In this case, the items were addressed to the Cheerleading coach, whom we have been in contact with since July of 2016. These spirit items are then to be distributed by the contact at the school. The Cheerleading coach stated she would like to receive these items for the school, as they were free of charge and required no further action on her part at the time. If she did not communicate with her superiors before requesting the items, we are not at fault. I have called 6 times and left message each time and have emailed them 3 times with no response. if this is in fact their way of handling customers I definitely want a better exchange of action. am rejecting this response because:I have the email that the company sent to *** *** in May of Attached to the email is a two year committment contract which no one filled out or returnedAdditionally, *** ***, has continued to call our local community businesses after I talked to *** *** and told him to stop telling our businesses that he represented the school, that the school has done business with them for years (which is a lie), and that *** *** works for Touchdown Sports and not for our school any longer (also a lie)I have contacted the Arkansas Attorney General and they are now investigating this caseAlso, I know that two banks have credited businesses for the fruadualant charges from Touchdown Sports and have launched their own investigationAgain, we do not do business with companies without a signed contract or agreement because that is our policyNo one has the authority to enter into any such agreements or contracts but me, and then they are approved by the school boardI totally reject the response of the company.

I spoke with Alec, a current employee of yoursHe introduced himself as working with *** High School and fundraising for the athletic programs. All of the other complaints state the sameIf it looks like a duck, quacks like a duck, it's a duckThere is no argument or coming to termsYou are operating under pretenses, your model is fraudulent and the countless others who have written reviews, filed complaints have all stated the sameYour business is a SCAM, and what you're doing is illegal and there will be ramifications for Touchdown Sports in the future. There will be no further communication between us

I am rejecting this response because: I contacted *** *** is no longer the Cheer Sponsor and has not been for this school yearShe also alerted me to the fact that the school district does not allow for Banners to be part of any order, and yet that was what was sold to meAlso sponsors are never to be announced at half time, and yet that was also promised to me by the sales-personThe school district, athleticts department, alerted us to the fact that Touch Down Sports does not do business with this district for this yearYes, we signed a contract, but the contract clearly states what is promised which is the banner and t-shirts which were never recieved, distributed, and the banner is not at all allowed in the district

The statement made by the 'Customer Service Department' of Touchdown Sports is falseTouchdown Sports operates on the premise that the initial contacts are made over the phone and the things they promise, state, are not recordedThe agreement between Bank of *** and Touchdown Sports was made 100% on the premise that Touchdown Sports was working directly with *** High School, which they weren't*** High School has confirmed that they had no prior knowledge about the arrangement of 'spirit shirts' they are aware of the scam and there have been local media reports in Montana regarding Touchdown Sports SCAMThey understand that they are misleading people and rely hoping to skirt away from any legal ramifications by adding "This contract shall not be changed, modifiedor cancelled, etc" The contracts themselves are made under pretensesThe attached email communications from myself and Touchdown Sports were regarding artwork onlyThey were sent before I was made aware of the scam. There was an email sent to Touchdown Sports when I became aware of that fraud had taken placeTouchdown has not responded at this timeIt doesn't take much detective work to figure out the business is operating under fraudulent practicesThere are many reports across the Country, not just in Montana stating the same things that I have stated in this formal complaintI have attached local media coverage regarding their SCAMs in Montana as well as Google Reviews stating the same thing as I have stated, and my email to them notifying them of their fraudI hope that Touchdown Sports is forced to close their doors as they should be and am confident that they will be because their business plan is fraudulent and they don't have a leg to stand on.I also let the company know that the only positive Google Review was made by their employee, they've since deleted the contents of the review because their employee was posing as a customer, another misrepresentation

I am rejecting this response because: Touchdown Sports states they were working with representatives from the two high schools we agreed to sponsor and that was not the case at allI spoke with the cheerleading sponsor personally. Also the artwork was not approved, nor were any of our logos approved or given permission to be used for reproduction by Touchdown Sports. Urgent Care by the Bay has not been provided with any tracking numbers for products provided to either school. When I spoke with *** on 12/2/2016, he said to send an email with an explanation and a refund would be issued. This company is preying on businesses that are trying to participate in sponsoring school athletics and then ripping them off!

I am rejecting this response because:I would like to see the signed contract that has been referred to twice in this response. I don't have a copy of the contract and the reason I don't have a copy of the contract is because it does not exist. I challenge Touchdown Sports to produced a signed contract. Also, [redacted] has worked for the [redacted] School District for 13 years and has been the cheer sponsor for 11 years. Again, I challenge Touchdown Sports to produce documentation that supports the claim that [redacted] stated that she does not work with the school. As the cheer sponsor for 11 years, I think she is in a better position to state whether or not the [redacted] School District has "ever" worked with Touchdown Sports. The simple solution to this issue is (1) Stop calling our local businesses and making fraudulent claims ([redacted] approved this, [redacted] doesn't work for the [redacted] school district she contracts with us, etc.; these are statements have been made by [redacted] to several business owners in our area) and (2) refund any money collected from local businesses because they were collected fraudulently.Short of that, there is no resolution.

To Whom It May Concern, I am writing to address the consumer complaintTo begin, we sold and followed all procedures for production as stated in the agreement. Submitted are the emails sent and received by the customer for purchased goods. As stated in the invoice received by the customer, “This...

contract shall not be changed, modified or cancelled. The advertised has not relied on any promises, statements or representations not contained herein.”  The customer then was sent an email by our art department stating a deadline for the artwork to be submitted, or art work would be created for them. The customer's artwork was received by our art department a day past the deadline. We work with nearly 1000 high schools and colleges. We made artwork for the customer, then sent a proof for them to review. The email was accidentally sent to the wrong email address, and the customer did not receive it in a timely manner. The customer did not follow up after September 27th,  so our art department did not catch that it went to the incorrect email. The customer then was contacted by one our of sales reps to see if she had received the proof. She stated she had not, so we submitted to her the first proof. Upon further investigation, our art department saw the emails the customer had received the deadline and submitted artwork. The artwork that was sent was then put on the banner. The original proof (that did not have the customers additional artwork), was sent instead of the final copy. That was due to lack of attention to detail, which lead to the letting go of that graphic artist. The final proof for the banner was never sent to the customer before print, as we did not know it went to an incorrect email, it did contain her provided images, as shown here in the attachments. The shirts were printed with the artwork our graphic artist provided, as the customer did not follow up before the items were due to be shipped. There was some miscommunication on our part, and we do apologize for that. The artwork  was made/provided, printed and shipped, fulfilling our part of the agreement which states,“This contract shall not be changed, modified or cancelled. The advertised has not relied on any promises, statements or representations not contained herin”.The items (shirts) that were sent to the customer were not returned. The items are at the school now and set to be displayed / distributed. Our part of the agreement was fulfilled. A refund would not be justifiable.  Sincerely, Touchdown Sports.
