The customer replied with an “Okay to proceed”, meaning she received our contract and understood its meaning and agreed. We provide extensive customer service via our graphic art department, to ensure the customer receives their perfect vision for advertisement.   As a quickly expanding company, we provide over 1000 High Schools and Colleges across the nation with free spirit items for a variety of sports teams. Producing the T-Shirts and Banners in house, and shipping them from our location directly to the sponsored school. Tracking numbers are kept and produced to customers who would like to follow up on when their items will arrive at the school. The items are addressed to our contact at the school, be it the cheer coach or someone else who handles spirit items. In this case, the items were addressed to [redacted] , whom we have been in contact with since October 2015. These spirit items are then to be distributed by the contact at the school, at their discretion. Once the school has requested items, we immediately begin reaching out to the community to get the school their items. We have provided the customer with tracking numbers, and the name of our contact at the school. “As it states in the agreement, This contract shall not be changed, modified or cancelled. The advertised has not relied on any promises, statements or representations not contained herin”. The customer needs to contact the school, to be advised about how the items were used. If the customer did not hear from our customer service department promptly, we do apologize. The items were created, produced and shipped for the customer. I am rejecting this response because:I have reached out to TouchDown Sports several times, and I am NOT receiving any communication back from them... it seems to be a complete scam.  I have called 6 times and left message each time and have emailed them 3 times with no response. if this is in fact their way of handling customers I definitely want a better exchange of action.

On 5/10/2016 we contacted [redacted] who agreed to receive free spirit items from Touchdown Sports. We do not lead anyone to believe we work on behalf of the school, and have fulfilled the obligations to the companies that sponsored the spirit items sent to the school.

I am rejecting this response because:Please note that the information provided in the email are false. In addition, I have never received any merchandise of any kind or deadlines of any kind. Please see attached. When [redacted] called early this week to ask if I liked the and she sent the proof as soon as I pointed out about the incorrect email, missing the @ sign and no picture, as I was promised. I was transferred to her supervisor, which apologized for the mistake and said they will make it up to me by making a bigger. At this point, I'm thinking the banner was to be redone, but then asked if he was to charge $500 to the same card, when I asked to clarify, he said he was talking about a banner on the football field. If  [redacted] had mistakenly sent me the wrong proof as stated on the business response, why was he so apologetic, blaming it on the supposed fired employee? Why him, a supervisor didn't fix the mistake and said customer service will be contacting me, which has not happened as of the writing of this message. In addition, I have contacted the Athletic Department at [redacted] HS and the Athletic Director stated the following: --------------------------------------------------------------------------------... of our sponsor packages are handling by the school's athletic booster club and not outside sources. As for Touchdown Sports, I have never communicated at any point in time with this group, nor have I ever in my 25 year career in Seminole County.As far as the gym in concerned, we do not have individual banners hanging in the facility. In terms of the shirts, our basketball program, to the best of my knowledge, does not have shirts with names of sponsors.-----------------------------------------------------------------------... paid for a banner that was going to be hanging in the gym and T-Shirts for [redacted] HS. [redacted] HS does not know Touchdown Sports at all. I was told by [redacted] how happy the coach was with the banners and shirts. My question is: Who's the coach? Let's arrange for a meeting at the school and take a look at the banner and shirts that were supposedly mailed. Let's see the postal records/receipts of such mailings, let's listen to the conversations. Let's look at the agreement between [redacted] HS and Touchdown Sports. Where is the money that was supposedly going to the school for sponsorship? Let's see a copy of the transaction.In addition, my number is registered in the Do not call registry.Kind regards, [redacted]

To Whom it May Concern, We do not operate on the premise that the initial contacts are made over the phone. I am assuming the contacts that are mentioned are with the school, and we have emails that are kept to and from the contact. We have had one disgruntled employee, delete 3 months of emails. Those are the only ones we have not yet been able to recover, but are in the process of contacting those schools again. We are not claiming that the representative  for [redacted] High School that the customer contacted, stated that they([redacted] High) had no prior knowledge about the arrangements. This does not mean that another representative did have knowledge and did not pass it along to their superiors. There is a news article stating we are a scam. Though we produce, print and ship all items, and they can be tracked by the tracking details we keep on file, that would prove we do fulfil our part of the agreement and are not a scam. The items are donations to the school, as they are free of charge to them. The contracts are not made under any pretense that is false. If they customer misinterprets something our sales representative has stated, that is out of our control.  In response to the google review, the former employee had family purchase shirts for their local high school. Resulting in the google review. It has since been deleted as he has since left the position, and requested his name to not be included in this customer's review. We do not intentionally mislead anyone. People will hear what they want, and we all know how someone's word is not always foolproof, that is why we have the invoice and agreement forms.   We are not attempting to “skirt away from any legal ramifications”, by putting our policy in the agreement form, as we do not perform illegal practices. Our contact at the school is [redacted], [redacted] Banner Tracking: [redacted]. Delivered to "[redacted] High School, [redacted]. Provided here or in previous emails is the agreement and/or contact information for the sponsored school(s). Tracking numbers for each of the approved items purchased, stating they were sent and delivered.Any other questions concerning the use of your items,  should be directed to the sponsored school(s)  Our part of the agreement has been fulfilled. As stated in the invoice that was sent and received by you, “THIS CONTRACT SHALL NOT BE CHANGED, MODIFIED OR CANCELLED. THE ADVERTISED HAS NOT RELIED ON ANY PROMISES, STATEMENTS OR REPRESENTATIONS NOT CONTAINED HERIN.”  Sincerely Customer Service Touchdown Sports."'   The items were created, produced and shipped for the customer. These spirit items are then to be distributed by the contact at the school. The Cheerleading coach stated she would like to receive these items for the school, as they were free of charge and required no further action on her part at the time. If she did not communicate with her superiors before requesting the items, that is not our issue nor are we at fault. Once the school has requested items, we immediately begin reaching out to the community to get the school their items. She stated she would like to receive these items for the high school, as they were free of charge. If she did not communicate with her  superiors before requesting the items, that is not our issue. Once the school has requested items, we immediately begin reaching out to the community to get the school their items. We have provided the  customers with tracking numbers, and the name of our contact at the school. “As it states in the agreement, This contract shall not be changed, modified or cancelled.
