I am rejecting this response because I filed the complaint only after six weeks had passed since the contract was signed and the work had not been started or completed per the contractThird Estimate was on site and began the job on or around November 6th and completed it on November 15th Also, after the six week period and before November 6th, I had some of the work in the contract completed by another contractorThe Balance Due as stated in the original contract is invalid

We at The Third Estimate have a one year labor warranty (see attached) after one year we will come out to a previous customers home and do a service call for $100, plus the cost of supplies We did the job for the customer six years ago, When they called in to our office our staff let them know that the job was well outside the term of the one year labor warranty time frame and that we would have to charge the service fee, plus cost of materialsThey were not happy with this and felt the fee should be waivedAfter much conversation and many phone calls by all parties involved, we came out to their home free of charge, tried to address the issues but were unable to fix it for free.We explained it has been years and that on top of all the things that could naturally happen from storms and just wear over that time frame, they also had a satellite dish installed on the roofWe let them know that it could also be the issueThey decided not to have us do the service and that was the last we have had communication

We contracted to do Mrs [redacted] 's home in 11/and it was completed just over a month laterPer the contract (Attached: [redacted] -contract.pdf) that we have attached, it states that we would do it within 3-weeksWe understand her frustration, but in addition to finishing within the contracted time frame, we also were working around Ohio winter weatherAt the end of the job the [redacted] 's signed off on the job being complete and to their liking and we provided them with their 1yrlabor warranty and the additional manufacturer warranty on the product itselfMrs [redacted] contacted our office in the Spring of and we told her that her 1yr labor warranty had expiredWe let her know that if she would like us to come out we would gladly do just that, but we charge a $service fee and then labor and materials if any additional work needs doneShe was unhappy with this, but unfortunately her yrlabor warranty has expired and this is our policyShe then at that time let us know that the metal at the bottom of the door was installed incorrectly (Attached: [redacted] - [redacted] ) and she stated it was damaged at the time of install, which was not the case after further review of our job completion photos(I have attached a photo of the bottom of the door area that she said was damaged to show it was okay upon completion(Attached: [redacted] ) We strive to make our customers happy and to keep their business for years to comeAs we stated to Ms [redacted] , as a resolution to the issue we can gladly come out and perform a service on her home for a nominal feeWe understand the winters and weather can be hard on homes in the Northeast Ohio region

indicated numerous times that he was not satisfied with the end result and insisted on multiple visits by our companyAll work that the homeowner requested be done was completed on visits; October 28th, and November 4th, At that time, the homeowner indicated his satisfaction and signed for the completed workWe contacted the building department, on or about, November 4th, to request a final inspection of the propertyWe were informed on November 9, by *** in the Building Department that the projects indicated were inspected and passed on November 6th, We are not aware of any uncompleted work to be finished at this timeAlso, at this time there is still an outstanding balance due to our company and the homeowner has indicated once again that he will not pay the balance unless all work is done, per the approval of the building department, Due to the fact that we were told the final inspection had been approved and passed, we did not need to complete any further work at the propertyWe are more than happy to send the warranties to this owner as soon as we receive payment in full

There is no outstanding balanceWhether or not the city building department approves any or all work done has nothing to do with the fact that contracted items have not been installedApproval by the city was only part of the "punch list"The fact that there are items pending requiring correction by the city only adds to my argumentPer the contract, payment beyond 50% is not required until completionThe job is not completeAs a sign of good faith, I paid in fullThe attached contract is clearly marked "5% off if not complete by the end of October"On the Third Estimate statement dated 11/9/(attached) there is no adjustment for this penaltyIn their response, the Third Estimate indicates work was not complete by the end of OctoberTherefore, as indicated by my hand written calculations on the statement, I have overpaid by $
