Complete disregard of customer
I have been locked in a back and forth exchange with Mitchell Kenigsberg, Customer Service Representative, of Tough Mudder Races and Active, Inc., for two weeks now. I reached out to inquire about a refund for the 2020 Seattle Mudder Classic 10k race I purchased. Tough Mudder canceled that race of their own accord due to Covid-19. I had no problem with that and assumed my tickets would transfer to the next available race date for Seattle. However, in January of this year I had a catastrophic injury and and I am not medically allowed or capable to run the September race now. I let Mitchell know this, and offered to provide medical documentation and doctor’s note, instead of working with me, he cited the cancellation policy and told me that start times would be assigned to my wife and I and I have no reasonable expectation that those times would match up. He told me Tough Mudder sent out an email in January explaining how to register to pick a start time.

I looked for that email, and amongst the deluge of spam Tough Mudder has sent me over the year, there was no registration email. Maybe it went to junk, maybe they didn’t send it. I don’t know. What I do know is, if they’re are going to set up a short deadline to get value out of your paid tickets, then they should make every attempt to ensure that the customer is notified of that deadline. One email that may or may not have ended up in the junk file is certainly not an effective attempt.

But then, Tough Mudder lost a lot of money on the 2020 race, maybe their hoping to overbook this year and the 2020 customers don’t get to get a refund, transfer, selected race time, or maybe even will not know how to sign back up.

Either way, I tried to work within their ridiculously anti-customer and opportunist policy and at least get my wife and I the same start time and figure out a transfer or something as September approaches. Mitchell, feeling so generous, sent me a code to use to pick a start time that expired the following day. He didn’t tell me how or where to use it. When I fumbled my way through it I realized my wife’s ticket wasn’t there. I reached out again a couple days later after his arbitrary deadline had already passed and told him this. I found my wife’s account and he, after pressing him, gave me another code for her. That code expired a few hours after he sent it. I didn’t get the email till the following morning. So after calling him on it, he gave me till that night at 8:59pm PST. I immediately attempted to lock in both our race times together but was given an invalid message for the codes. I notified him of my multiple attempts, only then did he tell me that I was supposed to disregard my already active account and buy two new tickets and use the code, not as a registration code, as he had told me it was, but as a coupon code at checkout. He also explained to me that it was too late now and that I would be assigned a start time and would not commit to allowing my wife and my start time to be guarantee to match up. Even after I relented and told him I’d take an assigned start time.

I explained to him over and over again my medical situation, that my wife and I are both disabled Veterans who really like the race because of its team building and goal achieving challenges. I told him we’d be racing again as soon as my foot was healed enough that I could put those stresses on it. I even asked him if I could just transfer my ticket to another person so they could race with my wife. I cited their own policy on it and he said I could not because the race hasn’t been created yet!?! Really?

I’ve asked to speak to managers, he won’t let me. I’ve asked to have a phone call. He won’t do it. I’ve asked for a refund citing Covid and my injury. They use their policy which doesn’t include pandemic procedures to steal people’s money. I’ve asked to defer to 2022, which is allowed in their own policy, but he denied that too. I’ve asked to transfer my ticket to another racer and he has denied that. I’ve asked him to let me choose matching start times for my wife and I and he gave me a vague code and no instructions on how to use it along with a short expiration timer that made it very unlikely that I, crippled, while at work, commuting, seeing the doctor, kids, cooking dinner, etc had no opportunity to use in such a short amount of time. Then when I’d given up on all other avenues and simply asked him to “assign” my wife and I the same start times so we could at least be made whole after THEY canceled our first race, he would not even acknowledge the request. He did however say we would be assigned start times, no mention of together or not.

Never in my life have I felt so helpless to receive something that I paid hard earned money for. Never by a company have I been treated so inconsiderately and unethically. I’ve never seen a company use their policy so rigidly and obviously using covid 19 to their own financial benefit on the backs of their customers who have already felt massive financial loss. Then doing absolutely NOTHING to work with people.

I purchased tickets for a 2020 Race, they cancelled it and said I can run it in 2021. Well, I can’t run it in 2021, so now where are we? According to Tough Mudder and Active, Inc., that’s my problem and they will go ahead and hang on to my over 200 dollars, plus all the interest that money has accrued over the last year. To me that is criminal. I will absolutely file complaints with the BBB, FTC, and any other regulatory agency that may have powers over them. I’ve retained copies of all the correspondence with Mitchell & Tough. He has blatantly lied to me citing policy which does not prevent my requests.

I would not recommend Tough Mudder or Active, Inc. to anyone ever again. In fact I would say they operate on deceit and unethical business practice. They do not care about the racers. They only care about the money. They are not a wholesome, Earth loving organization, as they would have people believe. They are a greedy, corrupt, and pathetic organization that will tell people one thing, make deals with people, then steal from them if given half a chance.

Revdex.com: I have reviewed the response made by the business in reference to complaint ID# [redacted] , and have determined that my complaint has NOT been resolved because: Dealing with the customer service of this organization has been the primary issue all alongThe fact it took the Revdex.com to get involved to get a response (which was immediate once the Revdex.com got involved) is completely out of lineI could have received a "no" on the fee waiver months ago and settled for thatTough Mudder has issued a transfer but in my opinion, things have already escalatedI should never have had to get the Revdex.com involved to finally get the attention of this company that has ignored any realistic response to my contact for monthsI received a note from the company that they do not issue refunds yet that's exactly what I'm seekingIf they refuse to issue the refund, then their response will still be rejected by me as a dissatisfied customer In order for the Revdex.com to appropriately process your response, you MUST answer the question above Sincerely, [redacted]

I have emailed the company twice now in three weeks and heard nothing! Revdex.com: I have reviewed the response made by the business in reference to complaint ID# [redacted] , and have determined that my complaint has NOT been resolved because: [The transfer fees were not waivedPart of the fees were waived, but there is another portion of the fees that were not refunded after a verbal agreement was made to refund them I have copies of those e-mails attached, I believe that may assist the business in remembering the promise that was made Also, the transfer fee waiver response doesn't address the fact that several cordially written e-mails with legitimate complaints and concerns have been deliberately ignored I've also attached the second e-mail that I sent which never received a response.] In order for the Revdex.com to appropriately process your response, you MUST answer the question above Sincerely, [redacted]

Though Mudder has the worst customer service communication I have ever encounteredI purchased $ tickets for their event ‘Mudderella’ in June, and I paid $extra per ticket to be eligible for a refund in the event I could not attend the eventI have been trying for over months to get my $dollars back from their outsourced refund company ‘The Booking Project.’ The experience has been brutalNot one person will pick up the phone and call meI have asked over times for a representative to call from both companiesIt has all been email, I have been asked to fill out multiple forms, multiple timesThere have been at least different point of contacts who have come in on a completely different page, asking me to fill out the forms againI have yet to see the moneyI warn any future sponsor and/or attendee they are very unorganized, terrible with communication and there are good odds you will not get any of your money back The people who corresponded with me who did not get this issue resolved: [email protected] (Jodi, Kat) [email protected] [email protected] [email protected] (Vanessa)

Hello [redacted] ,We sincerely apologize your refund has not gone through as of yetIt typically takes 7-business days, but we will definitely look into this for you and get back to your original message.Warmly, [redacted]

Revdex.com: I have reviewed the response made by the business in reference to complaint ID# [redacted] , and have determined that my complaint has NOT been resolved because: I am rejecting the response at this current point in time for the following reason: Tough Mudder has now notified me to file for a claim through a third party company that requires complete documentation for refund validationThis company is not associated with Tough Mudder so Tough Mudder is essentially passing me offWhile I will be filing for a refund through EOS claims, this claims process ignores my issue with Tough Mudder and places additional burden on me to prove I'm somehow worthy of a return even with Tough Mudder's careless customer serviceI now have to justify, with documentation, why I deserve a refundEOS claims will have to validate me and review my claim requestThis process reminds me of submitting additional paperwork and justification for pay corrections within the Armed ForcesLast time I checked, this was a civilian business and eventNot a legal proceedingAs a side note, somehow now, [redacted] from Tough Mudder "reviewed" my ticket and offered up this possibility because I bought the ticket in That was known at the start so either [redacted] never really looked at my issue, or they are using this as an attempt to avoid admitting they do issue refundsIf this process results in a refund, I will accept the response of the next message from the businessIf not, then this process will have to simply go against Tough Mudder as an unsatisfied and annoyed customer In order for the Revdex.com to appropriately process your response, you MUST answer the question above Sincerely, [redacted]

Revdex.com: I have reviewed the response made by the business in reference to complaint ID# [redacted] , and have determined that my complaint has NOT been resolved because: Below is the response I received from Tough Mudder [redacted] Here is my response back."I take exception to your email in regards to saying "I do not wish to transfer"You're incorrectly assuming I have the ability, both time and money, to be able to travel to an event either this year or next year, and just would like a refund in generalWhile it is a "bummer" it was cancelled, the service I signed up for was not provided to me and the options you have presented offer me no consolationIt is terribly greedy for Tough Mudder's only options in this situation to require me to spend more time and money not only to travel to the event but also to trainI simply just can't afford to do this over againWhether it is in the terms and conditions or not, the right thing to do here is to issue a refund.I realize that after attempting to contact TM for over a month with no response, I received a response the same day (today) I wrote a complaint to the Revdex.comA customer should not have to go to such lengths to get the attention from a businessI will not be retracting my complaint with the Revdex.comLastly, in every correspondence I sent I asked that a phone number be sent to me in order to contact a person in regards to this issueYou failed to meet this requestPlease do not respond to me again unless you are ready to discuss issuing a refund or are will to provide a phone number." I paid for a serviced and was not provided the serviceTo expect someone to spend more time and money to obtain something they have already paid for is asinineI simply won't accept the options they have given for this factI won't consider the matter resolved unless issued a refund.Sincerely, [redacted]

I registered for a race, but then Tough Mudder changed the date and location without offering a chance for a refundI could not attend the new date/location, and have been trying to contact Tough Mudder for TWO MONTHS nowThey have gotten back to one of my emails saying they'd escalate it to another level, but that was a month ago and I haven't heard anythingI feel that they've stolen my money, and since they have no phone number I cannot contact them directly

This issue is being handled by Tough Mudder customer service and we are in contact with the customer

Revdex.com: I have reviewed the response made by the business in reference to complaint ID# [redacted] , and have determined that my complaint has NOT been resolved because: The business refuses to refund our moneyThey want to give me a credit for another eventWithdrawal from the original event was due to all the publicized safety issues and the accident someone had during one of their eventsWhy would I want a credit to participate in a future eventThank you, [redacted] In order for the Revdex.com to appropriately process your response, you MUST answer the question above Sincerely, [redacted] ***
