I would like to amend my response concerning nonacceptance of US Restoration's response to my complaintAt no time did US Restoration ever tell me that there had to be at least two other jobs before scheduling my small repair jobI was assured by [redacted] in September and again in November that the repairs would be made before winter Thank You, [redacted]

I am rejecting this response because:From: [redacted] < [redacted] >Date: Mon, Aug 29, at 3:PMSubject: RE: You have a new message from the Revdex.com of Central Ohio in regards to your complaint # [redacted] To: Revdex.com < [redacted] They are lyingMy insurance company never replaces entire roofsThey are telling you liesThey could not do the job as promised so I let them goI was unable to do this in the days they state in their contract as they took longer than that to let us know the insurance company would not replace the entire roof

We are still trying to set up to do this with our installation crew

I am rejecting this response because: t is not trueI was calling the number on the business card I was givenI showed the card and the number I was calling from my cell phone to a company rep who came to my home yesterday (8/3/15)He insured the work would begin today and completed by next week and I accepted that resolution Regards, [redacted] **

The insurance company has miscalculated their estimate on the rear wall of the home It should be over square feet not We have been ignored by the carrier for a month and a half and have left several messages to no avail We have a solution to repair this with the homeowner

The insurance company must approve our total estimate before any more work can be doneMr [redacted] , we explained how pride public adjusting was hired to try to reconcile the difference sMr [redacted] please call a few demand that your insurance reconcile with our estimateYou must complain to your insurance

They have been saying the same thing for weeks and still not able to give me a date for completionNot aceptable as I sold this house

The insurance company has been contacted about outstanding bill g that we are owed on the roof replacementWe are looking for a sub contractor to do the gutters at this time

We have revised our bill to deduct off the previously billed step flashing We thought it was replaced around the skylights We were able to reuse itSo therefore, there is a balance of $owed to us We are willing to write this off as a paid in full Per our contract with Mr and Mrs *** The overhead and profit goes to the company to settle and negotiate the bill with the insurance carrier We consider this settled at this point If there is anything else please let me know.Dan S [redacted] General ManagerU.SRestoration & Remodeling, Inccell ###-###-####phone ###-###-####fax ###-###-####

From: Dan S [mailto: [redacted] ] Sent: Tuesday, August 02, 11:AMTo: [redacted] Subject: RE: Revdex.com complaint [redacted] binding arbitration cannot be done as we are awaiting the final payment to be disbursed from the insurance company for well over $ At that time it could be an option The insurance is still trying to not pay overhead and profit which is owed on the claim.I recommend that MR [redacted] file a complaint on [redacted] insurance for not paying something owed by his policy He should file complaints with the Pennsylvanis Department of Insurance, Revdex.com and State of Pa attorney general's office on [redacted] We are not the bad guys here Per his contract we are owed o and p and we are a general contractor We have complied with everything the insurance company has requested, they are being unscrupulous and he has a clear cut case for a bad faith lawsuit at this time A bad faith lawsuit would pay him times punitive damages We have asked him to allow us to file for an appraiser because that will force the insurance to pay or give us the right to sue [redacted] for him Our attorneys sue insurance companies for free on bad faith claims because the insurance company always has to pay their bill90% of the claims filed get settled, the other 10% are won with punitive damages[redacted] has been notorious for not paying claimsEspecially o and pWe also have proof of [redacted] doing the exact same thing on different claims as well as proof on claims where they have paid the o and p Dan S [redacted] U.SRestoration & Remodeling, Inccell ###-###-####phone ###-###-####fax ###-###-####

Attached you will find a PDF file with the original letter that we sent to the StPeters, MO office for US RestorationThe letter was sent certified and then returned to us as it seems that they no occupy that location ( but the sign is still in the window and their website still has that address listed )The letter spells out the issues that we still feel needs addressingThere are pics in the attached PDF as well showing some of the damage caused by the workers to the siding and bushesThe first pic after the letter is a shingle tab pulled from the top open pack of shingles that the crew was placing on our home ( that we do agree said Estate Gray ) and then laid on the top of our existing light gray roof that we were tearing offThe new shingle is nearly the same color and maybe a bit lighter/brighter than what we had, and we wanted to go much darker as seen in the bottom of that pic ( see note )The Estate Gray is on the Right and what it looks like is in the Lower Left of the color chartThere is a HUGE difference in the color from the sample and what the shingles actually look likeI understand that the 'package' said it was 'Estate Gray', but once you see the photo you can see that the color is not close to what 'should have been' in the packageI know it does not happen often where an item is packaged in the wrong wrapper, but it clearly looks like it may have happened with the skid of shingles that we receivedThe color is so much lighter than the Estate Gray ( it looks like the Sierra Gray )I do not dispute that the order that we placed was for Estate Gray, the package was labeled Estate Gray...but what was inside surely does not look like the DARKER Estate Gray! We just wanted the color that we ordered...Estate Gray like seen in the sample! We also wanted to not have any damage to our bushes and siding as well and are needing to finalize this ASAP as we need to get working on the siding again as it has been months since we started the roof and still can not get our issues resolvedDo you feel that after seeing the photos of the NEW shingles in the pics that they look like the Estate Gray color as seen in the sample book? Regards, [redacted]

We previously responded to this complaint We have done 85% of the work on the claim and are working with the insurance company on an estimate to repair the rest of the home properly The siding piece was cut to have it analyzed to see if there was a match for the existing siding There is not an acceptable match so we are trying to get all the siding replaced Once we come to an agreement with the homeowners insurance we can wrap this up Unfortunately, the homeowner complained to you because they could not get a hold of the sales rep on their personal phone We have informed the homeowner they need to call the office on their production matters not the rep The homeowner still owes a bunch of money when the repairs are done and we cannot bill the insurance out till we complete the repairs We are working on all of these items as best as we can

The estate gray shingle is a dimensional shingle and has different variations of color to give it a 3d look We did what you wanted This is the first I have heard about the bushesPlease call our office at ###-###-#### to get this addressed We will also try to call you I cannot do anything about the roof as it is installed properly and we gave you what you ordered and the supplier supplied the right productI have not seen any photos of the bushes

They have yet to contact us about the unfinished stuffAnd there are damaged items they haven't addressedA screen guy contacted us but has been hereThey think about final bill, money of course when we have been dealing with incomplete work, no return calls and over all unsatisficed bussiness

We previously responded to this complaint that we were working with the homeowner to complete their insurance repairs 85% of the work was the roof and it is complete The remaining minor trades were being scheduled to complete but they have to be coordinated to efficiently complete The homeowner will still owe us more money when the job is done We cannot bill out the balance to their insurance company until they are all done So once we complete the repairs we will address this with their insurance company so we can be paid in full

It is not faulty workmanship on our part when there is an improper installation of the electric in the house attic The code book does not allow for electric wires to be run on the underside of the deckingSo due to the roof being replaced this is a consequential loss and USAA insurance should pay for this not usPlease submit your bill to usaa and explain what happenedIf they say they wont pay for it you can sue them in small claims court

The homeowner executed a contract with US Restoration & Remodeling, Incon 8/20/2014, but did not provide us with his insurance paperwork and mortgage paperwork until the first week of October His insurance check then had to be processed by his mortgage company before he could tender his deposit, which did not even happen until the end of October We had rain days in October, so by the time Mr [redacted] gave us his deposit we had clients before him to have their installs performed We told him that we would do our best to get to him before winter but it was not likely The weather turned right around Thanksgiving and at this time we told him he would have to wait till SpringWe told Mr [redacted] he had to have a Spring install for two (2) important reasons: He has Rolled Asphalt Roofing (flat roof) and Rubber Roofing (flat roof) which require a warm temperature to adhere and install This cannot be done in colder temperatures otherwise the integrity of the roof is seriously jeopardized and we would be unable to provide him with any warranty, which each of our clients receive His residence is a 3-story row house with no access He also has slate and metal roofing which makes it a very complex install that only a limited amount of companies, including USR&R, are qualified to make Because there is no access, the complexity of the install and most importantly, safety concerns; i.e., frost and condensation on the slate and metal roofs, it is reckless to perform the install during the winter months We have performed over commercial and residential installs in the last years Any company that claims they can perform these repairs during the winter must be seriously questioned and/or examined We’ve told Mr [redacted] since late October that we will perform his install as soon as possible in the Spring once the weather takes a turn USR&R will not jeopardize the safety of our workers or the integrity of our services under any circumstanceIt should also be noted, our supplement department has been working on estimate to send to [redacted] Insurance on Mr [redacted] 's behalf because they are trying to get away with only paying $13,on a claim that will actually cost well over $25,000.00, which is fairly typical for insurance companies to initially do in a claim like this We want to ensure Mr [redacted] receives the insurance proceeds in which he is entitled so his residence is put back together as it should be

Received a call from Sean on Wednesday (Oct 15, 2014) stating that he was going to call on Friday to schedule a time to come out to the house to take a piece of siding with him to try to matchToday is Monday (October 27) and NO CALL!These "minor issues" includes siding replacement, screen replacement and flashingReferring to the funds "depreciation value" that need to be paid to the company will be released by the insurance company when the work is COMPLETEAfter all, you have the majority of payment ($14,plus)A roof does not cost $14,dollarsWe realize that it takes some time to schedule, but this is ridiculous!!!!! Communication is POOR !!!!!!!!! Regards, [redacted] ***

We have been trying to reach Mr [redacted] for several weeks. He has not paid for the work we have done. We have done all the work we were contracted to do per our contract. We finally talked to him last night on 6-7-17. This complaint was filed on 6-5-17 after we left him a message... saying it would be turned over to a collection agency. The homeowner stated again last night he was happy with the work. We would be happy to go to binding arbitration. However we will have to proceed with the collection process if we are not paid promptly. Moreover the claim rights were assigned over to us and the final check should have been paid directly to us from [redacted] ***. This is a violation of the law. Per our contract and assignment of claim we are to be paid directly and immediately. Please see the attached documentation.

We have talked to the homeowner and are meeting he is meeting with Sean this week to try to resolve these minor issuesThere will still be funds that need paid to our company that the insurance has not yet released for supplementsWe cannot submit for this until the work is all complete% of the work is done in the largest portion is the roofIt takes some scheduling and coordination for the smaller trades
