Dear *** and his Revdex.com complaint,Multiple emails and phone conversations explaining your Owner Statement in regards to a Utopia non-holding a tenant deposit, but instead, Utopia holding a "Reserve" collected from first months rent received from the tenant was addressed with you and our staffWe will repost the section in our Management Agreement in which you have signed when we first started managing your property till termination. Sections of Management Agreement:h) Tenant DepositsTenant security deposits shall be handled as follows: Utopia shall mail or electronically transfer security deposits received from tenants of the Managed Property on the date and in the manner which is customary to Utopia to the last known address of the OwnerOwner shall deliver the entire security deposit to Utopia upon demand or if instructed by Utopia shall return all or a portion of the security deposit determined by Utopia to be due tenant pursuant to the rental agreement or lease with tenant immediately upon demand to tenant with a copy evidencing return of such deposit to UtopiaIf Utopia instructs Owner to pay an amount less than the entire security deposit to tenant, the balance of the security deposit not paid to tenant, if any, shall be immediately delivered to Utopia so it can be applied toward any outstanding expenses, costs, or fees of the Managed PropertyTo the extent the balance on account for Owner is less than the sum of the Reserves and Additional Reserves (as such terms are defined below) at the end of any reporting period, Owner hereby instructs Utopia to hold back from the security deposit(s) the amount necessary to return the balance to an amount equal to the sum of the Reserves and Additional ReservesShould Utopia hold back funds from the security deposit as instructed above, Owner hereby acknowledges effective receipt of the entire security deposit and agrees none of the funds held on Owner’s account at Utopia are or should be properly deemed to be a security deposit(s) or any portion of a security deposit(s) of any tenant(s) of the Managed PropertyShould the Owner or Utopia terminate Utopia’s services under this Agreement, the return of any security deposit or assessment thereof for any tenant vacancy, which occurs after the Notice of Termination, shall be performed solely by OwnerShould Owner and Utopia mutually agree that Utopia will coordinate the return of a security deposit to tenant after the Notice of Termination, Utopiashall be paid an additional fee of $250per tenant in which it provides such serviceTo the extent any of the above fees are deemed to be liquidated damages, the parties agree that: 1) under the circumstances, it would be impracticable or extremely difficult for Utopia to fix and/or determine Utopia's actual damages from the breach of the agreement to pay the fees; and 2) the fees charged under this paragraph are reasonable, being the parties’ best efforts to reasonably estimate Utopia’s damages.I)ReservesOwner shall maintain at all times a minimum reserve in Utopia’s trust account for the Managed Property, equal to the amount determined by Utopia (the “Reserves”)Should the balance in the account for the benefit of the Managed Properties ever be less than the minimum Reserves, Owner agrees to deliver funds to Utopia in an amount equal to the difference between the minimum Reserves and thebalance in the accountAdditional reserves may be maintained (“Additional Reserves”).Thank you,*** and ***

It has been over two weeks since I terminated Property management services with Utopia Property ManagementTwo weeks ago, on July 21st, I received acknowledgement from them via emailI still have not received the lease agreement, walk thru, keys, etc...for my current tenant in my rental propertyA week ago I sent them an email requesting a tracking number for their package and also inquiring when they sent itI have had no responseMy tenant, my new property manager and I are all still waiting on this information
I want the information on my tenant including all keys, etcto my property expedited to me immediately

Mr***'s response has been reviewedWhile we appreciate his opinions and concerns, our
position remains the sameWe are regretful that Mr*** feels that he did not receive
satisfactory service, however we feel that we performed the duties that we were hired to perform
to the best of our capabilitiesMr*** now has a qualified long term tenant for his home and
we wish him the bestAt this time, all business obligations have been fulfilled

Tell us why here... We apologize for the miscommunication. We did fully process the group of applications, but also received applications from other interested parties around the same timeOur company does not approve applicants on a first come first served basis. Rather,
applicants are chosen based on an established and proven set of criteriaIn order to ensure we are placing quality tenants we have basic requirements that we expect them to meetThis includes, no prior evictions, no prior debt to landlord, a combined gross household income of times the monthly rent, no bankruptcy in the past years, and all applicants must have good to excellent creditUnfortunately, the property was not offered to this particular set of applicants as they did not meet our qualification standardsDue to the volume of applications we receive, it is very difficult to call every single applicant as soon as a decision is madeTo counteract this difficulty we email the applicants and mail out adverse action letters notifying them that their application was not approved and for what reasonWe emailed this notice to these particular applicants on August 31st and sent the adverse action letter via USPS on September 1stAgain, our sincerest apologies that we could not offer the apologies to these particular applicantsUtopia Management holds that a refund is not in order due to the fact that the screening protocol was followed and unfortunately these applicants did not meet our qualifications

I just wanted to say that the letting progress on my apartment was done very efficiently and quicklyNew tenants seem happy and appear to love the apartmentTeam member at Utopia Management Incmanaged to answer all my questions and queries efficiently and clearly, enabling me to be happy with the service that I have receivedi would definitely recommend Utopia Management Incto friends if they have a property to let

Utopia Management, is dishonest and thinks they can say anything and not be accountable for what they disclose I couldn't get a viewing appt, called and called, I had to pay for the unit before I could see itMoving long distance and only there for the day, I had a brief viewing, I noted that there was gas hook ups for laundry machines, I called and called, emailed, over and over to confirm this before moving and ordering appliances, and they gave me incorrect specifications on the house and won't take responsibility for what they saidI had to exchange the machines and lost $354.49, in which they are refusing to be accountable and reimburse meThere are ongoing repairs and maintenance issues - no hot water, multiple gas leaks, hazards, among many others; they listed the house as a 3bd/2bath and it is not, they never spoke of there being a loft, and only after I paid, I realized it's really a 2bd with a loft/2bath, so it's marked way over market price and was deliberately misleading San Diego code violation, as they misrepresented the house as bedrooms (City of San Diego section 11.0104)They are dishonest, greedy in just wanting it rented, do not maintain their properties well (as I have loads of repairs still ongoing), and horrible customer service, so far I've gone from Madi, to Melissa, to Melinda, to Johana - managers

The staff at Utopia Management Inchas been just a great experience in every aspect of rentingThey are always cheerful, happy to serve people even on the phoneThe process of getting papers signed and getting into a place was effortless and enjoyableThe property that I am renting is very well maintained and is the perfect priceI am happy where I'm at and will be signing another year's lease with them

Found Utopia Management Inc very professional and easy to deal with who has gone beyond their duties to help us with leasing our propertyWould highly recommend this agency to anyone

I have requested not once but numerous times to be notified
before any maintenance can be performed.
I have attached an email showing acknowledgment that a note should have
been place on April 1st, (see below). This particular email was dated on April 1st,
On May 2, was another request made by me for Utopia to honor my wish
to be notified for any maintenance that needs to be performed. Therefore, the works that were performed
during the month of April were in fact NOT AUTHORIZED
The note should have been placed on the account since April
1st, according to the response from one of your employee at
Utopia Management.**Due to privacy concerns the image has been removed**

I am responding to the complaint response made by a clientOriginal Complaint
/21/Z014, Case ***
As the agent for the owner we are given the authority via management agreement to
make repairs, at the owner's expense, to items that may violate the implied warranty of
habitability or that we deem necessary to the tenant's safetyIn this case, both our
maintenance technician and a licensed professional electrician advised that the
electrical issue in the home was a potential hazard and should be corrected
Correspondence between the property owner and Utopia shows that the property
owner did not want to make the repairsln the interest of the safety of the tenant, and
also in the interest of decreasing liabilty o.n Ms*** as the landlord, we invoked our
authority and made the necessary repairsPlease note that we try as much as possible
to accommodate the property owner's request with regard to how maintenance is
handledHowever, we cannot always do that especially jn emergency situations, or in
situations that may impose a safety threatThe electrical issues were corrected at the
owner's expenseBy doing this, we corrected what was deemed by professionals as a
potential fire hazard
We are currently looking into this
As a courtesy we attempt, again, to accommodate requests from property ownersThe
owner's requests for calls were often honored, but admittedly, not alwaysSome
situations call for us to send notice in writing, and sometimes, while again we would
like to accommodate the client's request~ sometimes we have to email items to their
attentionThe owner has often responded to our emails and given instructions via
emailAs for the confusion with the garage door, the complaint was relayed to the
owner in the exact language thatthe tenants relayed the complaintSo it appears to
have been a difference in the usage of terms
Owner statements are automatically generated by our management softwareThe
client chose to be set up to not receive statement.-via email rather to receive them via
mailOnce being notified that she did not receive a statement, another one was sent
Also, not all accounts are set up the same wayAnd depending on the situation, some
accounts may incur charges that others may notThis has no relevance to the
complaint at hand as these are two entirely separate contracts and arrangements
It is not, nor has it ever been, Utopia's policy to cancel the services of an owner's
personal vendorThe only incident in which this action would have occurred is if the
gardener was listed on our vendor registerBut, we had no contact with this gardener
when the owner signed on with our companySo the responsibility would fall on her
to have cancelled the servicesThe vendor that we secured for her was in fact servicing
the propertyAnd this is supported by an issue that arose with the previous tenants
granting him access to the 'back yard on the days he visited the propertyWe have
worked with this particular gardener for several years and have never had any issues or
complaint from any tenants orproperty owners with regard tCI his servicesAt this
time, we do not feel that a reimbursement for his services is in order
A complete inspection of the property took place immediately after the tenant's
departureAs a part of the move in/move out process our company adheres to a
mandatory inspection that takes place prior to a new tenant moving inThis practice is
m place as a check and balances system that our management teams u..'le in to ensure all
damages and defects caused by the previous tenant are discoveredThe owner was
emailed pictures prior to the secondary inspection being performed and while she did
point out the log set, we believe that upon our second inspection we would have noted
it as well
The owner was responded to within two business days

From the mo
inspection results emailed to me (dated January 24), MrsS*** ***
indicated, using her exact words, the home had only “a few minor issues” to
include the kitchen drawers, bathtub, and carpet next to entry. For some reason now, she indicates that every
room in the home required a major deep clean.
I’ve asked for an explanation since March 2nd why there is a
discrepancy between her initial assessment and her claim now, including any
documentation to justify her claim, but I have not received any feedback
Based on her initial assessment
I authorized a $work limit. I was
never given any indication that Utopia believed the home required any
additional work, other than the “minor issues” identified. The scope of work that was charged to my
account was in the amount of $for bedrooms, baths and sqft of
carpet. The scope of work should have
been only to address the “minor issues” identified by MrsS*** ***
I was never given any notification
that Utopia was going to disregard my direction and move forward with cleaning
of the complete home. I did not find out
that unnecessary work had been authorized by Utopia until March 2nd,
when the monthly statement was released.
They chose to take unilateral action without properly informing me or
consulting with me their intentions
Utopia has the right to
exercise with “absolute discretion” to “Make or cause to be made repairs,
improvements”. If they chose to exercise
that right without my consultation they are liable for the decisions they
make. The contract indicates Utopia is
required to “Use reasonable diligence in the performance of this
Agreement”. They failed to consult with
me their decision to go forward with unnecessary work and were reckless in
their management processes
If Utopia insists that
their contract gives them unrestricted authority to make decisions without my
consultation I submit that they are in violation of State Law. Unless Utopia clarifies their processes to
ensure I am included in all future decisions that results in a charge to my
operating funds, my intention is to file a complaint with the California Department
of Consumer Affairs, the Consumer Affairs Department at the San Diego County
District Attorney's Office, as well as informing the California Bureau of Real
Estate of their business practice
I do appreciate the work
that Mrs*** *** and Mrs*** *** has provided thus far, but
I strongly feel that I need a team that is more careful in how they manage my expenses
At this
point I feel the need to move forward with a new team

We question these expenses because Utopia did such a poor job, and we don't know on what base they are charging us the lease fee, what are the maintenance supplies? A water heater cost about dollars in home depot why they are inflating these prices (need a receipt)We asked they tenant, and they told us that hey never called Utopia about leaks !!! Trash removal didn't happen, and we ended up paying $for a third party to remove the trash
This is another example of the mismanagement provide by Utopia for this property(They should pay us back most if not all of these inflated charges)Where are the receipts - they didn't send us clear data supporting these inflated charges

We have been working with Utopia Management Inc for the past several yearsThey manage rental houses for us in the San Diego area and do an absolutely outstanding job filling vacancies, managing tenants and dealing with the upkeep of the propertiesThey respond to issues immediately and conscientiously and pleasantly, and are very knowledgeable about the San Diego realty market I highly recommend this group!

Utopia Management Incmanages three rentals for meThis year two became void and Utopia Management Incworked really hard to fill them both the day after the old tenants leftThey succeeded in getting me excellent rents on nice long leasesThoroughly recommend them
