6/4/2014 we denied the claim to both the complainant and to his insurance company [redacted].  Based on our policyholder statement the complainant is the at fault party.  As such they are more than 51% at fault for the loss as such barred from any recovery under the Law.  8/20.2014 we denied [redacted] subrogation claim based on the same denial.   The complainant is guilty of one or more, failure to reduce speed to avoid an accident, improper lane usage, improper look out, inattentive driving.  That no police report was filed.  We side with our policyholder just like [redacted] would side with the complainant.  However, [redacted] closed their file.We denied this claim based on liability and continue to deny based on liability.  We will not reconsider the denial.  The claim remains denied.Thank you,[redacted]Claim ManagerUnited Equitable Group, Ltd

loss is under Reservation of Rights with coverage pending.  Our policy requires the policyholder report this loss in writing it has not been.  The loss was reported by the complainant which only serve to set up a claim and start an investigation. However, the policyholder shall and must comply with all terms and condition of the policy.  Any refusal from the policyholder not to co-operate or report the loss can be cause to deny coverage and the claim.  The complainant relies on the police report.  A police report is nothing more than a exchange of information.  A police report cannot be entered in as evidence in any legal proceeding it cannot even be mentioned in Court. In short its nothing more than an exchange of information. In any case this loss is under reservation of right with coverage pending.  The loss is less than 40 days old.  We have 60 days under state statute to provide the 3rd party/complainant with a status that the claim is pending and why, deny or make an offer. We have not reach that 60 days mark as of this date.  We are not excepting any liability until we have the full cooperation and report from our policyholder.  It appears the complainant/3rd party is demanding a settlement.  We have no other choice but to deny the claim and coverage.  We will not make any offer or settlement.  This is not to say he can't present a claim directly to the other party, its we will not provide any coverage due to policy violations.All request for payment is respectfully denied. Ron [redacted]Claim ManagerUnited Equitable Group, Ltd

repair the vehicle. Furthermore, this is a Comparative Negligence State, meaning no one is negligence free.  We photoed and estimated the damages to this vehicle.  Ms. P[redacted] has a copy of our estimate of repairs as well as our settlement draft.  The rear cover only needs to be refinished and nothing more.  The amount of the estimate is $375.00.  This is the only amount we will consider.  If  she has to rent a vehicle our policy is we will reimburse the rental upon submission of a paid rental car bill. This is reimbursed is at the rate of $21.99 per day for the time it takes to repair.  In this case the amount of time to repair is 8.3 hours or 2 days for an amount of $43.98.  We do not advance the amount or direct billing, a paid bill must be submitted. Review of the facts of this loss revealed Ms. P[redacted] made a sudden stop.  This sudden stop places 50% negligence on her.  However, a 100% offer was made.  If our offer is refused then it will be withdrawn and an offer of 50% will be made as the facts of the loss warrants a 50% offer.  This is final and will not be reconsidered.If she wishes to settle she simply needs to sign the back of the draft and cash it.  If she rejects the offer she simply needs to write across the front of the draft reject and return it to us.  At that point Ms. P[redacted] can take what  ever action she wishes and we will respond accordingly.Ron C[redacted]Claim ManagerUnited Equitable Group, Ltd

forced to leave a message.  The claimant was advised of our rental reimbursement policy.  He must submit a paid rental agreement from a licensed rental car company.  Once it is submitted we will reimburse at a rate of 21.99 per day for the time the estimate show it will take to repair the vehicle.  In this case the estimate reveals 108 hours or 2 days. [redacted] Claim Manager United Equitable Group Ltd
