Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] 7, and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear below Regards, [redacted] I have to add that I did see the vehicle once I went to pick up the car but since my car was in-between cars they told me I can fully inspect the vehicle once vehicle is out of tow yard which required to have me pay the towing bill, I will be very specific my car was in-between cars and there was no way to see the damage , left of the car was against a curb which its not level , the area which is damage was right near the highest point of the curb, all I know that my brand new car had no damages, possibly they damaged it during the tow or at the tow yard , when I saw my car I did question that how my car got to this area which they responded there were no cars around it , hard to believed since every car surrounding my vehicle was full off dust and you could tell that those cars have been there for weeks , I do also want to add again that manager did not call me back once NONE at all , he told me right in my face at the day of pick up that he will Look into it and will call me , If they were not at fault why wouldn’t they call me back ??

Our name and phone number is on all signs at the entrances ways to the community As far as” ripping people off “ we charge our contracted towing and storage rates As far as “rude and disrespectful” I apologize if your complaining party feels that way A lot of the times if we either don’t give someone the answer they are looking for or we can not give that information to them by law the person claims we are being rude and/or disrespectful She mentions that her vehicle was in our storage facility for hours That storage rate is for a hour period We are not allowed to charge another day of storage until it has been in our possession for more than hours

I apologize for the long delay in getting Revdex.com an answer to this complaint. I had thought the complaint had been forwarded onto your complaint department a long time ago. On the particular day in question September 7, 2014, our driver towed the complainant’s illegally parked
vehicle. After talking to our dispatcher who was working at that time our dispatcher said, that she would not indicate where a particular driver might be located or when they would have left because of safety reasons. She went on to say, she would give the caller an estimated time of arrival at the yard is all that would be conveyed to the caller. There was no way she could determine if it was even the registered owner of the vehicle over the phone. My driver as he approached the gate to our yard , heard someone speak but did not hear what that person said as his windows were rolled up and he had his radio on. He thought the person was there at the yard to pia vehicle NOT that it was her vehicle on the back of his truckHe pointed towards the release window indicating he would be with them in a moment. As he continued into the yard, there was no conversation further until the man and woman came to the window. The man and woman were very belligerent, argumentative, and quarrelsome. The driver has other duties that he is required to take care of once the driver brings a vehicle into the yard and that was the delay the man and woman might have been referring to. Let me reply chronically which should make it easier for *** *** to understand. Statement: I have reason to believe that it was illegally towed I looked up all the laws in California, County and city as wel.Answer: We DO NOT tow vehicles illegallyWe follow the California
Vehicle Code to the letter of the law. Statement: The police also had to escort me back in order to get my personal belongings out of the car as well the lady only gave me minutes to get my stuff saying that she was closing for the day she did not have time for me and she would not let me inspect my car either for damages and I believe that my windshield is cracked but I can't even go back there to see.Answer: *** *** did call the police and after they arrived at our offices the police did listen to her. She was told repeatedly after yelling at police and my office manager; the police did then tell her it was a civil matterWhich it is! We broke no laws. *** *** could clearly see whether her windshield was cracked as she was there getting her personal belongings out for more than minutesMy employee would not care that we close at 5pm as my employee gets overtime in the event that she has to stay after 5pm for any reason pertaining to work. Statement: they will not give me any of the paperwork to my vehicle authorization forms and why it was towed who authorized it to tow it they didn't even give me the form that I was supposed to receive within hours if I felt that my car was illegally towed on who to contact they still won't give me that I called up there today they won't give me copies of the photos that my car was parked illegally they told me in order to receive any of the paperwork I have to pay for my car up front and in full the balance now is $1,which I don't have and I feel that I should have the right to see the papers involved in why this happenedAnswer: California Vehicle Code states, we have to give PRIOR TO PAYMENT a copy of the tow authorization form with the name of the person who had it towed redacted from the document . *** *** demanded we give her all of that information without her FIRST PAYING FOR THE VEHICLE*** *** told my office manager that we had to give her the paperwork prior to her paying to get her vehicle released WHICH IS NOT TRUE! We are legally prohibited from telling anyone who signed for the towWe are not going to do something that is illegal. She has been a difficult customerShe did not owe $as she alleges of the date of 11-11- My suggestion to*** *** would be to come pay to get her vehicle back as the storage just keeps going up and eventually her vehicle will be sold at auction to help us pay for the charges that have accrued

Our company has contracts for towing with different Police agencies in Orange County. On January 11th, the driver of the Mercedes Benz was arrested by one of these police agencies and we towed this vehicle. It was NOT reported stolen at the time of the towing nor anytime
after it was in our possession. After hours of being in our possession we are mandated to place a lien on the vehicleWe did that. The owner had several weeks in which to get the vehicle back but apparently chose not to

2. QUESTION :DMV States you can
park your car where preferential parking privileges are given to residents

Code gives the owner of a handicap placard the right to park anywhere there is a properly marked
handicap stall (handicap sign at front of space and handicap symbol on
ground). It does not say if you are
parked in any other space it is O.Kor legal for you to park there. Ms*** was parked next to the handicap stall

they told me they never got any calls

that we have to call the Sheriff office first
before we tow. If the Sheriff’s office has gotten so many
complaints then they are not doing

investigating the alleged complaints. We have

ever talked to anyone at the Los Angeles County Sheriff Office in regards to

If Mr*** can show us how we could have possibly damaged his horn or alarm system by towing the vehicle we would get the units fixed for him. The alarm system on his vehicle must be attached to his horn by wires from the alarm system but we do not open vehicles nor do we open hoods of vehicles I would suspect a fuse or something like that

I offered Mr*** to come to our offices and we would show him that our tow truck did not cause the damage he claims. He neglected to look at that as an option. There is nothing else that I can help him with as stated in the previous email, "Our tow truck could not have done the damages Mr*** claims"

I did respond back I don't know what happened why did not go through my issue has not been resolved I did not have access to Internet my sincere apologies butt, to and Mo still has my car they still won't release any paperwork on it I'm running out of time because now I'm finding out that they can actually put a lien on my car and sell it I talked to some lawyers and they're telling me it's a civil case Court I don't know how to go about that or what to do again I'm not from here I can't do anything I can't go back to Ohio I can't stay here and get a job I can't do anything I need my car please help is there anything you could do or advise me to do

I spoke to our lady dispatcher who had spoken to *** *** about the directions to our yard. She
assured me that she had told *** *** what yard his vehicle was towed
to. We always ask what property the callers vehicle was towed from.We
have three yards and all
vehicles go to the closest yard determined by
the radial miles from the clients locations. We have GPS at all
three yards to make sure we are sending the vehicle owner to the right
yard *** *** said that our dispatchers were rude. Since I was not
there I will apologize to him now if that had happened.
Unfortunately, our dispatchers are yelled at and called filthy nasty
names as most customers are mad at us for towing their vehicle and take
it out on the dispatchersBut when they write to Revdex.com they neglect to
mention their demeanor when they come to pick up their vehicle
As far as the tow being wrong I will check on that when I get into the office tomorrow. I will update this further when I get additional information

I am sorry that Ms*** finds the decision unacceptable. The vehicle was towed legally and the claims that were made (exparked in a handicap stall, handicap placard on mirror) were false. I will respond to the complaining party’s assertions as written and in that order.   1.       During at that time I was almost unconscious. Then TO and MO towing company came and took my car away. 1a -We have a towing contract with Anaheim Police Department to tow...

vehicles on a rotation basis with other tow companies.  We received a call by Anaheim Police Department dispatch to respond to the accident scene.  We then were asked to tow the Nissan Altima away from the accident location. 2.         This tow company took control of my lien without my consultation. 2a.- We called the complaining party’s insurance ([redacted] on the 4-4-2016 that we had the vehicle and could they please send an adjuster out to take the vehicle.  No one from [redacted] responded. By California law we have to file a lien on the vehicle after 72 hours of having the vehicle in our possession.  We filed a lien on the vehicle. 3.       They never communicated with me and they know that I was hurt almost dead from the accident.  3a- We do not do the lien paper work ourselves.  We have a third party lien company do the liens for us.  We would have no way of knowing that “she was almost dead from the accident.”     4.       Then now they told me I owe them $1,500 dollars and threaten me they will ruined my credit send it collection. 4a  We made no threats of any kind nor did we asked for   $1500.  Unfortunately people involved in an accident who either do not have insurance or have let their insurance lapse  expect the towing companies to make an exception for them and give the vehicle back at no charge.  We are a business and are governed by our contract with Anaheim Police Department.. 5.       This tow company must be in need of money if they charge people an arm and a leg just to pick your car in the spot they picked it up in. They have no professionalism, I hope they feel good about what they do to people who actually work hard with their hands not just drive around looking for some one to take advantage of. 5a  If this woman had insurance this would not be an issue.  We work very hard for our Police Departments and or clients. They have no professionalism.  Not sure how to answer that complaint as there is no substance to it. 6.       They keep the car as long as they possibly can to rack up the bucks, and are rude, uninformative, and uncooperative. 6a. Again, Not sure how to answer the rest of that sentence as there is no substance to it. 7.       Please help, assit me to solve this nightmare matter soon. If they were professional from get go I can release everything for them 7a.  I feel she thinks if she releases the vehicle to us she does not have to pay for the fees that have been acquiring since the accident.   We still have the vehicle and would be happy to return the vehicle to her if she paid the monies owed. The rest of her oratory cannot be answered. As stated earlier WE STILL HAVE HER VEHILCE FOR A FEW MORE DAYS AND IF SHE WANTS HER VEHICLE ALL SHE HAS TO DO IS PAY FOR THE FEES THAT HAVE BEEN INCREASING SINCE WE TOWED HER VEHICLE ON APRIL 1ST, 2016.  42 DAYS AGO.

the towing itself is not being called into question; it is the behavior of the tow truck driver, and thus, To' and Mo' Towing, that was improper.Re:  TimingIt is both self-serving and irresponsible for To' and Mo' Towing to respond 1 year and 3 months late to this complaint.  However, this tardiness and lack of professionalism seems consistent with my encounters with To' and Mo' Towing thus far.Re:  DispatcherTo' and Mo' Towing is mischaracterizing my conversation with the dispatch operator.  Not once did I ever ask for the location of the tow truck driver.  I asked for the location of the tow facility so I could pick up my car.  All subsequent calls to the dispatcher were made at the tow lot.  It would be absurd to inquire as to the location of the tow truck driver when I had seen, and interacted with, the tow truck driver in person.  To' and Mo' Towing's account of the events is inaccurate, and once again, self-serving.Re:  Communication with the Tow Truck DriverAs stated in my complaint, when the tow truck driver arrived, both my companion and I repeatedly gestured and shouted to the tow truck driver that the car that he was towing--specifically, the car attached to his truck--was my car.  We were shouting because we were a few yards away from the approaching truck.  The tow truck driver stopped the truck.  The driver-side window was rolled down.  When we approached the tow truck there was absolute no audible music, therefore, there is no way the music was too loud for the tow truck driver to not clearly hear us shouting that the car attached to his tow truck was mine, and that we wanted him to drop off the car at the gate instead of inside the lot so that we would not incur storage fees.  Instead, the driver shook his head repeatedly at us, and decided to drive into the lot, thus forcing us to incur the storage fee.Re:  DemeanorAs stated in my complaint, I was accompanied by a small child in the car.  There is no way I would have acted "belligerent, argumentative, and quarrelsome" in front of a child.  Again, To' and Mo' Towing's statement is self-serving and wholly unsupported by the record.  To' and Mo' Towing does not even attempt to provide evidence of any specific behavior that would indicate belligerence or aggression, or any evidence of foul language.  Of course, To' and Mo' Towing could not provide such evidence because no such behavior was exhibited, and no such language used.  My companion and I are both professionals who are bound by an ethical code.  We would not place our professional licenses in jeopardy to bully a tow truck driver.  This is evidenced by the fact that I brought a complaint to the Revdex.com instead of confronting the tow truck driver or any of To' and Mo' Towing's representatives.  Having experienced To' and Mo' Towing's business practices first-hand, I wanted to bring my complaint through a reliable third party.  Re: California Vehicle Code ViolationThe California Vehicle Code provides that:(1)  A towing company that removes a vehicle from private property under this section shall notify the local law enforcement agency of that tow after the vehicle is removed from the private property and is in transit....(3)  A towing company that does not provide the notification under paragraph (1) within 30 minutes after the vehicle is removed from the private property and is in transit is civilly liable to the registered owner of the vehicle, or the person who tenders the fees, for three times the amount of the towing and storage charges.Cal Veh Code § 22658 (m).As stated in my complaint, the tow truck driver reported an incorrect "10-98 Time" as 2:11 pm for the time he left the tow site.  Even when I told him the time was incorrect, he did not change it.  This was probably to avoid admitting his violation of the 30-minute reporting requirement.I have 2 witnesses who saw the car get towed and leave the site at about 1:45 pm.  I also have phone records of the To' and Mo' Towing dispatcher stating that the car was towed, and already in transit before 2:00 pm.  The apartment community representative also confirmed, in person, that they had authorized the tow before 2:00 pm.  Moreover, I was already at the tow company lot before 2:11 pm, which is the time the tow truck driver indicated he had just left the tow site.  My arrival at 2:10 pm came after already having called law enforcement (who had no notice of the tow), and then contacting the apartment community where the car was towed to find out who the tow company was.  It is impossible for the tow truck driver to have towed my car at 2:11 pm.So, by To' and Mo' Towing's own statement there was no way to have confirmed that I was the registered owner of the vehicle before speaking with me in person at the customer service window, and the tow truck driver "did not hear" me shouting about owing the car he was towing.  Therefore, the tow truck driver was obligated to report that my car had been towed to local law enforcement by the time the tow truck driver came to the customer service window and ascertained that I was the registered owner of the vehicle (which was more than 30 minutes after the tow).  To' and Mo' Towing's own statement indicates that they did not determine my ownership of the car until after the driver came to the customer service window.  I confirmed with law enforcement again that To' and Mo' Towing never notified law enforcement that the car had been towed.My phone records, witness statements, and first person observations indicate that the tow truck driver fabricated a tow time in order to feign compliance with their 30 minute reporting requirement.  Even when I pointed out the error, the tow driver did not correct it.  To' and Mo' Towing was in clear violation of the statutory reporting requirement.

Mr. [redacted] was off property when he stopped our truck.  The driver charged him the proper amount of money.  There was no discussion with Mr. [redacted] of dropping the vehicle except how much would it cost..  What I find after a person's vehicle is towed they talk to someone more...

knowledgeable and then come back to say things different than what really happened..

WE still have her vehicle.  I am not sure exactly what she wants or why she thinks we owe her something.  In reading her first response I believe she thinks she can just turn the title to the vehicle over to us and be resolved of any further collection proceedings.  As she also said in the her first response,  "my car was destroyed"  Why would she think we would even want the vehicle.   She owes the money on the vehicle from the Towing, Storage and the lien fees.   With just the 43 days of storage that is owed on the vehicle it is over $2,000 dollars currently. We did nothing wrong no matter what she alleges as most of the information that was in her first response was just TOTAL slander and BULL S_ _ _!  She got into an accident, apparently with no insurance in force at the time of the accident and we were called by the Police to tow the vehicle off the streets of Anaheim,  SIMPLE AS THAT.  We will bring legal action against her if she does not pick the vehicle up and get it out of our storage yard.  After reading her first response  I really  do not care to be of any help to this lady or to do anything  special for this  person.  She is either mentally unstable or does not understand the laws of the state of California, neither of those two things are not our fault, either.   I will not make any further comment regarding this matter as I feel I answered her ridiculous questions as best as I could.  We will keep her vehicle for no more than one more week then we will sell it for scrap.  The difference from what the scrap dealer gives us for her "destroyed Altima" and what is currently owed in fees will be what we will be asking for when we go to court to retrieve our monies that we are owed. It will hurt what credit she has as we will win when we go to court.  Unfortunately there is "NO Free Ride in California" especially when she uses the language that she used in her response to the Revdex.com.

There is nothing that we do when we tow a vehicle that would affect the alarm or horn.  Usually a good alarm would sound when we move the vehicle then it will reset.     I return any and all calls that I have the responsibility for.   I never received any calls...
