None of the phone calls or e-mails were returned by *** ***
November 10th-Vehicle was placed out for repossession due to *** *** not returning our calls and not following through with the promises for payments as agreed
November 11th-Vehicle was repossessed
November 12th-*** *** called the office and spoke with a C&F representative advising that the vehicle has been repossessed and that she isn’t interested in redeeming the vehicle. *** *** questioned why the vehicle was repossessed. The C&F representative explained to *** *** that the vehicle is 3 payments past due, the agreements made were not fulfilled, and attempts to communicate with *** *** were unsuccessful
With regards to *** ***'s desired resolution, the monies paid will be applied to the account and will reduce the amount that will still be owed, the deficiency balance, after the vehicle is sold at auction. A letter detailing the sale and the deficiency balance will be sent to *** *** following the auction. The monies paid towards repairs may assist in bringing in more funds at auction which could reduce the deficiency balance. If *** *** has any further questions, please contact our office

[redacted] set up payment arrangements of $100 monthly beginning 12/31.  [redacted] called on 12/3 to inquire about the payment arrangement letter sent, she was advised to give it until the end of the week to arrive and if she had not received the letter to call back.  [redacted] has not...

been in contact with our office since 12/3.  A new letter will be sent out 12/09 with a review of her payment arrangements.  A judgment will be sought to secure our interest in the debt.  This is a normal business practice for C&F Finance Company with all Charged Off Accounts.  Once the judgment has been paid in full, we will then notify the courts that the judgment has been satisfied.    [redacted] vehicle was repossessed on 10/18 and she did not contact our office until 10/30.  On 10/30, she was given the repossession agents phone number for contact as they would be in possession of any belongings in the collateral.  C&F Finance Company does not have nor never had physical custody of the collateral.  The repossession agency takes possession of the collateral until it is deemed available for sale at auction.

An investigation was completed for this account by C&F Finance Company Management and the following was found:- A Cure Letter was sent on 12/17/2014 by registered mail.- Calls and messages left for customer were unanswered or returned between 12/17/2014 and 12/29/2014.- On...

12/29/2014, a repossession order was placed with vendor.- On 01/05/2015, a Notice of Repossession and Notice of Our Plan to Sell Property was sent to customer.       - The amounts stated in the letter are as follows:          - Pay current arrearage in the amount of $1,497.39          - Pay cost of repossession $350.00 and storage charges at the rate of $25.00     - The date stated for the Sale of Property was January 28, 2015On 01/05/2015, customer returned a call placed by collector.  The customer was quoted $1,847.39, which was past due amount of $1,497.39 + repo fee of $350.00.  The customer was also advisedthat she would have to pay storage fees directly to repo agent.  All redemption information was sent to customer and the collector placed the account on a redemption hold until 01/12/15.On 01/12/2015, collector called customer and left message for returned call.  No response from customer so normal repo actions were taken.On 01/21/2015, all ancillary products were cancelled and the vehicle was moved to auction.On 01/22/2015, collector spoke to customer regarding account.  Management pulled the recorded call and verified that collector correctly stated the amounts due of $1,847.39.  Customer requestedthat we hold vehicle from sale until 02/04/2015.  The collector placed the customer on hold and went to obtain approval from management to hold car until the requested date.  When the collectorreturned, the call had been disconnected.On 01/26/2015, the last contact with customer's mother took place.  The collector explained to the mother the redemption process and was told that the funds would have to be received by 01/27/2015in order to stop the sale.  No funds were received and the vehicle was sold as scheduled on January 28, 2015.In summary, C&F Finance Company did everything possible to assist the customer to redeem the account, but without communication from customer and funds to cure the account, C&F Finance proceeded with normal repossession actions.  No violations of law or business practice were committed during the redemption process. ?

C&F Finance does not offer refinancing options.   If a customer wishes to refinance, they would need to do so with a bank or credit union.  The customer has called our office and reached us 3 times over the past 50 days, showing the ability to make contact...

with C&F Finance.  Due to the unaddressed delinquency of the account, C&F Finance Collections Department has been making daily calls to the maker.  Based on the customers statement in this complaint, customer knows of the past due status and can contact our office to make agreeable arrangements to resolve the delinquency.  Our collection center is staffed from 8:30AM  – 8:00PM Monday – Thursday and 8:30AM – 5:15PM on Friday.  Our toll free number is [redacted]  In the event the customer continues to have difficulty she may call our Collection Manager, [redacted] directly at ext[redacted]
