We thing the $100 we offered is equitable in the context of the $161.65 check that has already been provided and the savings the account experienced for almost 3 years.

difficulty finding your account because the name on the account is [redacted], apologies for any inconvenience caused.

account is leaving service with Verde at the end of the current billing
cycle on 10/6/14.  Verde has no cancellation fees of any type.  Although
you have cancelled your service with Verde as a good will gesture we
will send you a billing adjustment check for $256.49 to lower the
effective rate on your two most recent bills to the [redacted] rate of
$0.1145/KWH.  You will receive this check in approximately 2 weeks.

On May 27 we provided Jeff Tomlin with a copy of the enrollment verification and also issued a $108.45 billing adjustment check on 5/21/14.  All phone leads are scrubbed every 30 days against the Federal DNC registry so if the phone number in question was on the DNC list at that time it should have been blocked unless there was some type of processing issue.  The customer should be in receipt of our check at this time and we think this was a reasonable resolution.

I have looked up your account and see that you only have one account with us: [redacted], so I will be referring to that account only. If you can provide me with further information on the other account, I will be happy to look up that information as well. 
I see that your fixed rate expired on 10/1/14. At this time, Verde is not required to contact [redacted] customers when their rate is about to expire. When you enrolled with Verde, we stated and you agreed to a 6-month fixed rate of $0.0899/kwh. You actually received that rate for 8 billing cycles, two more billing cycles than was promised.
As a one-time courtesy, I have processed a $98.46 refund for the difference in rate to our new fixed rate on your most recent bill. I have also processed the $75 rebate that was available for you to take advantage of during the first 6-months of your enrollment. You should get these checks in the mail within 15 business days.
I have adjusted your account to our current fixed rate of $0.1149/kwh. That rate is FIXED for 6 months and is for 100% green energy, such as solar, wind, hydro, biomass, landfill gas and other renewable power sources. I am also having a new Terms of Service mailed to you. We still have no contract to sign and no cancellation fees. Please be sure to contact us before your expiration date to avoid switching back to the variable rate.

I am rejecting this response because:  their response is inadequate.  Their letter announcing the switch from "brown" to "green" energy prices is very deceptive.  Nowhere does it mention that the rate will most likely increase to almost double the [redacted] "price to compare".Also, I do not understand why Revdex.com continues to give Verde Energy an A+ rating, when even on your own website there are 24 negative reviews, one neutral and one positive?  Please see attached the letter I sent to Verde Energy.

Amy D[redacted]Hi Karen,I do not recall receiving the letter you attached, and how do you know I received it?  Did you get a certified read receipt?  This switch to renewable energy rates, and the expected increase in the supply portion of my electric service, is a material change in contract.  I did not expressly accept this change in your new Terms of Service.  You sent a letter, which I may or may not have received.   As I read the letter, it does not make clear that the renewable energy rates will most certainly increase, and in fact will almost double.  Instead, you imply rates will go down — “…if the market rate for electricity drops, your rate may also go down with it.”  Never once in the letter do you say the rate will be expected to increase to a rate almost double the [redacted] “rate to compare”.  Instead, you make a positive spin on the “go green” aspect, which is all great news until you notice your electric bill has increased on average $100/month.  This is very deceptive communication on your part.  I am still not happy with the $473.99 refund.  In reading other reviews on Revdex.com, it looks like many others customers have also been deceived.  I am prepared to escalate this further unless I receive the refund I asked for originally.   I would like a refund of the supply portion of each of my [redacted] bills equal to the difference between the “price to compare” and Verde Energy’s monthly variable rate on each of my monthly [redacted] bills from the time my fixed rate contract with you expired in August 2011.  I estimate this to be around $6,000. Amy DiNunzio

Complaint: 10462339I am rejecting this response because:
I received nothing ON PAPER stating the rate that I would be paying and nothing was stated verbally when signing up.  All I heard that they were going to "save me money".   This is what I believe to be a predatory tactic.  I spoke to the rep and gave her screenshots of my billing statements.  I was told about the rate at the time of my complaint.  This is why I believe that there should be no further billing.  I would be willing to return the $75 rebate as long as I am excused from everything else.Sincerely,[redacted]

Verde Energy provided customers with regular “brown” energy. In December of 2013, we mailed out a letter to all our NJ customers stating that we were no longer going to be offering regular “brown” energy, but were switching all of our customers to our “green energy” product. Within that mailing, we provided you with a new Terms of Service, which explained our new variable rate policies which did not include always being lower than your utility. (I have attached a copy of that letter which was mailed to you.)We have been informed by your utility company that your account will no longer utilize Verde Energy USA for the supply portion of your electric service. Your service will be returned to your utility on 3/11/2016. We have lowered your rate to our fixed offer of $0.1049 for any remaining billing cycles with us.We are processing a $473.99 refund for the difference in rate from your three highest bills while you were with Verde Energy. Verde Energy is not required to offer any refunds on the variable rate pricing and we do so only as a courtesy. I switched to Verde 2 years ago. They gave a fixed rate lower than [redacted]. They they converted me to a variable rate without telling me. They said the promotion was only 6 months. So Ok I asked to swith to a fixed rate. They did that. They did not tell me it was only for 6 months. Now I see...

thay they have had me on a variable rate for 5 months. This has cost on average $50 more than [redacted] rates. Now they say that they have no obligation of informing anyone in ** of rate increases. It takes at least 2 months to change providers. This practice is bait and switch.

Adjust my last 5 months and next 2 months bills to the flat rate.

As a one-time courtesy, I have processed a $58.32 refund for the difference in rate from the variable you were charged on your most recent bill, to the current fixed rate. You should get that check within 15 business days.
For your information, I am emailing you a voice recording of your enrollment with Verde Energy USA where we clearly state that your account is for a fixed period and at the end of that period it will automatically switch to a variable rate.

I have looked up your account and see that you originally enrolled the account with Verde Energy for a 4-month fixed rate of $0.1149/kwh. You received that rate for 4 billing cycles. After your fixed rate expired, per the Terms of Service mailed to your address, the account switched automatically to our VARIABLE rate. 
There was a call made in August of 2015 where you requested to be put on the new 6-month fixed rate of $0.0999/kwh. At that time, we also issued you a refund check for the difference in rate from your June/July bill ($32.90) as well as a check for $25 thanking you for remaining with Verde Energy. We also processed your $75 rebate. We adjusted your rate and you received the agreed upon .0999/kwh rate for 6 months. Per your Terms of Service, after the 6 months, your rate automatically switched to our VARIABLE rate at the time: $0.1899/kwh and continued on the variable rate. 
I see that your account has been scheduled for cancellation from Verde on 7/12/16. I have adjusted your rate to our current fixed rate of $0.0949/kwh for the final bill with Verde.
 
We are processing a $39.05 refund for the difference in rate from your highest billing. Verde Energy is not required to offer any refunds on the variable rate pricing and we do so only as a courtesy. You should receive the check in the mail within 10-15 business days.

Ms. Janiszewski was enrolled under a monthly variable rate offer which can change with market conditions.  Her initial rate with Verde Energy in March 2013 was $0.0854/KWH which was lower than with her prior supplier Rescom.
As a goodwill gesture, we are issuing a billing refund...

check totaling $61.84 which represents the difference between the rate charged on her last two bills with Verde versus the $0.0999/KWH she could have received if she switched to our 6 month fixed rate offer which is posted on our web site.  She will receive the check within 2 weeks.
This should resolve this inquiry
