The owner of Top Notch Landscaping, Incmet with the homeowner (our customer,) yesterday (April 9, 2018) regarding this matter. The homeowner has verified that the damage is to her own property, which happens to fall on the complainant's side of the driveway. It was discussed that after the weather temperature increases, we will come out and re-grate the land and reapply seed to the lawn where the damage occurred. As stated in our previous reply, we are not responsible for snow plow damage when the driveway is not marked, but we have made this offer to the homeowner as a good faith effort to resolve this matter. The homeowner has agreed to sign off on the repairs once completed to her satisfaction.

great deal of communication was made and customer has evidence in writing of
all of it. Last phone call with landscaper was on Wednesday, July 29, with the result of landscaper stating they would come out and
review. They drew orange lines on our property, still existing to this
day and sent an estimate in the amount of $2,for additional work to be done

(picture as evidence after they were at customer property first day) and it
never recovered after pooling rain, due to path not allowing flow as prior to
landscaper work. Attached picture shows damage from 6-5-

Agree that landscaper always stated they would repair damage to grass due to tractor Additional damage created by pooling water We have lived here for years How we would have been able to have that beautiful green grass in the picture if rain was an issue? The May rain was more than this June The landscaper does have some responsibility since the work was not performed as indicated.C Customer would accept landscaper response if all grass behind

A sketch of the property line is in my possession. Might I also add that current neighbor was not the owner at that time so may not be knowledgeable of this factTop Notch Landscaping can view the property line information at the Cuyahoga County Auditor's website if chooses to do so.I have always maintained the garden bed next to the house with installation of shrubs, mulch, gravel and have maintained the lawn as well. I really don’t care much about of all the rhetoric this has caused but I do care about continuing to have a good relationship with neighbor. I find it very rude and unprofessional to go to the neighbor with my complaint. Neighbor knew of damage, photographed and reported such damage to Top Notch LandscapingNeighbor assured me that they were made aware of and will take care of the damage.To offer additional repair as good will is simply an insult.As for the resolution to this complaint, I agree, however, have doubts based on the company's continuous rebuttals when a fix is so very simpleIf this resolution remains unresolved or unprofessional then neighbor can assume maintenance of garden bed, leaf removal and lawn care in the futureI simply refuse to repair any damage that I did not cause in the first place.

quickly escalated complaint*** did direct the crewmen to go out to the property and address the damage, and use what materials we had readily available to fix the damageOur crewmen did lay down seed, and found it a better option to use *** mulch, as opposed to typical straw, due to its ability to adapt to any soil, and it's starter fertilizer properties to ensure proper nutrients to said seedDuring the time that the customer contacted us, the crew men addressed the situation, and the follow up complaints (weeks time), we here in North East Ohio have had adverse weather, not ideal to rapid seed growthAs previously stated to the complainant, it does take time and proper weather conditions to nurture the re-growth of the grassTop Notch Landscaping can not control the weather, or how and/or where nature moves our work( ie floating down her driveway due to excess rain and snow)It did seem as if the complainant was looking for a high end sod to be placed immediately to cover up exposed soil, and that simply is not how we address our repairs.? This matter is not closed. We have dead grass as a
result of this landscape company What personal gain is there to get
grass in condition it was prior to landscaper being on property?????????????
The issue has been and remains that landscaper states they
will only repair tractor damage. From day customer has shown other dead
grass, near tractor damage as a result of work performed and pooling of
water. The landscaper told us and indicated in writing that they dug
the path down three to four inches (when they did not as evidenced by pictures
taken to record issues). The work they said they did, and was not performed caused additional damage to grass
Bottom line, they did not dig the 2nd path down and there was
additional damage to the grass, as shown with numerous pictures. Accept
business response:
-YES, come out and repair the damaged grass above
path caused by tractor and path not being dug

I agree, nothing has been accomplished nothing except continuing to waste time. The day they had standing water the entire are was under flash flooding and that fact has been ignored continuously. There is no point in continuing, this has gone back and forth we have agreed to do the warranty work for what was damaged from the tractor and the tractor only. That will continue to be the answer.

We will not drop off materials, customer continues to try to persuade the situation for own personal gain. We will agree repair grass that was damaged by the tractor as we said we will have several times.  Again these are only attempts to prolong the situation without the attempted resolution previously stated. We will not give in the unreasonable demands, we agreed to repair the damage created by the tractor, if the customer says that "we can't be trusted to perform work on the property" than we will consider the matter closed. Customer needs to agree in the next response one of two ways. 1. Yes come out and repair damage 2. No we refuse to let the landscaper do the tractor repair work that they said they would do from the beginning.

Response to each individual statement in order; French drain was the initial suggestion discussed with [redacted]The grass that was damaged by the tractor and in many occasions we have agreed to repair grass from tractor damageWe dug down only to the water level that was originally discussed with the customer to create better water flow. We dug 3" which was the required to create an even path for the water to flow.We did confirm that we would repair the grass as stated again again and again any damage done by tractorOn 6-27-15 there was heavy rain and flash flooding "[redacted]/" and the customer had been notified before that it would only aid in the flow of water that is WAS NOT A DRAINWe did dig down 3" if we didn't there would have just been a pile of rock laying there even there own pictures show a good 2.5-3" worth of stone being removed when they attempted to "dig deeper"Last year we repaired grass damage with out any issue from our end the problem occurred when they wanted grass repair turned into them wanting  us to give them an entire new lawn in that area including dirt, re leveling, etc. (which we did end of doing trying to make them happy even though it was well above what we agreed upon)These two things were never actually addressed or brought to our attention had they have been we would have repaired them no issue how are we supposed to correct the issue but there was no communication from the customer  (much like now)All customers wants is continue to get something for free each time we explain clearly what we are going to do they agree than once the job is complete they are start adding things to the job and saying it was never done. We received warnings from previous landscaper about there tendency to change the job after it had already been completed and try to get free work. We have never been dishonest in anyway shape or form, again being proven by the fact instead of calling as stated in emails exchanged they continue to only respond through a complaint  with no intent of actually calling and discussing the issues. At this point it has become a personal vendetta of the customer attempting to slander our name instead of actually trying to resolve the issue. We have been in business for over 11 years with only 1 positive experience on Revdex.com and no negatives at all. We hold ourselves to a high standard and quality in work we attempt to make every customer happy but unfortunately every once in a while you will get a customer that is more concerned with slander than of our virtually spotless complaint record.

1. Tractor caused damage to lawn.  Landscaper does not dispute and has stated will fix grass2. Landscaper (confirmed in writing (see attached) on August 9, 2015 states the path was dug down 3-4 inches.  It was not (again pictures from when customer did own repair).  Not preparing path correctly caused damage, compounded by the tractor damage.  Now no grass in area.3. Customer does not trust landscaper to perform any work on property.  Will do the work themselves.  Customer would accept landscaper proposal, with materials delivered for:Top Dress and ReseedTop dress the agreed upon area using pen mulch, 50/50blend grass seed, fertilizer, and top soil as needed.CLEARLY, customer is NOT trying to get something for free, but wants property back to condition it was prior to landscaper stating they would dig a path down 3-4 inches and not doing it, causing noted damage.

Exhibit B shows the email stating "Clearly" that I we explained that we would repair all grass that was damaged by the tractor.  Also if you take a look at "Exhibit A [redacted]" attached the water path way is only a minor part of the 3835.62 that they are claiming to be. Top Notch Landscaping Inc....

clearly told the customer that a french drain was required to fix the problem and in a attempt to save cost they went with a gravel walk way that would only allow better water flow. Also please note at all that water build up was in June when we had a record breaking amount of rain everywhere had standing water. Also please note that the customer stood there all day and watched us do the work and commented how great it looks only to have her husband come home and shortly after we receive and email from him. Customer has now done this to us twice they have always looked for a way to reduce their invoice even though prices are discussed before the work begins. Also please note that they have been contacted several times to try to discuss this matter to get it resolved although they insist on only using email. There attempt to "dig it deeper" is only going to increase the issue causing the water to build it up more  and cause more of a back up of water.

We have provided support in writing including pictures that the landscaper did not perform work as indicated, leaving additional damage. We are tired of the landscaper repeating the same message.
We used the former landscaper, Just [redacted], with no incident. Unfortunately, he sold to Top Notch, and that is when we had issues. Problems arose with this new one, and in an effort to eliminate any thing in the current year, my wife met with the owner  in spring.
There seems to be no resolution.  The landscaper has changed the story and takes no responsibility.  Had the path been dug down 3-4 inches as they said, and confirmed in a text, which we forwarded with our documentation, we do not believe out grass would have died.  We had much rain before June 5th and had pictures that shows green grass.
This has not been productive, and we feel the landscaper has been most unprofessional.
What do you suggest we do? We are not trying to get something for nothing, we just want that section of the lawn to look as it did prior to their arrival.  We sent their quote and final bill.  It is obvious we were willing to pay for work done. The problem is it was not done as they suggested, or as they confirmed in writing it was done.

All points provided in the last response have been answered time and time again. This matter has become redundant and is  clear sign that the information that is so clearly provided is going unacknowledged by Revdex.com and the customer. We agreed to repair tractor damage, customer choose cheaper route and was happy ( we explained they needed a drain), the day in question had flash flood warnings in that area, since the estimate little to no contact has been made to resolve this matter. I do not understand how many times we will have to repeat the information over and over again saying the exact same thing. Customer has provided no factual evidence and is only grasping at straws. such as calls were made on july 29 (yes except no contact was made except email thread after the estimate). This has become a clear attempt to receive more that what was paid for even when they choose the cheaper not advised option.
