I have reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond.
In her complaint Ms. [redacted] alleges that she was told that she was eligible for a special cancellation. Ms. [redacted] desires cancellation of her Agreement without penalty.
Vivint's records indicate that on September 23, 2015 Ms. [redacted] did call into Vivint to request cancellation and she was told that Vivint would submit her account for review for special cancellation. This was not a promise to cancel the account only a review process. Ms. [redacted]'s account was denied for special cancellation.
Nevertheless in an effort to assist Ms. [redacted], Vivint is willing to cancel her Agreement provided Vivint can remove the home security equipment from her home and Ms. [redacted] pays her past due balance of $142.03. If Ms. [redacted] desires to take advantage of this offer I would advise her to contact Vivint's [redacted] department at 1 [redacted] to schedule a technician to come remove the equipment.

I am accepting this response because I do not want to be tied to this company or hear about them every again. [redacted] I called and called this company for 3 months and no one ever called me back so I started speaking to whoever would pick up and explain the whole story to them and then still no call back. So I am accepting this because this is the only response I have received. [redacted] keep telling you that they will send a tech out to fix it but it only lasts a few days. [redacted]

Concern:I have reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond. In her complaint Ms. [redacted] states that she has never signed a System Purchase and Services Agreement (“Agreement’) with Vivint but she is receiving collection attempts for a Vivint account in her name. Ms. [redacted] desires her name to be removed from all collection action. Vivint’s records indicate that Ms. [redacted] entered into her Agreement on August 16, 2014. Agreement: July 18, 2014          To Whom It May Concern:I have reviewed the information provided by Mr. [redacted] and appreciate the opportunity to respond. In his complaint, Mr. [redacted] states that he was pressured into signing up with Vivint, that there were complications with the billing of his account, and that he experienced technical issues with the alarm system.  Mr. [redacted] states that he is now in collections, and he desires for Vivint to remove his account from collections and from his credit report.  Vivint’s records show that Mr. [redacted] signed a System Monitoring and Services Agreement on July 18, 2014, in which he represented that he understood and agreed to the initial term of sixty (60) months.  He also represented that he would pay a monthly monitoring fee of $69.99 each month, plus applicable taxes, during that term. Vivint provides a Right of Rescission period of ten (10) days following installation of the equipment, during which time Mr. [redacted] would have been able to cancel his services without penalty for any reason, such as feeling pressured at the time of sale.   Mr. [redacted] first contacted Vivint regarding his concerns on September 4, 2014, which was six weeks following the installation.  At that time, Vivint applied a credit of $75.00 to his account to assist with billing complications.  A Field Service Professional was dispatched to Mr. [redacted]’s home on November 3, 2014, to address concerns with the system. Vivint’s records indicate that the system was inspected and tested on that date, and equipment concerns were resolved.   Cancellation of Mr. [redacted]’s Agreement without penalty is not warranted at this time. Vivint has not received any payments pursuant to the Agreement due to invalid bank account information on file, which Mr. [redacted] did not correct.  Further, Mr. [redacted] has Vivint’s equipment in his home.  After 120 days of non-payment, Mr. [redacted]’s account was transferred to a third party collections agency, and has since been sold to Perfection Collections.  Mr. [redacted] must settle the balance of his debt with Perfection Collections at this time.If you have further questions or concerns regarding this response, please respond to either our mailing address: 4931 North 300 West, Provo, Utah 84604, or fax number: (801) 765-5759, attention Department 160 – Legal. Agreement: June 13, 2013          To Whom It May Concern:I have reviewed the information provided by Mr. [redacted] and appreciate the opportunity to respond. In his complaint, Mr. [redacted] states that he was sent to collections for the remaining balance of his Agreement with Vivint.  He further states that he had issues with the billing of his account and with the functionality of his system.  Mr. [redacted] desires for the balance of his Agreement to be reduced.  Vivint’s records show that, on April 30, 2015, Mr. [redacted] agreed to a resolution with Vivint after reporting these issues.  At that time, Vivint reduced his monthly service fee by 40% for the remaining term of his Agreement.  This reduction of the monthly rate also reduced his total payoff balance by 40%.  On June 29, 2016, Mr. [redacted]’s account was cancelled after 120 days of non-payment and was transferred to an outside collections agency.  Mr. [redacted] recently paid the collections agency the full balance of his debt, which was the reduced payoff of his Agreement with Vivint.Mr. [redacted]’s signed Agreement with Vivint states that it is his responsibility to pay his monthly service fee for the initial term of the Agreement (Section 2).  Vivint previously reduced Mr. [redacted]’s payoff balance and transferred the account to a third party.  No further reduction or refund is warranted at this time.If you have further questions or concerns regarding this response, please respond to either our mailing address: 4931 North 300 West, Provo, Utah 84604, or fax number: (801) 765-5759, attention Department 160 – Legal.     To Whom It May Concern:I have reviewed the information provided by Mr. [redacted] and appreciate the opportunity to respond. In his complaint, Mr. [redacted] states that his system was never installed properly and he is displeased with Vivint’s customer service.  He is requesting immediate cancellation without penalty, that Vivint repair any damages done to his walls, and that Vivint pay to have his previous alarm system reinstalled. At this time, Vivint is willing to immediate cancel the account. Any maintenance that needs to be done to Mr. [redacted]’s walls is his responsibility, as is the cost to reinstall another company. Vivint’s records show that on June 21, 2017, Mr. [redacted] signed a Purchase and Services Agreement with Vivint, with an initial term of sixty (60) months. By signing this contract, Mr. [redacted] represented that he understood and accepted all terms of the entire agreement, including that the system’s operation is not under warranty and that it is not Vivint’s responsibility to repair any damage done during installation. About a week after filing my complaint I received an e-mail from Vivant's legal department to deal with my request. I called this person the next day and together we were able to get a time set up to have the equipment removed. All equipment was removed that evening (Oct. 9th). On Oct. 14th ALL the money we had spent (installation fee plus 2 monthly payments) was deposited back to our account. I was also told that no more monthly payments would occur. These payments normally came out on the 14th of the month. Today is now the 16th and no further payments have been deducted.

Ms. [redacted] states that the required paperwork to remove Ms. [redacted] from the account was sent by Mr. [redacted]. However, this paperwork was never received from Mr. [redacted] and the account has remained in Ms. [redacted]’s name. Vivint records further indicate that Vivint representatives offered to allow Mr. [redacted] to take over the system and move it to his new home with the same equipment which existed in his previous location. Mr. [redacted] decided he wanted new, upgraded equipment such as cameras and home automation devices which he would need to purchase. Due to those additional costs Mr. [redacted] decided not to move forward with the takeover of Ms. [redacted]’s account.Ms. [redacted] remains responsible for the terms of the Agreement.  However, in an effort to resolve this matter, Vivint has offered a reduced payoff of the Agreement by 50%. Additionally, Vivint is willing to move Ms. [redacted]’s service to her current address without charging the standard $99 fee.  Ms. [redacted] may contact Vivint’s Customer Loyalty department at 1-800-[redacted] to accept either offer.[redacted]

I have reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond.
In her complaint, Ms. [redacted] states that she was misled by a Vivint representative regarding the term of her agreement and the fees for service, and that she requested cancellation ten (10) days after installation of her system. Ms. [redacted] further alleges that she has had complications with some of the installed equipment and has still been charged for using it. Ms. [redacted] desires cancellation of her Agreement and removal of Vivint's equipment from her home.
Vivint's records indicate that prior to the installation of any equipment, Ms. [redacted] completed a telephonic Pre-Installation Survey with Vivint's Account Creation department. Every customer must complete this Pre-Installation Survey, and if a customer does not pass the survey, Vivint will not enter into an agreement with the customer and will not install any equipment in the customer's home. The purpose of the survey is to verify certain information, ensure that the customer understands Vivint's offer, and confirm the terms and conditions of the Agreement. Our records show that Ms. [redacted] completed the required Pre-Installation Survey on June 3, 2015.
During the recorded Pre-Installation Survey, Ms. [redacted] represented that she understood and agreed to the initial term of sixty (60) months. She also represented that she would pay a monthly monitoring fee of $79.99 each month during that term. Further, Ms. [redacted] represented that these terms were clearly outlined on the Agreement and that Vivint's representative did not make any promises or commitments which were not written on the Agreement. Vivint relied on Ms. [redacted]'s representations to ensure that she understood her commitments to Vivint as outlined in the Agreement.
Vivint has no record of Ms. [redacted] requesting cancellation of her Agreement shortly after installation. Ms. [redacted] has reported her equipment issues, and a Field Service Professional was dispatched to her home on November 16, 2015 to address these issues. Ms. [redacted] has not paid for service since this visit and her account is past due in the amount of $404.19. To assist Ms. [redacted], Vivint is willing to waive the past due balance and reduce her monthly monitoring rate by $15.00 so that she will no longer be charged for the door lock, doorbell camera, or garage door opener that have not functioned well for her. Cancellation of the Agreement, however, is not warranted at this time.

When vivint's representative came to offer the the promotional service it is true that Jason K[redacted] ask me to speak to someone on phone to verify my address and other personal information and when I signed d contract Jason K[redacted] clearly stated that there is a 15days promotional offer that we can cancel it anytime within that period and that when I told him I will not sign any 5years contract as it is too long he pointed what he wrote as 2yrs contract, and when I called him 10days later to cancel the contract he clearly told me that he will tear and garbage the copy of contract I originally signed on June 3, 2015 ( a week before my wedding day) and agreed with our verbal agreement and never told me to write vivint as he already agreed in fact vivint told me they cant find that copy and cant find my info in their system sometime in October when I called them to uninstalled their equipment specially their door lock was always frozen everytime the temperature in Regina drops so low and when I asked them to send me that copy of contract they emailed me instead a copy of contract dated August 10, 2015 with my falsified signature so I called them again and told them that the copy they emailed me is not the contract I signed but a falsified one. I cannot rely to this company and dont want their service anymore.

She states that she attempted to cancel her service shortly after installation through her sales representative, and then later by calling Vivint.
A representative has recently contacted Ms. [redacted] in an effort to resolve this matter. After review of the documentation provided by Ms. [redacted], Vivint has agreed to cancel her account following retrieval of its equipment from her home. An appointment has been scheduled for this removal, and a refund of the activation fee is being sent to Ms. [redacted]. Ms. [redacted] may contact Vivint's representative directly with any further questions or concerns.

[redacted] Today vivint finally concede and cancelled my contract w ith them and promised to refund the installation fee by sending a cheque once their representative collects all their equipment.
Vivint's representative just collected all their equipments today and call their office to verify retrieval and reported as bad because according to him it is already used even though it is still in good condition and told me it wont make any difference to me.

Concern:I have reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond. In her complaint Ms. [redacted] explains that she was told by the sales representative that she had an extended period to cancel the account without penalty. But she is having issues canceling her account. Ms. [redacted] requests that her account be canceled.A representative from Vivint has recently attempted to contact Ms. [redacted] in an effort to resolve her concerns. Vivint does not have any records of any promises made by the sale representative other than what is on the contract. In an effort to help Ms. [redacted] and to resolve this issue. Vivint can cancel the account without any additional charges, if Ms. [redacted] will allow a Vivint technician to come to her home to remove the equipment from her home. Concern: I have reviewed the information provided by Mr. [redacted] and appreciate the opportunity to respond. In Mr. [redacted]’ complaint he explains that he has been told that he would be getting a refund for canceling his upgrade but he still has not yet received it. reviewed the information provided by Mr. [redacted] and appreciate the opportunity to respond. In Mr. [redacted]’s complaint he explains that he had issues with the installation that caused some damage to his home. Mr. [redacted] desires $600.A representative from Vivint has recently contacted Mr. [redacted] in an effort to resolve his concerns. Vivint’s records show that Mr. [redacted] provided a quote for repairs on his home that totaled $450. Vivint will give Mr. [redacted] $450 for the damage done to his home, but no other monies are warranted.
