At time of contract homeowner explained he had all the funds to start and complete entire job. first payment was received and work was commenced up until second payment was due, which was approximately $6,500, Homeowner then said he used the money to install a new boiler in which my company was not contracted to do. He came up with $2,000 of the $6,500 and said to continue and would submit the rest of the second payment asap. we continued up until the rest of the payment was due, he then said he was out of money and could not continue. I had no problem with the situation and we agreed that I would continue when funds were available. At this point we were both in agreement and I re-assured the homeowner that I would be back when funds were available. Review: Valla Construction was hired to finish half of our basement after it was flooded from hurricane Sandy. The funds were provided by NY Rising as a grant and the owner of the company, [redacted], was told from the start that half the money was provided up front and the second half would be provided upon completion as per NY Rising. The carpenter that was sent to do the job was nice but worked very short days (10ish am-3pm)....the approx completion date of 3 weeks came and went and very little was done. There were several days when no one would even show up or let us know they weren't coming, when later questions they said it was because the supplies needed did not arrive in time. After completing just the french drains and part of the framing we were asked for more money. We explained again about NY Rising and the agreement we had from the start and we were told they needed more money to continue working. We foolishly scrambled to get as much money as we could to lay out until the completion ($2000). Framing and dry wall was finished and taping and spackling was started. They again did not show up for work and when questioned said again they needed more money to continue. We explained we had now more money to give until we got the second half upon completion. They stopped work and refused to finish the job, at first offering our $969.27 back as the amount we paid was more than the amount designated up until that point in our contract. We tried to contact them to see when we would get the refund and had a delayed response of about a week. When we finally heard back [redacted] told us that there was no money to refund, when questioned about where the money went we were told the sheet rock that was used was more expensive than anticipated as he used a special kind for the basement and he had to cover the cost of the dumpster. In our "scope of work" it included the cost of the dumpster as well as the basement grade sheetrock. We are stuck in limbo now having taken the first half of the grant and not being able to finish work as well as out almost $1000. We just want them to do what is right and refund the money laid out in the scope of work that was not used, we personally finished the spackling and sanding as well as painted when that should have been included in the amount we paid as well.Desired Settlement: We understand things don't always go as planned. If the contractor does not want to finish the job as planned and get the check from NY rising at the end that is fine BUT we are a family of four struggling to pay bills and the money we laid out that was not used for anything in the scope of work should be returned ($969.27).

Review: 1 - The down spout is just getting the correct color and replacing it.2- The toilet in the basement. He needs to get your plumber back and fix the flushing/drainage problem. I paid $7,000 for that bathroom and I does not work. I am not a plumber and cannot give him advice. Between the contractor and the plumber need come up with some type of remedy on fixing this drainage problem.3 The chimney does not hold in the smoke inside the fire box. I am neither a mason nor a chimney builder so all I know is that there is no draft in the chimney itself to draw up the smoke. This problem is due to the chimney not being built correctly as you know. There is no smoke shelf, the back of the firebox inside does not curve up, the sides are straight and should be tilted in on an angle inside the fire box, there is no drop down fascia inside the firebox and I dont believe the height of the chimney extends 2-0 above the peak of the house. All of these details were on the architects drawings Valla had to build the house and were not followed by Valla and the mason. As I mentioned before I am not a chimney builder so I cant tell Valla what to doIts up the and chimney contractor to come up with the best means and methods to resolve this situation to get this chimney working properly. This has been going on for two years and nothing has been done to finally fix it.Desired Settlement: I am looking for $75,000 to fix all the problems listed above.
