This is in response to the letter addressed to our office, received on or about 04/18/2014.
 
Our contract is very clear we have done everything the contract terms state. You are just not happy with the end result of what the current value of your timeshare property is worth. Pursuant to the signed contract, if the timeshare did not sell after 10 months a market price offer would be made for the purchase of your timeshare. According to the definition of market price on your contract; “Market price means what a similar Timeshare most recently sold for on the current resale market.” The market price offers were made to you by our in house licensed Real Estate Broker, completing the contract.
 
There was NO specific amount guaranteed as we have no way to see the future value of any timeshare. If you believe your property is worth as much as YOUR requested sale price, you can try to sell it back to your timeshare company and see if they buy it close to the amount they made you believe it’s worth when purchasing. You should be more upset with your timeshare company.
 
We don’t make the market prices; we report them as they are completed by third parties other than us.
 
We submitted about three comparatives for your timeshare which are actual bona fide transactions done by buyers and sellers not affiliated with us. Unfortunately you have a timeshare property that at this date and time is not worth very much money on the re sale market as evidenced by the proof we submitted. Prices always fluctuate and we have no way to see the future value of any timeshare.
 
With that said, all services you contracted for have been provided by TSRSOnline, and we have completed the contract. Your timeshare has been advertised pursuant to the terms and conditions of your signed contract and we have made you the market price offer as guaranteed. Our contract is very clear, we admit no wrong doing or liability what so ever. Therefore we find no refund due at this time, we have completed the contract.

  This dispute is not resolved.  This company promised to market our timeshare in a timely and aggressive manner.  This did not happen.  They did respond with an offer after you notified them.  However, I believe our time share to be worth more than $20.29.  This company is not a reputable,reliable, or trust worthy business.  They want their money up front for everything, but fail to deliver. 
 
What they offered for our timeshare is $20.29.  We paid $10,000.00 for our timeshare.  TSRS said "we should have no problem selling this timeshare as the going rate in that area was 15-18 k". In the offer recently sent to us they ask for $479.00 up front again to have their legal company  handle all legal work should we decide to accept their offer. Again money up front.    What a joke!  To resolve this issue TSRS  needs to refund our money back.  This company is a joke and uses false advertising to prospective sellers wanting to sell their timeshares.  To resolve this issue refund our money back of $1,199.00.
 
I am working with the San Diego District Attorney and the Attorney Generals Office regarding TSRS business practice.

Review: I had a sales rep [redacted], (if I remember correctly) promised that he will sell my timeshare with in 2 to 3 months but it had been 8 months but I had not received single phone call feedback on my status. I called and complaint about false advertising and misleading on service, but all they said was they will remove my name from the listing if I am not happy about it but there is no refund. I had received no service. they never had done anything to sell my timeshare. this was 100 % fraudulent company.Desired Settlement: 200.00

This is in response to the letter submitted to our office on or about July 24, 2013 regarding a message submitted by [redacted]. This is our response. We have carefully reviewed the message submitted and there is no dispute that [redacted] contracted Timeshare Real Solutions to help market the timeshare. Our client entered into the contract on or about January 2, 2013, entering into a verbal contract agreeing to all terms and conditions. Shortly after entering into the verbal agreement a written contract was mailed to be reviewed, the contract was received signed by our office on or about January 14, 2013 with acknowledgment of all terms and conditions of the contract.

Pursuant to the contract, the client signed up for a “Home Page” this promotion is clearly stated on the signed contract as follows:

A. HOME PAGE PROMO: As a Home Page Promo member, you will receive a Home Page promotion on our web site for 60 days.

The Home Page promo highlights your property ad on the home page for greater exposure. After 60 days on the home page, your property listing will be transferred from the home page and then be marketed as an International Sale/Rental.

As you can see there was no “promise” or guarantee that the timeshare would sale in “2 to 3 months” or in any period of time, yet he did receive a home page promotion on our website for 60 days. Before entering into a signed agreement, the client was given the proof of delivery to show that the timeshare was being marketed as contracted and he also was provided with our website to see his posting at any time. Therefore, it was confirmed that we were providing the service contracted to do by [redacted].

We do not appreciate his false accusations made.

With that said, we find no refund due as we have been providing the services contracted for, for over 6 months now.

We understand he is frustrated but we are marketing the timeshare as per the signed contract and are hopeful for offers.

Review: Contract # [redacted] to sell a time share.

Contract signed 5-14-2012

terms were if after 10 months the time share did not sell, we were to notify the company in writing and they would then buy the time share.

10 months ended at the end of March 21. 2013.

Letter of intent for me was mailed to timeshare resale March 5th, 2013.

Letter dated March 27, 2013--Timeshare then requested, additional information that I feel was not needed. .

Additional information form was submitted 4-9-2013.

The 3-27-13 letter stated to please allow approximatley 12 weeks from the time additional information was received to receive an offer.

7-8-2013 I followed up on offer and advised to follow-up at the end of July.

Still working on offer.

8-9-2013- I followed up again as advised and told again still working on offer and to follow up at the end of the month. I advised the lady it says approximately 12 weeks not 20 to 24 weeks. I advised that this is unacceptable. I then called your office and found out they have an F rating.

Not sure what you are asking?? I did receive a proposal from TimeShare resale on 8/26/2013.. I was advised I would get a fair market price value. What was submitted is an E-BAY bid !!!!!!!!! According to the proposal one unit sold for 10 cents !!!!!!!

Really. When I first spoke to someone at this company ( [redacted] on 5-7-2012) I was told I would get the low end of the market value at that time was $11,000. To add insult to injury, the proposal is $71.95 and then I would need to spend another $1050. to transfer the deed. I orginally paid $997 to this company. I can scan the documents and sent them if it will do any good. I need to know if I can turn this over to the attorney general's office. This is a totl rip-off. Also how can I get the word out so someone else will not be scammed !!!!!

I did receive a proposal of $ 71.95 !!!!!!!! My understanding was that the unit would be purchased for $11,000 the low end of the market value. I was told this by Time Shares in 2012. Interesting instead of getting a normal fair market value comparison [redacted] sent me an E-Bay bid comparison !!!!!!!!. Insulting enough one of the winnng bids was 10 cents. Yesterday I sent a certified complaint letter to both Time Share Resale Source and [redacted] both at the same address. I did look her up on Department of Real Estate and she has a different address registered with them. I have kept good records and have my hand written notes from the original conversation with another Time Share Resale employee. If you need any of my scanned documents just let me know. I am going to file a complaint with the CA Dept of Real Estate Office. My question is can I complain to the Attorney General's office? Do you know? thanks for your help.......

Review: I listed my timeshare for sale with TSRSonline August 2011. After 7 months the timeshare was not sold, so they offered me the buy back program for $350 dollars, which stated after 10 months if they failed to sell the timeshare they would buy it back for fair market value. So 10 more months go by and they failed to sell it, they have now had 17 months to sell it. Because the 10 months had lapsed and they failed to sell the timeshare I complete the paperwork for the buy back program and they said it would take at least 3 months to gather comps on the property. I made several calls and was always told they were still working on it. almost 5 months later I received an offer for $70.95 for the timeshare...all comparables were from ebay. I was lied to and they failed to do what they said they would do. I also asked the price be reduced on the add twice during the 17 months to increase chances for them to sell it and they never changed the add price, after I was reassured it was changed.Desired Settlement: I would rather them honor their commitment and buy back my timeshare because they failed to sell it in the indicated amount of time for its value, with comparables from timeshares they sell, not an ebay bid price. They inferred it would be sold for the price listed by them. If they won't do that, then I would like my money back because they did not honor their end of the deal. ($649.00)

My timeshare is owned by [redacted] and is 333 points EOY. An offer of $70.95 from ebay is not a comparable. It should be not be compared to something that might not even be a real timeshare sold. There is no way to substantiate the comparables you sent. This obviously is designed to rip off the clients and is not acceptable. When I originally signed up for your service I was told by [redacted] and [redacted], VP that my timeshare should sell within 3 months...23 months later you still have not done so. I was also reassured when I paid additional fees for the buy back program, that they will put my timeshare to the top of list to be sold. It still was not sold. I want my $649.00 returned immediately.

The guarantee clearly states that, “For the purpose of this buyback provision, market price/value means what a similar Timeshare most recently sold for or is currently selling for on the current resale market.” We submitted about three comparatives for your timeshare which are actual bona fide transactions done by buyers and sellers not affiliated with us.

Unfortunately you have a timeshare property that at this date and time is not worth very much money on the re sale market as evidenced by the proof we submitted. Prices always fluctuate and we have no way to see the future value of any timeshare.

If you don’t already know, [redacted] has filed for bankruptcy in 2011. As a result, their properties have lost value and what we show in the attachment is what they are actually selling for.

Unfortunately this is out of our control and is not our fault. (Feel free to go onto their website for further details). We understand they have been bought out yet their value still decreased through this process, you should be more upset with your timeshare company.

With that said, we find no refund due as all services you contracted for have been provided by TSRSOnline, and we have completed the contract.

AFTER 1 YR AND FEW MONTHS THEY SENT A LETTER SAYING IT DID NOT SELL. BUT THEY WILL BUY IT BACK FOR $42.50 YES FORTHY TWO DOLLARS AND 50 CENT WHEN I CALLED THEM THEY SAID THATS WHAT TIME SHARES LIKE WE HAVE ARE GOING FOR. THEN THEY SENT TWO OTHER BIDS ONE FOR $20.00 FORM SOME ONE . THIS IS WHERE THEY MESS UP THIS WAS A SCAM THEIR CONTRACT AND THEIR TALKS AN LETTERS WERE ALL SCAMS THEY TOOK $895. Review: On 2-2-2012, my timeshare was listed with TSRSonline, for their price for listing $999.00 Their advertisement guaranteed that if my property was not sold within 10 months from this date, they would buy the property. Their representative advised me not to pay annual fee at the timeshare. I have been in constant contact with their company over the past year and 10 months. The last contact was with a letter from [redacted] which offered me the sum of $1.75 for my property and a list of contingencies. Their original offer for buy back was $10,725.

I feel that I have been scammed and want to file a complaint against this group.Desired Settlement: To find reasonable way to recover what I have lost through their deception.

It seems that I am not the only victim of this "scam" as you will find web posts regarding others who have encountered the same as I (see [redacted]). I cannot think that this company would have thought that they conveyed the possibility that the price of my timeshare would be as little as their $1.75 offer. I have contacted the company who holds my property and was told that my property was listed in Forced Resale, with a price of $9,100. TSRS falsely advertised and I will continue this until there is an equitable resolution.

Review: Information about the timeshare buyback program was misleading and directly contradicted information in the TSRS contract and information I received verbally from representatives of TSRS. I was told by a rep at TSRS that the "timeshares could not be bought or SOLD if "they weren't already paid off in full." The contract makes no mention of this and a different Rep said exactly the opposite. TSRS waited until my contract was nearly up and I was calling everyday (23rd month into a 24 month contract) to make me an offer they claimed was "market value". Market Value was blatantly incorrect based on research I conducted and info verified by [redacted] (the proprietor of the timeshare).The customer service is abysmal. Representatives are skilled at giving callers the run around and disseminating false information (see complaint #1). Although my "contract is up" my listing remains on their website leading me to believe that TSRS and its subsidiaries are more focused on getting people's money initially than maintaining their online listings, or legally obtaining fair market value for buy backs.Desired Settlement: Although my contract has been up for seven months, at the very least TSRS should refund my original investment paid. Not only was I mislead and given terrible customer service, but the only offer TSRS made was not market value (although TSRS claims that it was) and the offer only came after I called every day because my contract was nearing its terminus. As far as I can tell, aside from having my listing on a website, TSRS did not honor their half of the contract to my satisfaction or legality.

Review: TIMESHARERNTORSALE COM, LLC was contracted to sale our timeshares as offered by them within 30-45 days. They stated that there were people waiting to purchase our property. Company charged us $798.00 on 09/03/2009 as a "one time advertisement order fee" but no advance was made in the resale of our timeshare. I called several times seeking updates and no update could be offered. After some time it became very difficult to speak to someone. No effort was made to inform me in the process of sale or was there any further notification of people interested in our property. More than 4 years have passed and no one has ever contacted us about this agreement. 9Desired Settlement: It is requested that a full refund ($798.00) be provided for monies paid as no service was ever rendered as agreed. This is a fraudulent agreement on behalf of TIMESHARERENTORSALE COM, LLC for which we seek reimbursement.

This dispute is not resolved. This company promised to market our timeshare in a timely and aggressive manner. This did not happen. They did respond with an offer after you notified them. However, I believe our time share to be worth more than $20.29. This company is not a reputable,reliable, or trust worthy business. They want their money up front for everything, but fail to deliver.

Review: A sales representative contacted me regarding selling my time share making multiple promises (i.e. the property should sell in just a few months and that it would likely sell north of $10,500).

He recommended the property be listed at $16,000 and then we could negotiate with seller if an offer came in. This service cost $200 to list property. Then after months of no action, the rep called again and said if I paid another $500 TSRSOnline would buy the propert if it didnt seel in 10 months. I went ahead and paid the $500 because I was desperate for money and am unemployed. After the 10 months and 0 offers, I called them continually asking where my offer was and was told repeatedly for another 3 months that the agent was pricing the property.

Then after 13 months I received a package with an offer for $10.84 for a propery I paid 15,000 for originally and was promised it would sell for over 10.500 by the selling agent! In addition, this offer was contingent upon me paying an additional transaction fee of $1050 which was never disclosed. In summary they offered 10.84 for a property I paid 15,000 for and 1,750 to TSRSOnline to sell!! Also, they sent non-representative Ebay listings to try and say they were paying market value, the properties were in CA and not on the strip in Las Vegas, where my property is located. This company it a total scam and I cannot understand how they are allowed to be in business. I am considering legal action at this time!Desired Settlement: I want a refund for my $700 and action taken against the company so it does not rip off and hurt others as it has done to me.

Review: I was contacted by TSRS and told that they would advertise and sell my time share. If it was not sold in a period of time, they gaurantee a buy back of $13,000. The cost to advertise and seel my property was $1016. I entered this agreement on March 19th of 2012 and just received an offer to buy my time share for around $600 with an additional cost to me of over $1200 for closing costs. If I go through with this process, it will end up costing me money. Review: In February 2012, we were solicited by telephone several times by TSRSonline to list and sell our timeshare in [redacted]. After providing our time the details the representative suggested that the value of the timeshare was in the range of $42,000 to $47,000 (which was in keeping with what other timeshare resellers had said).

The TSRSonline representatives said they felt confident that they would have no trouble selling our timeshare as many of their clients were corporations that needed the property for staff during trade shows and conventions. They said they had a guaranteed buy back program that we could participate in that would buy the timeshare if it was not sold within the allotted time of the agreement. This buy back was to be at fair market value based upon comparables of equal properties resold in the area.

This guaranteed buy back program was something the other timeshare resellers did not have and was the main reason we engaged TSRSonline. Nothing was mentioned about comparables coming from eBay or of distressed or foreclosed properties or those of questionable title. During the course of the next year we never heard from them and our several calls were met with, "We're working on it." In April 2013 we advised them in writing we wanted to exercise the Guaranteed Buy Back. A letter from them dated april 25, 2013, said their "licensed California Real Estate broker will make us a market price offer."

In May we were asked to fill out a Questionnaire which we completed and fax to them on May 8, 2013. We were told it would take another 60 days. It wasn't until September 25, 2013 that we received a buy back offer of $138.00. Further there was an additional $1,050.00 facilitation fee we would be charged. This is contracy to the representations made when we were solicited. It is nothing less than fraud. Today we faxed a letter making a demand for a full refund of our $795.00. If not resolved, we will contact the California Attorney General and the Real Estate DepartmentDesired Settlement: The immediate refund to me of all monies ($795.00) paid to TSRSonline.

Review: This writting is in reference to a contract I signed with a company in your area, TSRSonline, a timeshare resource company. I recieved a solicatation call from this company Jan 20 2012. the person who originated the call was [redacted]. At the time of the call, I had 24 hours to to pay $1495.00 to TSRS for them to sell a timeshare I own. I was told by [redacted] this company would sell my property within 10 months for $17,000-$19,000. guaranteed, or the company would buy back my property . He repeatedly told me this company would not pay less than $17,000. He gave me the number to a person in Omaha to call to verify she had had a contract on her property and sold within a couple of months. I called her and she said they were wonderful, got her more than she had originally adked for her property. I gave my credit card number and they promised a listing and a quick sale. I was mailed a contract I had to sign and return within 3 days. I did so. I checked their sight for my listing a month later and it was not on line. I called and complained and it was finally liosted. 10 omnths came and went with no offer no correspondence of any kind. I contacted them and they sent me a "buy back questionnaire". I filled it out and returned December 31, 2012. I was to allow 12 weeks for an offer of market price. I have made numerous attempts to find out the status and have been told my offer is "in progress". I fully believe I have been ripped off. I can never speak to anyone other than the one who answers the phone. I believe I have been scammed out of $1495. Can you please investigate this business. Review: Feb 2012 I was contacted by TSRS asking if I would like to advertise my timeshare to be rented/sold. I said yes and paid them $1299.00, this included a buy back offer if my timeshare did not sell within 10 months. They had people that were interested in using my timeshare and that I should have no problem in selling it. I called a few times to inquire....no prospects. Ten months later I wrote to them about the buy back offer that I paid for. I just got a letter that the market value for my timeshare that they were offering me was for $98.00 and I would have to ay $950.00 in closing costs. It seems that all they wanted was the $1299.00 knowing that they had no one that was interested at all....it was misleading!!!!Desired Settlement: I would like a refund of the $1299.00 that was paid to them because I feel they misled me.

Review: TSRSonline had unfair and misleading tactics in soliciting clients to use their website /sales department. We had several misleading conversations with our salesperson [redacted]. She "guaranteed" a sale and said that she had never "not sold" a timeshare.(I have this on a voicemail message) If our timeshare did not sell in 10 months, the company promises to buy it from you at market value. [redacted] wanted to put our timeshare on the market for $15,250. I asked [redacted] straight out if $15,250 is the market value- which she answered "yes" to. I asked her that when the 10 months are up, does the market value change. She said "it can". I said is there any possibility of the company offering us lower than the $799 that we paid initially after the 10 months are up. [redacted] answered "no". So at this point, I am assuming an offer of over $799 after 10 months. NOT SO! The company offered us a price of $12.75 for our timeshare plus a $950 legal transfer fee that was NOT mentioned in the contract. We also would have to pay our timeshare fees for 2013 when our contract ended in October of 2012. These practices are abhorrent and inexcusable. If I would have known this up front, I would have never agreed to the terms and conditions. Do not use this company under any circumstances!!Desired Settlement: We would like TSRSonline to buy our timeshare for at least $799 as stated in conversation with [redacted]. We would be willing to pay half of the legal transfer fee since the amount was so high and was never disclosed. We have paid our timeshare fees up until 2012 when the contract ended. We believe it is the responsibility of the company to take care of the fees after that. If this is not acceptable, then we would, at least, like our $799 fee refunded to us.
