In an effort to help Mr. [redacted]. Vivint can cancel the account without any additional charges, if Mr. [redacted] will allow a Vivint technician to come to his home to remove the equipment. After the technician has removed the equipment the account and contract will be canceled. As such, Mr. [redacted] requests a refund for all monies pail while the account was not in his name.A representative from Vivint has recently attempted to contact Mr. [redacted] via email in an effort to resolve his concerns. Vivint’s records indicate that this matter has been resolved to Mr. [redacted]’s satisfaction. A refund check was sent to Mr. [redacted]’s new address and Vivint records show that it was cashed successfully. 2013 To Whom It May Concern: I have reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond. In her complaint, Ms. [redacted] alleges Vivint is holding her to a contract that is expired. Ms. [redacted] desires the cancellation of her account without penalty. Vivint’s records show that on July 10, 2009, Ms. [redacted] signed a Purchase and Services Agreement with Vivint, with an initial term of thirty-nine (39) months. As such, the initial term of the agreement would have lapsed on November 10, 2012 and continued from month to month.  However, Vivint spoke with Ms. [redacted] regarding her alarm service on December 7, 2012. Ms. [redacted] represented that she was satisfied with Vivint’s services and that she was interested in extending the term of her agreement.  Based upon this representation, Vivint offered a twenty-four (24) month extension to which Ms. [redacted] agreed. Indeed, Vivint read the following statement, after which Ms. [redacted] responded affirmatively: You understand that this call is being recorded, and you agree to extend the term of your agreement forty-two months from today.  No other provisions of your agreement have been changed and this amendment constitutes the new agreement between you and Vivint. Ms. [redacted] signed the extension on January 12, 2013; this is the date the renewal became active. Ms. [redacted]’ account after January 12, 2015 once again reverted to a month to month agreement. Ms. [redacted] could request cancellation of the account at any time as long as she provided a written notice of cancellation 30 day prior to her desired cancellation date (Section 2.4). Vivint has agreed to make an exception to this rule, and has agreed to cancel Ms. [redacted]’ account. Concern: I have reviewed the information provided by Mr. [redacted] and appreciate the opportunity to respond. In Mr. [redacted]’s complaint he explains that he moved from his home due to his job and that he canceled his account with Vivint but was told that there was a charge on the account of $334.00 that went to credit reporting agencies. As such, Mr. [redacted] requests a refund of $334.00 and the negative credit entry removed.A representative from Vivint has recently attempted to contact Mr. [redacted] via email in an effort to resolve his concerns. Vivint does not have any record of Mr. [redacted] moving in May of 2016 or of a Notice of Cancelation. Vivint’s records do indicate that Mr. [redacted]’s account was cancelled and sent to collections due to a lack of payment. Due to these facts a refund of the full $334.00 is not warranted. However, in an effort to assist Mr. [redacted] Vivint is willing to issue a refund of $100.00 and Vivint is having the negative credit entry removed. I am rejecting this response because: This is an unacceptable response from Vivint.  My contract included a doorbell camera and Premium Service so all the equipment would be serviced.  My doorbell is always disconnected and broken.  It has been replaced at least 4 times and never works.  Vivint has not held up their end of the contract to provide the service that I signed up for. I would be ashamed to operate a business the way that Vivint has and how they have treated me on this issue.  All I want is for my service to work the way it is supposed to.  That is why I paid extra for the Premium Service.  Vivint's answer is to downgrade the system to something I don't want.  They also offer that I can pay $1189.83 buyout fee.  Apparently this is at a 50% discount.  Why would I have to pay a fee to get out of a contract that Vivint cannot meet the terms of? A Vivent representative that I spoke to on the phone told me that there are some homes that the doorbell camera just doesn't work in.  I am pretty sure my home is one of those homes.  Vivint knows that the doorbell camera is a poor piece of equipment and they are trying to make me pay a buyout fee because they cannot meet their obligation to the contract I signed.  I want Vivint to cancel the contract without trying to charge me fee's.  Vivint has not provided the service I signed up for.

reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond. In her complaint, Ms. [redacted] alleges that she was never informed her system was out of date, and Vivint never follow through with an upgraded panel. Ms. [redacted] desires the cancellation of her account and refund of her final payment. Vivint records indicate Ms. [redacted] signed a Purchase and Services on July 18, 2009. Ms. [redacted] agreed to an initial term of thirty-eight (38) months and she agreed to pay her monthly service fee of $[redacted]. In the section of the Agreement labeled as Customer Duties, it states that it is the customer’s responsibility to test the system at least monthly to insure the system is functioning properly. Vivint also made steps to inform its customers by mail or email anytime a piece of equipment was out of date.  After further review, Vivint has agreed to cancel Ms. [redacted]’s account without penalty and refund Ms. [redacted] her final month’s payment. reviewed the information provided by Mr. [redacted] and appreciate the opportunity to respond. In his complaint, Mr. [redacted] alleges that he has had equipment complications that Vivint has been unable to resolve. Mr. [redacted] desires cancellation of his Vivint agreement without penalty.  Vivint’s records indicate that Mr. [redacted] first notified Vivint of his equipment concerns on July 13, 2015.  Vivint has scheduled two (2) service visits with Mr. [redacted], and it has been determined that Mr. [redacted]’s internet upload speed is not sufficient to support all of the camera devices installed at his home.  Mr. [redacted] signed a Purchase and Services Agreement and also participated in a telephonic Pre-Installation Survey upon installation of his Vivint system, in which he represented that he understood and agreed to the initial term of sixty (60) months.  He also represented that he would pay a monthly monitoring fee of $[redacted] each month, plus applicable taxes, during that term.  By signing this Agreement, Mr. [redacted] agreed that he is responsible for providing proper internet service that may be required for devices installed in his home (Section 12).  Cancellation of the Agreement without penalty is not warranted at this time.At this time, Mr. [redacted]’s account is past due in the amount of $[redacted].  In an effort to assist Mr. [redacted], Vivint will waive that balance and bring the account current.  Vivint would like to ensure that Mr. [redacted] is able to utilize his system as intended. Mr. [redacted] may contact his internet provider to increase his upload speed and improve the functionality of his installed equipment. Alternately, Vivint is willing to send a field service professional to Mr. [redacted]’s home at no charge, to downgrade the package and remove any equipment that is not able to be used. This downgrade would reduce Mr. [redacted]’s monthly monitoring rate accordingly. reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond. In her complaint Ms. [redacted] states that she was not informed of the three day right of rescission period. Further, that the alarm system is difficult to operate and that she has been experiencing equipment malfunctions. Ms. [redacted] desires her System Purchase and Services Agreement (“Agreement”) cancelled without penalty. Vivint agrees to upgrade Ms. [redacted]’s account to Premium Service which will provide her with free technician visits for when any repairs of the system or instruction on its operation is needed. Vivint’s records indicate that Ms. [redacted] entered into her Agreement on October 17, 2016. By signing her Agreement Ms. [redacted] agreed to section 4.5 which states, “You may cancel this Agreement at any time prior to midnight of the third business day after the date of this transaction.”Vivint’s records further indicate that prior to the installation of any equipment, Ms. [redacted] completed a telephonic Pre-Installation survey with Vivint’s Account Creation department. Every customer must complete this Pre-Installation survey, and if a customer does not pass the survey, Vivint will not enter into an Agreement with the customer and will not install any equipment in the customer’s home. The purpose of the survey is to verify certain information, ensure that the customer understands Vivint’s offer, and confirm that terms and conditions of the Agreement. Our records show that Ms. [redacted] completed the required Pre-Installation survey on October 13, 2016.During the recorded Pre-Installation survey, Ms. [redacted] represented that she understood and agreed to this initial term of forty-two (42) months. She also represented that she would pay a monthly monitoring fee of $44.99 plus any applicable taxes each month during that term. Vivint relied on Ms. [redacted]’s representations to ensure that she understood her commitments to Vivint as outlined in the Agreement. Due to Ms. [redacted]’s representations and the terms of her Agreement cancellation without penalty is not warranted. Ms. [redacted] believe the initial term of the Agreement was for 3 years, however when she recently called into Vivint she was informed the Agreement was for 5 years.  Ms. [redacted] desires for her account to be closed without penalty. Vivint’s records indicate that prior to the installation of any equipment; Ms. [redacted] signed a System Purchases and Services Agreement. By signing the Agreement Ms. [redacted] represented that she understood and agreed to the initial term of sixty (60) months.  She also represented that she would pay a monthly monitoring fee of $59.99 each month during that term. Vivint relied on Ms. [redacted]’s representations to ensure that she understood her commitments to Vivint as outlined in the Agreement. After installation, Vivint provides its customers a 3 day Right of Rescission period. During this if they are unhappy with any aspect of the equipment or Agreement; Vivint will close the account without penalty after given proper notice (Section 4. 4). Vivint receive no such request from Ms. [redacted] within the allotted time therefore the full term of the Agreement applies. Vivint has included a copy of Ms. [redacted]’s Agreement with their response.  Vivint has been providing security services to Ms. [redacted] since the time of installation, on April 15, 2015. Cancellation of the account is not warranted. Should Ms. [redacted] wish to cancel her Vivint agreement prematurely, she may pay off the remaining balance on her account – currently $2,579.55, however Vivint will take 55% off the payoff amount, bringing it to $1,160.80. Mr. [redacted] desires cancellation of his agreement without penalty, and for Vivint to reimburse him the value of the stolen property.   Vivint’s records indicate that Mr. [redacted] notified Vivint of this break-in, and that Vivint’s Alarm Events department has opened a case for review. Mr. [redacted] desires a refund of the $46.99 he paid to Vivint in October after requesting cancellation, and for his account to be cancelled. At this time, Vivint has cancelled Mr. [redacted]’s account, and he has no further obligation to Vivint.  In an effort to assist Mr. [redacted], a refund of October’s payment in the amount of $46.99 is being sent back to the credit card on file. Vivint’s records show that Mr. [redacted] signed an agreement on August 1, 2013, in which he agreed that service would continue month to month after the initial term of forty-two (42) months, unless cancelled in writing no less than 30 days before the next renewal term (Vivint Purchase and Services Agreement, Section 2.4).  A written notice of cancellation was provided by Mr. [redacted] on October 4, 2017, and his account had already been invoiced for the last month of service on October 1, 2017.  Despite this information, Vivint agrees to the above resolution.  Mr. [redacted] will not be charged further and may expect the refund back in his bank account in 7-10 days.If you have further questions or concerns regarding this response, please respond to either our mailing address: 4931 North 300 West, Provo, Utah 84604, or fax number: (801) 765-5759, attention Department 160 – Legal.
