This customer was notified the same day he placed his order that it was not available. We never collected any money from him but he kept telling our sales guys that he was owed this product.Colt is the maker and we cannot manufacture this weapon as we are not a manufacture. He was told on 6-8 the day he placed his order that we were cancelling the order and again on 6-9 when he called us back to complain about us. From our calls with him we believe him to be elderly and we are not sure if he can grasp the fact that this is not currently available. It's not in stock and there are none that seem to be in stock anywhere in the USA. There are however many items just like this product available.On our last conversation with him he just kept demanding that we find him one. He was very rude to our sales guys and seems to just not accept that we had to cancel his order. In reading his comments it looks like he is saying he initiated the call and he did with the first call on 6-8 when he called us to get a list of dealers, but later on the same day when we were processing his order it was discovered that this was not in stock and a call was placed to him. That's when he became upset but was told we had to cancel the order.  He was told that we could contact him at a later time if one became available,  but we would not collect and keep his money until that time. It is our policy not to accept any back orders.Again no money was ever collected or his card processed and refunded in this order.We would love to take care of him and other like items were offered but he didn't want to hear that and Colt does not accept direct orders for any products and our distributors do not accept back orders for firearms because of the sometimes very long lead times of production. I'm Myron the Manager in which this customer is speaking of , The story is simple, we showed 1 item in stock when the customer placed his order, we initiated a call to him to let him know that we did have one available at the price he saw.  He wanted six(6) in total, but we only possessed...

one(1), the other five (5), we would've had to get from a different vendor at a higher price.  We explained that to him, but he insisted that we sell him all six (6) at the same price which we couldn't.  Unfortunately, that was not the answer he was looking for.  I told him that I would check to see if I could get authorization to sell him all of them for the same price, again that couldn't be done.  I called him back and explained it to him and he wasn't happy with the way we did business.

item in stock, as a matter of fact 51 of the items.  I also explained to him that when he ordered the item on 3/4/16, that it said "in stock one week"  which meant that the warehouse where it was stored, doesn't have the authority to ship the item directly to the customer, it simply meant that it had to come to our Phoenix location first, and then we would ship it out to him.  He agreed that he totally understood now how the process work, and was now not interested in canceling his order, he is happy to get his item delivered to him within a week. I don't think this should be displayed as a mark against us, we both agreed it was a simple misunderstanding of the way the information was displayed.

I'm Myron , the Manager of Online sales here at Tombstone Tactical.  The customer that filed this complaint did indeed place an order with us via our website.  His order was placed at 4:02pm on 6/8/16, we processed his order at 4:24pm on the same day, he contacted us for a list of licensed...

dealers in his area, we gave  him that information so he could select one and get back to us to inform us of who he selected.  The firearm he ordered was in another distributors warehouse, which we draw inventory from as well.  However, it only showed one available when his order was placed, we had no reason to believe that their inventory was not there.  We contacted this customer to inform him that we could not locate that firearm, so his order would have to be cancelled at that time, this was all in the same day.  We never took any money from this customer, we wanted to verify the inventory before we did.  There are times where the website could say the item is available, and another order might be placed a few minutes before, which will grab that last item.  In this case that's what happen, as mentioned above we contact this customer immediateley.

Tombstone Tactical - Internet Buyer's Beware!

On August 13, 2017, I contacted Tombstone Tactical and confirmed with a salesperson that a particular firearm, Springfield 1911 EMP 9mm was in stock and could be delivered in 2-3 business days to my FFL Dealer.
Because of a specific time schedule in needing to obtain the firearm and work through the California DROS process, timing was paramount when considering this purchase. On that date, I made an on-line purchase with Tombstone Tactical and received confirmation thereof to include their written advisement “If any item is no longer in-stock when your payment is received your money will be returned to you."

On August 16, 2017, after failing to receive any further correspondence from them, I contacted the a store representative was advised that the firearm was NOT in stock and they had it on back order which could take 5-7 business days or longer before they would be in receipt of the item and then would be shipped in possibly two to three days thereafter which would make the subsequent transfer of the firearm in California an issue due to my schedule. A telephonic and e-mail request to cancel the order was made at that time and an email confirmation thereof was received on August 17, 2017, along with my first notice that there would be a 30% re-stocking fee for re-stocking the item which they did not have.

After their written confirmation of my request to cancel the order, I purchased the identical item from a local dealer.

On August 18, 2017, I received an e-mail from Tombstone Tactical that the cancelled item was being shipped to my FFL Dealer and charged of $1,015.88. I contacted them immediately by email to which has gone without response. As of this writing, I am out of pocket $1,169.54 for an item that was cancelled and due to it being a firearm, in a very tenuous position. I would never consider doing business with this dealer as at least in this instance, they were found to be dishonest and without any business integrity.

They never contacted me to let me know that the item was not available; it was I who contacted them to check on status and any action item due on my part to facilitate shipping transfer; it was only then that I was told that the item was not available- they never took the initiative. Another example of poor business practices.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

(Issue #1)

This statement totally conflicts with Tombstone Tactical's Policy which is clearly posted on their website. I have posted a copy of their policy below. This policy is strictly enforced and has been applied directly to me in the past. For example, after making many purchases with this company, I placed a new order for a firearm. Please understand that this example was a different order than what is currently being discussed. However, it is compelling evidence of them enforcing their payment first policy. On the purchase form, I checked that I would be paying by Money Order. In just a few days, I received a phone call from them and was told my gun would not ship until payment was received. I was further told that the order would be cancelled if payment was not made immediately. My point here is that firearms are not shipped, even to previous customers, unless they are paid in full. I received an email from them that stated, "If you did send a check and we did not get it logged correctly please let us know." They are openly admitting that a mistake was made on their part.

You are not being truthful and forthcoming about the ATF matter. Please address the email that I received from [redacted] stating, "I do not want to involve the ATF, but I am legally obligated to do so." Any reasonable person would deem this as threatening and intimidating. When I personally contacted the ATF in Martinsburg, WV, it was their position that this was scare tactics on your part. For the record, I spoke directly to Special Agent [redacted] concerning this matter. Again, you need to address this matter. What is your legal obligation to contact the ATF? Please reference the specific law or laws that would welcome an ATF investigation.

At no point, did I add my work email to my account with Tombstone Tactical. I am employed by the North Carolina State Public School System and I have over 20 years of tenure. It is totally against school policy to post my email on a gun website and I would never do such a thing. In fact, my school email was added to your system at the request of [redacted]. I received an email from her that stated, "I obtained her work email and phone number from Google. I've always worked in accounting and collections... you can use Google or other public records to attempt contact." The second email that I received from Tombstone Tactical definitely contains information about assault rifles and other firearms for sale. You are even given instructions to click-on the link to view the sale. The only purpose of this email is for people to view the store sale and to purchase firearms.

As I stated previously, I could be reached at ###-###-####. To date, I have never received a phone call from you at this number. My email address is [redacted], I first received correspondence from you at this address on Nov 18, 2013. My husband [redacted], immediately responded to you on Nov 19, 2013. There was absolutely no avoidance or delay in getting back with you. My husband reviewed his account with you and saw no information concerning this order. He stated to you, "I show no such order on my account. In closing, not a very polite email to a good customer..."

I also gladly accepted and signed for your certified letter, I had no reason not to. I have also responded to you repeatedly concerning this matter.

Please read the following comments I received from [redacted]. Then, please explain how they would be perceived as patient, helpful, polite and professional.

"Thankfully, there are those honest people still out there to restore my faith in our species. :)"

"I can see that trying to be helpful and understanding will only backfire with persons of your nature."

"I do not want to involve the ATF, but I am legally obligated to do so."

In closing, I frequently pay for online orders by money order. I have purchased firearms from other websites and paid by money order as well. This also saves money, as most places of business now charge you an extra 3% to purchase by credit card. When this order was placed it was clearly marked as paid by money order. The fact that previous orders were paid by credit card, in no way means that this order could not be paid by money order.

{Several customers have had orders shipped without payment, because we have had problems with our website hosting company and sometimes cannot verify payment. When it’s a previous customer, we go ahead and ship the order when it’s ready. This is the ONLY case where a customer did not provide payment upon notification. See Exhibit A. Once our system was up and running, we notified the customer of missing payment via email and they responded quickly saying they’d get it paid shortly, when they arrived home from vacation.}

I received the item shortly thereafter, and was satisfied with the product itself. I have purchased several firearms from this company and apparently my business is not appreciated. However, the actions that have transpired since are totally unacceptable. This company threatened me with action by the ATF, when they had no right to do so. Here is a direct quote from an email that I received, "I do not want to involve the ATF, but I am legally obligated to do so." I personally contacted the ATF in Martinsburg, WV and made them fully aware of the situation. I spoke to Special Agent [redacted], who stated that their office had no involvement in this matter at all. Special Agent [redacted] further stated that the use of his office by Tombstone Tactical in this manner is strictly prohibited and a violation of the law.

{We did not threaten the customer at any time or anyway. The only thing that could be considered threatening is that we told them we would send the account to collections if payment was not received by the end of the year, and the order would go on our End of Year reports as unpaid which would result in the customer being placed on our Do Not Serve List.}

I am now being harassed at my place of employment by both phone calls and emails. I immediately advised this company in writing to stop contacting me at work and they acknowledged my request, as my employer disapproves of the calls. The company was also given a phone number and email address where they could easily contact me. I work at a Public School and can you imagine my horror when I received phone calls and emails concerning guns. This company knew in advance of the contacts that I worked at a Public School. Who would do such a thing? Due to recent events in this Country concerning schools, which include Sandy

Hook, Columbine, etc., you would think that this would not happen. My school is now receiving advertisements from this company concerning assault rifles and other firearms. Are you serious?

{See Exhibit B. Our computer system sent out ONE email this year notifying previous customers of our upcoming Black Friday sale. The email says NOTHING about guns, firearms, weapons, or anything of the nature - it is completely generic. The email was sent to her school address because she had added that email address to her account in our system as a secondary contact at some point. It was an automated email that went to every single email address we have on file in our database. It was in no way personalized.

Furthermore, we attempted to contact this customer over 25 separate times regarding non-payment of this order. We used the addresses, phone numbers and emails on file first before we ever attempted contact at her place of employment. There was ONE phone call made to her place of employment, the customer personally answered the phone, we stated “this is an attempt to collect a debt”, the customer stated “stop calling me” and hung up. We then sent ONE email to her work email address, and finally received a response after six months of avoidance by this customer at ALL OTHER contact addresses, phone numbers and emails. We even sent several to her husband (who had the same home address, dealer address, phone number and email on file). His only response was that he knew nothing of the order. See Exhibit C.

In total, there have been ONE phone call and ONE email to this customer at their place of employment. Once they finally responded to one of our emails, we ceased all contact attempts at the employer upon customer request. Considering that this customer has purchased numerous firearms from our company, we did not consider that a generic email with nothing more than our website address could be deemed offensive.

Also, the customer herself signed for our Certified Mail letters regarding this order, and chose NOT to respond at all. See Exhibit D.}

This is nothing short of unbelievable! These contacts are continuing to take place even after they were notified to cease. In closing, I have also been receiving very rude, unprofessional, threatening, and personally demeaning email from [redacted] an employee of their company. This is totally unacceptable and unwelcome.

{Our employees have been patient, helpful, polite and professional in all dealings with this customer. We spent countless hours reviewing bank statements and files to ensure that no payment was received before contacting the customer, and even checked a second time since. This customer paid every single order other than the one in question with the same Visa card, yet say they “paid this one with postal money order”. We gave them six weeks to provide proof of payment, but they still have not. We have given the customer reasonable time to respond and make payment arrangements. They have not provided any documentation of payment or attempted to resolve this issue in any way and we have been more than accommodating. We have no documentation that this order was paid for and have made several efforts to give this customer opportunity to provide proof otherwise, and they have not been able to do so.

Our resolution request would be to receive payment in full, or the weapon they received to be returned in Like New Condition.

If the Revdex.com would like additional documentation, please feel free to send a request. We can provide specifics of past orders and proof that they were paid with the same Visa card, as well as proof of contact attempts to the customer’s home addresses, phone numbers and emails.}

The fact of the matter still stands that neither [redacted] or [redacted] have sent us any kind of payment for their order #[redacted] of the Ruger GP100 Revolver. The mistake that was made on our part was letting their order ship out without payment due to the fact that they had been such good customers we didn't think there would be an issue collecting payment. Our company has shipped firearms out before receiving payment multiple times to good customers so they can get them faster and this is the first time we have had someone not pay anything and still pick the gun up from the receiving dealer. We have tried to resolve this matter in every way possible and it has been over 7 months now and they have yet to pay anything on this order or even try to talk to us about it, they have completely ignored any email or voice mail until recently. We have dated and signed accounts of almost every employee in our office trying to contact [redacted] or [redacted] by email and phone and over the past few months there has been no response from them until our accounting department finally received a response after they sent them an email saying they would be sent to collections over this. We are a business so we keep records of any payments received from all customers and no such payment was received from [redacted] or [redacted] and neither of them have any type of proof to show they ever sent us a money order. We are an accredited firearms dealer and we have absolutely no reason to risk our good name just to lie about a 650.00 order. The only communication with [redacted] or [redacted] has come from these responses with the Revdex.com and they have asked us to cease any communication with them either by phone or email. There is nothing else we can do other than send this to a collections company so we can try to collect payment from them or they can send the Ruger GP100 back to us.

Tombstone Tactical just interested in getting your money, Customer service is practically rude, Jill is absolutely not helpful.

In a nutshell, I purchased a Springfield EMP 9 mm, little bit over $1000, went immediately to the range, and I had FTE, and every other hick ups imaginable, it happened to be a Gunsmith at the range, and after he tried it out to make sure may be is just not broken in, he told me NO, the gun has some work needed, and has to be sent back to the manufacturer.

I stopped by the Tomstone after about an hour I bought the gun, and Jill, very uninterested, stated, well, you bought it, you haven to send it back to Springfield, like Deal with it, not our problem.

I will never going to purchase any gun from them again, and if you want a better experience, there are many other nicer store out there you can spend your hard earned money

Review: I ordered a Browning T-Bolt magazine from Tombstone Tactical on Friday March 4 th, order # 94560. The ad for the product indicated it was in stock, which is the reason I ordered it. This is a very hard product to find. When I checked the ordered it indicated it was ready to ship but hadn't. I called and was told that in stock meant at their supplier Browning. I told them that this was misleading that " in stock" to me means their. I was told if I cancelled, there would be a restocking fee. Which is incredible as it isn't in their stock. Moreover, they charged my credit card before shipping.Desired Settlement: I want the order cancelled, with no restocking fee and my credit credited.

I spoke to Special Agent [redacted], who stated that their office had no involvement in this matter at all. Special Agent [redacted] further stated that the use of his office by Tombstone Tactical in this manner is strictly prohibited and a violation of the law.

{We did not threaten the customer at any time or anyway. The only thing that could be considered threatening is that we told them we would send the account to collections if payment was not received by the end of the year, and the order would go on our End of Year reports as unpaid which would result in the customer being placed on our Do Not Serve List.}

I am now being harassed at my place of employment by both phone calls and emails. I immediately advised this company in writing to stop contacting me at work and they acknowledged my request, as my employer disapproves of the calls. The company was also given a phone number and email address where they could easily contact me. I work at a Public School and can you imagine my horror when I received phone calls and emails concerning guns. This company knew in advance of the contacts that I worked at a Public School. Who would do such a thing? Due to recent events in this Country concerning schools, which include Sandy

Hook, Columbine, etc., you would think that this would not happen. My school is now receiving advertisements from this company concerning assault rifles and other firearms. Are you serious?

{See Exhibit B. Our computer system sent out ONE email this year notifying previous customers of our upcoming Black Friday sale. The email says NOTHING about guns, firearms, weapons, or anything of the nature - it is completely generic. The email was sent to her school address because she had added that email address to her account in our system as a secondary contact at some point. It was an automated email that went to every single email address we have on file in our database. It was in no way personalized.

Furthermore, we attempted to contact this customer over 25 separate times regarding non-payment of this order. We used the addresses, phone numbers and emails on file first before we ever attempted contact at her place of employment. There was ONE phone call made to her place of employment, the customer personally answered the phone, we stated “this is an attempt to collect a debt”, the customer stated “stop calling me” and hung up. We then sent ONE email to her work email address, and finally received a response after six months of avoidance by this customer at ALL OTHER contact addresses, phone numbers and emails. We even sent several to her husband (who had the same home address, dealer address, phone number and email on file). His only response was that he knew nothing of the order. See Exhibit C.

In total, there have been ONE phone call and ONE email to this customer at their place of employment. Once they finally responded to one of our emails, we ceased all contact attempts at the employer upon customer request. Considering that this customer has purchased numerous firearms from our company, we did not consider that a generic email with nothing more than our website address could be deemed offensive.

Also, the customer herself signed for our Certified Mail letters regarding this order, and chose NOT to respond at all. See Exhibit D.}

This is nothing short of unbelievable! These contacts are continuing to take place even after they were notified to cease. In closing, I have also been receiving very rude, unprofessional, threatening, and personally demeaning email from [redacted] an employee of their company. This is totally unacceptable and unwelcome.

{Our employees have been patient, helpful, polite and professional in all dealings with this customer. We spent countless hours reviewing bank statements and files to ensure that no payment was received before contacting the customer, and even checked a second time since. This customer paid every single order other than the one in question with the same Visa card, yet say they “paid this one with postal money order”. We gave them six weeks to provide proof of payment, but they still have not. We have given the customer reasonable time to respond and make payment arrangements. They have not provided any documentation of payment or attempted to resolve this issue in any way and we have been more than accommodating. We have no documentation that this order was paid for and have made several efforts to give this customer opportunity to provide proof otherwise, and they have not been able to do so.

Our resolution request would be to receive payment in full, or the weapon they received to be returned in Like New Condition.

If the Revdex.com would like additional documentation, please feel free to send a request. We can provide specifics of past orders and proof that they were paid with the same Visa card, as well as proof of contact attempts to the customer’s home addresses, phone numbers and emails.}

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.

(Issue #1)

This statement totally conflicts with Tombstone Tactical's Policy which is clearly posted on their website. I have posted a copy of their policy below. This policy is strictly enforced and has been applied directly to me in the past. For example, after making many purchases with this company, I placed a new order for a firearm. Please understand that this example was a different order than what is currently being discussed. However, it is compelling evidence of them enforcing their payment first policy. On the purchase form, I checked that I would be paying by Money Order. In just a few days, I received a phone call from them and was told my gun would not ship until payment was received. I was further told that the order would be cancelled if payment was not made immediately. My point here is that firearms are not shipped, even to previous customers, unless they are paid in full. I received an email from them that stated, "If you did send a check and we did not get it logged correctly please let us know." They are openly admitting that a mistake was made on their part.

You are not being truthful and forthcoming about the ATF matter. Please address the email that I received from [redacted] stating, "I do not want to involve the ATF, but I am legally obligated to do so." Any reasonable person would deem this as threatening and intimidating. When I personally contacted the ATF in Martinsburg, WV, it was their position that this was scare tactics on your part. For the record, I spoke directly to Special Agent [redacted] concerning this matter. Again, you need to address this matter. What is your legal obligation to contact the ATF? Please reference the specific law or laws that would welcome an ATF investigation.

At no point, did I add my work email to my account with Tombstone Tactical. I am employed by the North Carolina State Public School System and I have over 20 years of tenure. It is totally against school policy to post my email on a gun website and I would never do such a thing. In fact, my school email was added to your system at the request of [redacted]. I received an email from her that stated, "I obtained her work email and phone number from Google. I've always worked in accounting and collections... you can use Google or other public records to attempt contact." The second email that I received from Tombstone Tactical definitely contains information about assault rifles and other firearms for sale. You are even given instructions to click-on the link to view the sale. The only purpose of this email is for people to view the store sale and to purchase firearms.

As I stated previously, I could be reached at ###-###-####. To date, I have never received a phone call from you at this number. My email address is [redacted], I first received correspondence from you at this address on Nov 18, 2013. My husband [redacted], immediately responded to you on Nov 19, 2013. There was absolutely no avoidance or delay in getting back with you. My husband reviewed his account with you and saw no information concerning this order. He stated to you, "I show no such order on my account. In closing, not a very polite email to a good customer..."

I also gladly accepted and signed for your certified letter, I had no reason not to. I have also responded to you repeatedly concerning this matter.

Please read the following comments I received from [redacted]. Then, please explain how they would be perceived as patient, helpful, polite and professional.

"I can see that trying to be helpful and understanding will only backfire with persons of your nature."

"I do not want to involve the ATF, but I am legally obligated to do so."

In closing, I frequently pay for online orders by money order. I have purchased firearms from other websites and paid by money order as well. This also saves money, as most places of business now charge you an extra 3% to purchase by credit card. When this order was placed it was clearly marked as paid by money order. The fact that previous orders were paid by credit card, in no way means that this order could not be paid by money order.

The fact of the matter still stands that neither [redacted] or [redacted] have sent us any kind of payment for their order #[redacted] of the Ruger GP100 Revolver. The mistake that was made on our part was letting their order ship out without payment due to the fact that they had been such good customers we didn't think there would be an issue collecting payment. Our company has shipped firearms out before receiving payment multiple times to good customers so they can get them faster and this is the first time we have had someone not pay anything and still pick the gun up from the receiving dealer. We have tried to resolve this matter in every way possible and it has been over 7 months now and they have yet to pay anything on this order or even try to talk to us about it, they have completely ignored any email or voice mail until recently. We have dated and signed accounts of almost every employee in our office trying to contact [redacted] or [redacted] by email and phone and over the past few months there has been no response from them until our accounting department finally received a response after they sent them an email saying they would be sent to collections over this. We are a business so we keep records of any payments received from all customers and no such payment was received from [redacted] or [redacted] and neither of them have any type of proof to show they ever sent us a money order. We are an accredited firearms dealer and we have absolutely no reason to risk our good name just to lie about a 650.00 order. The only communication with [redacted] or [redacted] has come from these responses with the Revdex.com and they have asked us to cease any communication with them either by phone or email. There is nothing else we can do other than send this to a collections company so we can try to collect payment from them or they can send the Ruger GP100 back to us.
