Unfortunately, home warranty plans in Texas do not cover pre-existing conditions.  The service contract states that we reserve the right to request documentation to verify if a covered component was operable or in the process of a failure at time purchase of the warranty.  The Wares home...

inspection report noted deficiencies to the A/C unit, which should have been checked out by a certified A/C tech.  They did not and this lack of follow up failed to identify a long term material degradation failure of the evaporator coil.  It is common knowledge that material degradation of copper doesn't occur in a short amount of time, rather it takes several months and years.  We hope this clarifies our decision and clears up any misunderstanding on the client's coverage.

We understand your grievance, however our cash-outs are commensurate with our actual cost as noted in the service contract.  Unfortunately, we will not be able to offer more than the $300.

they are not even comparing the correct items. Gas is NOT an option! Sad that they will not reconsider, I feel I have provided enough evidence for they to consider.I will NOT renew the contract! I will encourage everyone I know not to use them as well.

We apologize for any misunderstanding.  There are two factors at play when application of coverage is decided.  The first factor that we take into consideration is whether this failure occurred within the lifespan of the warranty.  [redacted] ordered a monthly current homeowner...

warranty and shortly thereafter placed a service request for a new [redacted] install.  As easily identifiable, [redacted]s do not fail within 20 days.  Our warranty clearly reads that we do not cover pre-existing conditions.  If there is a failure in question, the service contract reads that we can request documentation from the client that the [redacted] was functional/operable at time the warranty was ordered. If a failure could have been identified by a simple mechanical test, which a [redacted] failure could be identified by then we would have to receive the supporting documentation that the [redacted] was in working order when the warranty went into effect.  I would like to request that [redacted] provide that.As a home warranty provider, we work with licensed, bonded vendors.   In order to ensure they are compliant with their license regulators, they must make the proper upgrades and codes improvements in order to ensure there are no problems with a [redacted] install.  Our vendors have been through strict screening procedures to ensure that they can legally offer the service/product required of them.  As stated in the service contract, our vendors must be used for service requests.  [redacted]'s [redacted] repair required several upgrades, which are not covered under the home warranty.  Unfortunately, there was no screening or assurances that the vendor [redacted] contracted to conduct his install was properly certified to do so.  We cannot reimburse for the use of an outside vendor unless we approve it prior, which we were not afforded the opportunity.  At this point, since the service contract was not followed, we cannot reimburse for [redacted]'s cost.  As an amicable resolution, we will offer [redacted] a full refund of any premiums paid including the service fee he paid to our vendor.  The total amount of refund would be $169.90.I have attached the service contract here for review.  Below are the sections that outline the coverage I cited above:Section E, clause 1Section F, clause 9Section C (Applying coverage)

As I stated, we read our contracts. This is an acceptable solution. Life is gray and if we complain about the bad we also have to mention the good. I like how Right Way responds to claims, I like the contractors they choose and despite the disagreement I also like the responsiveness to this complain. I also like that they seem to be a local business and that when you call them an actual human picks up the phone!Keep that because it is a good thing..  I will appreciated if you could send the check ASAP since we are really struggling without that oven!
