We were having a bad snow storm and explained to her that we were pretty well booked but we could try to work her into the schedule.? We came to a verbal agreement and I told her we might not be able to come earlyShe gave me her credit card to pay for the service.? Why would she do that if she wasn't hiring us.? We plowed her at least timesShe called later in the season and wanted to cancel.? She put in a dispute with her credit card in the spring and the money was tied up for another days but they finally released the money to us.? She paid a flat rate for the season and she cancelled the service.?

She stated that they put down Item 4 rubble down(as seen in the attached photo) and then covered it with 3 inches of fine rubble otherwise known as crusher stone (as seen in the other photo).  From the pic you will notice there was not a notable change in height when the crusher is put on top of the crushed stone.  If they did put 3 inches of crusher on top of the Item 4(crushed stone) it would have most definitely brought the level of the two stone types above the garage floor.  Add the 2.5 inches of compacted asphalt on top of that and it all just does not add up.  I am beginning to think I was not given the average of 3.5 inches of uncompacted asphalt that was contracted either.   That however is much harder to prove without coresamples. One more thing, I really don't appreciate her trying to make me out like a liar.    This He said She said has got to stop.   Hopefully we can stick to the facts which are the contract and the pictures I have taken during the driveway install.  Thank you.

This customer will say just about anything about the driveway that was installed. Now he is stating the lip we installed near the edge of the garage is hazard. He new up front that the lip was the only way to prevent water from going into the garage. The way he set...

up his wall that was installed in the back yard. Also there is a hill on the opposite side of the driveway, we had to dig into the hill to extend the driveway wider. The driveway is set into a area where there is a high hill surrounding 3 sides of the driveway . That is why we had to install a lip at the edge of the garage for xtra protection of preventing water entering the garage. Mr [redacted] was well aware of the lip to be installed at the time he was ok with it now he is complaining about that. He never said anything about it in the first complaint he wrote .  On my contract and most all blacktop paving professionals put on the contract that we can not guarantee water pitch. that is part of nature not all lands are set up the same. We told him that since his driveway sat in a gully some what were there are  hills on all 3 sides that is why we would have to put that lip there in front of the garage.
We have installed plenty of lips on several driveways. For a percaution of water not entering garage floors. As I said in the first complaint I had talked to this customer several times before he hired us. He had a whole year to make a desison . MY CONTRACT NOT RESPONSIBILE FOR DAMAGES DUE TO NATURAL CAUSES INCLUDING TREE ROOTS,GRASS, (WATER PITCH NOT GUARANTEE). YOU WILL SEE IT IN THE COPY I SENT YOU.
ALSO WE DUG OUT EXISITING ASPHALT DRIVEWAY WHICH WAS 2 LAYERS OF OLD DRIVEWAY, WHICN COMMON SENSE TELLS YOU THAT, THATS ABOUT 4.5" TO 6" OF BLACKTOP.
THEN WE GRADED OUT A TRUCK LOAD OF DIRT AND THE TRUCK HOLDS 10 TON  WE LEFT SOME EXISTING GOOD STONE FROM THEIR NEWLY ADD ON GARAGE. THEY HAD INSTALLED A NEW EXTENDION OF THERE GARAGE.
NEXT WE BROUGHT IN ABOUT 10 YARDS OF ITEM 4 RUBBLE WHICH WE GRADED THROUGHOUR SKID STEER, TO STRENGTHEN GROUND, THEN THROUGH OUR PAVER MACHINE WE LAYED 3" OF FINE RUBBLE, 2 STRIPS DOWN THE DRIVEWAY, WHICH WE POWER ROLLED WITH A TWO TON ROLLER. aND MY ROLLER IS A 2016 BRAND NEW ITS WORTH 35,000 DOLLARS. IT WAS ALL COMPACTED. hIS BASE IS FINE . fIRST OF ALL HE IS NOT PUTTING A BOAT ON THE DRIVEWAY OR A RV TRAILER. tHAT BASE IS WHAT ALL RESEDENTIAL HOMES GET. UNLESS THEY ARE GOING TO HAVE A BOAT OR RV PARKED ON THE DRIVEWAY.   THANK YOU CHARLOTTE

I have reviewed the response made by the business in reference to complaint ID [redacted]3, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
I have already presented estimates stating the driveway would need to be replaced in order to grade properly.  I have presented pictures showing that the driveway was not dug out properly and very clear pictures showing that 3 inches of crusher stone was not placed down as you stated in an earlier message.  My stand on this is that your crew does not have the proper experience to call themselves a professional paving crew.  As for the rest it seems to me that they were doing everything in their power to take shortcuts and bring your profit margin as high as possible.  This includes not wasting time or money digging out and putting down the proper base.  Also From just looking at pictures I can tell that there is thin spots of asphalt throughout the driveway.  I have already contacted an individual who is willing to remove small sections so I can get an idea just how little asphalt was put down and show the poor base as well.I realize you are hoping I will just give up and this can be thrown in the resolved column but that will not happen.  We can go back and forth as long as you want.

repair she was not there when they came ther . Also ther is appoxiately 10 percent water sitting in the driveway when it rains but when it stopps it goes away. so she is not happy with that but as I told her my contract states we don't gaurantee  water drainage it is in possible to get a driveway 100 percent accurate..  because I am good business person I am going to heat up blacktop and tamp areas for better drainage and give free sealcoating. The day of the complaint I was on my way to her home and we came to agreement of making her happy. I take it when where done she will update the complaint. Please review Pics it will surely see that no water sits on driveway after rain fa;ll . It does at bottom of driveway on the road not on driveway.Thank You

UPSTATE PAVING AND SEALCOATING

On 10/22/14, my husband and I hired Upstate Paving & Sealcoating to install and widen a blacktop driveway and create a cobblestone walkway. They were reliable, friendly and did an overall great job. The price was also reasonable. [redacted], the manager, was on site overseeing the job most of the day. We were extremely pleased with the quality of work and the reasonable cost.
I would have submitted this positive report sooner but I have a very ill family member who has been in and out of the hospital since that time.

Response taken by phone:  The consumer was there and was satisfied at the time of installation.  He signed off on the job and paid the bill.  The driveway was installed correctly.  In the contract it states there is no guarantee for drainage.  The driveway is pretty boxed in with hills and walls.  He knew we were putting a lip at the edge of the garage to stop the water from going into the garage.  The consumer is not willing to work with me and as the owner of the company I do not want someone else to speak for me or my business.

To whom it mayconcern. Completely fabricated story .Her mother called for our service sometime at the end of December 2016 asking how much for plow service her daughter was out side shoveling. I told her that we were very booked and and there was no way we could get to hrr early morning to plow but...

if she wanted service still we would do our best to plow her as soon as we can get ther around 8 or 9 am maybe she saod that would be find and put us on my schedule. She said She would call me back when she talked to her daughter. Within a couple hrs I got a call from Mrs [redacted] . Asking questions I explained how it would work and how much. She then gave me her credit card and we did the transaction. She located me on home advisor. I have been doing snow plowing for 2 seasons and have no complaints. Have repeat business from other customers. This lady fired me and my company last February 2017. She was very upset because we were later in the day to plow her out. She had called me complaining that we did not get to her until late that day. We had a very bad snow strom and it took a long time to get to all of the customers. So you can understand she called me an was furiest about not getting to her in time. I sent my boys to her house to  they cleaned anplowed the driveway. She then callsme and said I am mad you xame here lare. I did notwant ur service anylonger. I hired someone else so dont come to my property. ok so then she calls me an tells me she wants a refund and I told her no one gets a refund. when u fired us. she then n calls an argues with me an  demands her refund I told her that no one gets a refund. she then takes this to the credit card services.  Then the card services take the money out of my account and disputes this for 60 days they finally made to a desion an found I was in the right an gave me my money back. TThen u recieved a letter from a attorney an I called him an explained the situation an he told me he was a friend of her families an I told him what happened an he told me that he explained to her how that the way snow removal works. And he word not come to Saratoga from Utica to small claims court cause she would not win. please this person fired us an expects a refund we were more then happy to finish the work. she refused our service. she paid me in full an ther is no problem except we were late one afternoon do to the weather. .  I am on yelp with great reviews. this lady lies I did not call her dirty names thats unreasonable I would never. yes ther are a couple bad reviews with blacktop buthey are unreasonable. We did nothing wrong She paid me for a service then after 3 times of service fired us that is the truth for being late. which I told her when she called that we were booked an would try to accommodate her the best we could.thank you Charlotte.
