Upstate Paving & Sealcoating

This company is a scam- hired them, paid them and they never showed up. Tried for a refund and they fought my credit card company dispute.

Went to court, got a judgement, just to find out they are bankrupt!

Charlotte is the most unprofessional person I’ve ever worked with.

Do not hire this company!

On 10/22/14, my husband and I hired Upstate Paving & Sealcoating to install and widen a blacktop driveway and create a cobblestone walkway They were reliable, friendly and did an overall great job The price was also reasonable [redacted] , the manager, was on site overseeing the job most of the day We were extremely pleased with the quality of work and the reasonable costI would have submitted this positive report sooner but I have a very ill family member who has been in and out of the hospital since that time

To whom it may concern, I talked with the customer at [redacted] about the complaintI will be taking care of the complaint asapAnd she knows she had lied about me not following up because I did follow up last falland my men went there and did some repair she was not there when they came ther Also ther is appoxiately percent water sitting in the driveway when it rains but when it stopps it goes awayso she is not happy with that but as I told her my contract states we don't gaurantee water drainage it is in possible to get a driveway percent accurate because I am good business person I am going to heat up blacktop and tamp areas for better drainage and give free sealcoatingThe day of the complaint I was on my way to her home and we came to agreement of making her happyI take it when where done she will update the complaintPlease review Pics it will surely see that no water sits on driveway after rain fa;ll It does at bottom of driveway on the road not on driveway.Thank You [redacted] UPSTATE PAVING AND SEALCOATING

This customer will say just about anything? about the driveway that was? installed.? Now he is stating? the lip? we installed near the edge of the garage? is hazardHe new up front that the lip was the only way to prevent water from going into the garageThe way he set up his wall that was installed in the back yardAlso there is a hill on the opposite side of the driveway, we had to dig into the hill to extend the driveway widerThe driveway is set into a area where there is a high hill surrounding sides of the driveway That is why we had to install a lip at the edge of the garage for xtra protection of preventing water entering the garageMr [redacted] was? well aware of the lip to be installed at the time he was ok with it now he is? complaining? about thatHe never said anything about it in the first complaint he wrote ? Response taken by phone: Her mother called in December when the season had already started We were having a bad snow storm and explained to her that we were pretty well booked but we could try to work her into the schedule We came to a verbal agreement and I told her we might not be able to come earlyShe gave me her credit card to pay for the service Why would she do that if she wasn't hiring us We plowed her at least timesShe called later in the season and wanted to cancel She put in a dispute with her credit card in the spring and the money was tied up for another days but they finally released the money to us She paid a flat rate for the season and she cancelled the service

So I had to hire someone else, who came every time, and did an amazing jobI never had to call them or had a single issueThey were doing the work Upstate Scam Plowing should have doneand nowhere where they to be foundI called for over two weeks , then weeks again and no one returned calls or answered my callsWhen I finally got a hold of them, Charlotte apologized, said she was in the hospital for two weeks and confirmed she would give me my money back and work something outNever did , so we started calling again, my Mother even called and to each of us Charlotte yelled, used vulgarity, insults and was the most unprofessional person I have ever come across proclaiming to own a business. Google and Yelp reviews confirm the same and a ratingShe knew they were wrong, she knew they never showed up after hired and verbally confirmed she would refund my money since they did not provide a service they were hired forI was more than fair, I would pay for the first plow and she could refund the restI can not understand how I was charged with no contract,never given a contract was asked over a month, how they showed up one time and never came again, never provided a service I paid forand because of this I had to hire and pay another company so my son could walk down the driveway to go to school. I should be refunded less one plow for $50. This business should truly be reviewed and hopefully I can save someone from going through this or getting scammed.

Response taken by phone: The consumer was there and was satisfied at the time of installation He signed off on the job and paid the bill The driveway was installed correctly In the contract it states there is no guarantee for drainage The driveway is pretty boxed in with hills and walls He knew we were putting a lip at the edge of the garage to stop the water from going into the garage The consumer is not willing to work with me and as the owner of the company I do not want someone else to speak for me or my business

She stated that they put down Item 4 rubble down(as seen in the attached photo) and then covered it with inches of fine rubble otherwise known as crusher stone (as seen in the other photo). From the pic you will notice there was not a notable change in height when the crusher is put on top of the crushed stone. If they did put inches of crusher on top of the Item 4(crushed stone) it would have most definitely brought the level of the two stone types above the garage floor. Add the inches of compacted asphalt on top of that and it all just does not add up. I am beginning to think I was not given the average of inches of uncompacted asphalt that was contracted either. That however is much harder to prove without coresamples. One more thing, I really don't appreciate her trying to make me out like a liar. This He said She said has got to stop. Hopefully we can stick to the facts which are the contract and the pictures I have taken during the driveway install. Thank you

Months of calling and she again would not take my phone calls when I asked where my refund was.? So I disputed with my credit card and she lied to them saying I gave authorization to charge-- but never provided a contract!? So now I'm trying to handle this way and hoping I don't have to pay an attorney more than I will get back in my rightfully due refundHow can they charge me for a season of plowing when they plowed one time and never showed up again??? The google and yelp reviews on this company are so many negative and people confirm dishonesty, bad service, vulgarity and unwillingness to solve a problemThis is not fair or right business and? I will not allow this to happen to me and my son, and hope I can avoid this happening to someone elseHow can this not be handled??? I am due a refund for work never performed, PLUS a credit card was charge with no authorization or contract,? and a service not provided that Im being charged for!? ? ? ?
