Concern:I have reviewed the information provided by Mr. [redacted] and appreciate the opportunity to respond.In his complaint Mr. [redacted] states that after his master panel was relocated to facilitate the connectivity of his security cameras a hole was left in his wall. Mr. [redacted] desires repair of the damage on his wall. Mr. [redacted] is a customer of Vivint Louisiana, LLC, and not Vivint, Inc.  Vivint Louisiana’s records indicate that a technician was able to patch the hole in Mr. [redacted]’s wall. However, Mr. [redacted] also has some pin sized holes in the same area, and Vivint Louisiana is willing to patch those. Vivint Louisiana has also added a $30 credit to Mr. [redacted]’s account to cover the cost of any paint that may be needed after the patching of the holes. 2008        Date of Addendum: April 26, 2013          To Whom It May Concern:I have reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond. In her complaint, Ms. [redacted] states that she requested cancellation of her account after her initial term had expired, and that Vivint continues to bill her for service. Ms. [redacted] desires a refund of the monies she has paid to Vivint since the end of her contract term, and for her account to be cancelled. At this time, Vivint agrees to cancel Ms. [redacted]’s System Purchase and Services Agreement (“Agreement”), effective immediately.  In an effort to assist Ms. [redacted], a refund of October’s payment, in the amount of $47.69, is being sent back to the credit card on file.Vivint’s records show that Ms. [redacted] signed an Agreement with Vivint on August 1, 2008, in which she agreed that service would continue year to year after the initial term of sixty (60) months, unless cancelled in writing no later than 30 days before the next renewal term (Section 2.4).  Further, Ms. [redacted] spoke with a Vivint representative on April 26, 2013 and agreed to extend the term of her Agreement for forty-two (42) months.  Ms. [redacted] contacted Vivint about cancelling the Agreement, and she was advised that the end of her term is October 26, 2016 and that she would need to send a written notice of cancellation.  Vivint did not receive a written notice, and as such Ms. [redacted]’s account was invoiced for service on the usual billing cycle date of October 20, 2016. Despite this information, Vivint agrees to the above resolution.  This complaint will be considered Ms. [redacted]’s written notice of cancellation, and the payment made in October will be refunded.  Ms. [redacted] has no further obligation to Vivint.If you have further questions or concerns regarding this response, please respond to either our mailing address: 4931 North 300 West, Provo, Utah 84604, or fax number: (801) 765-5759, attention Department 160 – Legal. provided by Mr. [redacted] and appreciate the opportunity to respond. In his complaint, Mr. [redacted] states Vivint sales representative sold them on a system where he could cancel in the event of moving. Mr. [redacted] is now moving but when he called to cancel, he was informed he would still be responsible for the service. Mr. [redacted] desires cancellation of his agreement without penalty.  A representative from Vivint has recently attempted to contact Mr. [redacted] in an effort to resolve his concerns. Vivint’s records do not indicate the offer of cancellation upon moving was promised at the time of install. However, Vivint’s records indicate Mr. [redacted] notified Vivint was moving out of the country. Vivint does provide its customers with an early cancellation option if the customer moves out of Vivint’s serviceable area. Vivint has requested Mr. [redacted] provide documentation as proof of his moving to another country, but Vivint has yet to receive this documentation. At this time, Vivint is awaiting documentation from Mr. [redacted], to proceed in reviewing the account for possible cancellation. If Mr. [redacted] will provide Vivint with either a lease agreement, utility bill, or two pieces of addressed to Mr. [redacted] from the new location, his request for cancellation will be further reviewed. Hello, Vivint recently received a complaint under Ms. [redacted] complaint ID # [redacted] . Ms. [redacted] is a non-customer, but Vivint did reach out to her and explained that if she wanted to remove the system from her home she could do so. Ms. [redacted] rejected this response requesting Vivint provide her with a code to disarm the panel. As this compromises the security of Vivint’s panels, this is something we are unable to provide. Unfortunately, given Ms. [redacted] is not a Vivint customer, we are unable to assist her further.
