2009 To Whom It May Concern:I have reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond. In her complaint, Ms. [redacted] states that she has paid her bill every month, but Vivint is saying that she missed a month and she is being forced to pay for a month twice. Ms. [redacted] desires a refund and an apology. Vivint apologizes for any misunderstanding regarding Ms. [redacted]’s monthly invoices. Vivint’s records show that a credit for one month of service was applied to Ms. [redacted]’s account to resolve this matter on February 25, 2018. This credit covered February’s service fee.Vivint confirms that Ms. [redacted] paid her service fee each month until February (which the credit covered). The payments were generally sent at the first part of each month, but in December the payment was not processed until December 15th, and in January the payment was not processed until January 29th. For this reason, the invoices sent to Ms. [redacted] those months may have been printed and sent before the payment was made. Vivint sends Ms. [redacted] her statement each month on the 15th.Ms. [redacted] has recently made her payment for March, and her Vivint billing account has a zero balance and will be invoiced for the next month on March 15th. In his complaint, he alleges that a particular sensor has not been communicating with Vivint’s system for an unknown period of time. Mr. [redacted] is requesting cancellation of his service and a refund. On February 2, 2016, Mr. [redacted] called Vivint to express his concern about one of his sensors that was not communicating properly. This is the first time that Mr. [redacted] notified Vivint of this issue. Typically, if the system is experiencing this type of malfunction, the customer will get a call or notification on the panel that will inform them of the problem. Vivint apologizes that Mr. [redacted] was never made aware of this issue. A representative from Vivint has recently attempted to contact Mr. [redacted] via phone and email. Vivint has agreed to cancel Mr. [redacted]’s account and has issued a refund that covers 4 months of service ($[redacted]). reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond. In her complaint, Ms. [redacted] alleges she has been experiencing technical concerns that have yet to be resolved by Vivint. Ms. [redacted] desires the cancellation of the account without penalty. Vivint’s records indicate that prior to the installation of any equipment; Ms. [redacted] completed a telephonic Pre-Installation Survey with Vivint’s Account Creation department. Every customer must complete this Pre-Installation Survey, and if a customer does not pass the survey, Vivint will not enter into an agreement with the customer and will not install any equipment in the customer’s home. The purpose of the survey is to verify certain information, ensure that the customer understands Vivint’s offer, and confirm the terms and conditions of the Agreement. Our records show that Ms. [redacted] completed the required Pre-Installation Survey on May 21, 2013. During the recorded Pre-Installation Survey, Ms. [redacted] represented that she understood and agreed to the initial term of sixty (60) months. She also represented that she would pay a monthly monitoring fee of $[redacted] each month during that term. Further, Ms. [redacted] represented that these terms were clearly outlined on the Agreement and that Vivint’s representative did not make any promises or commitments which were not written on the Agreement. Vivint relied on Ms. [redacted]’s representations to ensure that she understood her commitments to Vivint as outlined in the Agreement. Ms. [redacted] notified Vivint of her concern with her door locks on May 19, 2015, and an appointment was scheduled for June 3, 2015. On June 3, 2015, the Vivint field service professional noted he could not find anything wrong with the door lock. On November 5, 2015, Ms. [redacted] called Vivint and reported another issue with her door locks. The assigned Vivint field service professional did not have a required piece of equipment and would need to order this piece and return at a later date. On December 15, 2015, Ms. [redacted] contact Vivint stating she had not heard back from the field service professional after he ordered the piece of equipment. An appointment was scheduled for January 2, 2016, and Ms. [redacted] was given a goodwill credit of $[redacted]. Vivint’s records indicate that the assigned field service professional was sick, and was unable to fulfil the appointment. Ms. [redacted] has an appointment for January 15, 2016 to resolve her concerns. Cancellation without penalty is not warranted at this time. Should Ms. [redacted] wish to cancel her Vivint agreement prematurely, she may pay off the remaining balance on her account – currently $[redacted], however Vivint will take 55% off the payoff amount, bringing it to $[redacted]. Alternatively, should Ms. [redacted] wish to continue services, Vivint is to apply a credit of $[redacted]; a total of three months of Ms. [redacted]’s service fee. In his complaint, Mr. [redacted] states that he has been experiencing equipment complications with his security system that have not been resolved. Mr. [redacted] further states that he has experienced long wait times while calling into Vivint’s Customer Care. Mr. [redacted] desires cancellation of his Vivint agreement without penalty. Vivint’s records indicate that prior to the installation of any equipment; Mr. [redacted] completed a telephonic Pre-Installation Survey with Vivint’s Account Creation department. Every customer must complete this Pre-Installation Survey, and if a customer does not pass the survey, Vivint will not enter into an agreement with the customer and will not install any equipment in the customer’s home. The purpose of the survey is to verify certain information, ensure that the customer understands Vivint’s offer, and confirm the terms and conditions of the Agreement. Our records show that Mr. [redacted] completed the required Pre-Installation Survey on April 25, 2015. During the recorded Pre-Installation Survey, Mr. [redacted] represented that he understood and agreed to the initial term of forty-two (42) months. He also represented that he would pay a monthly monitoring fee of $74.99 each month during that term. Further, Mr. [redacted] represented that these terms were clearly outlined on the Agreement and that Vivint’s representative did not make any promises or commitments which were not written on the Agreement. Vivint relied on Mr. [redacted]’s representations to ensure that he understood his commitments to Vivint as outlined in the Agreement. Further, Vivint provides a Right of Rescission period immediately following installation of the equipment, during which time Mr. [redacted] would have been able to contact Customer Care to address any concerns from the Pre-Installation Survey and cancel services. Cancellation of Mr. [redacted]’s agreement without penalty is not warranted at this time. Vivint’s records show that Mr. [redacted] first notified Vivint of his equipment concerns on April 26, 2015, and Vivint’s Scheduling department found an appointment for April 30, 2015; however, Mr. [redacted] called into reschedule. Mr. [redacted] again called Vivint on May 14, 2015, and an appointment was scheduled for May 16, 2015. Mr. [redacted] further notified Vivint of his equipment concerns on May 25, 2015, and Vivint’s Scheduling department found an appointment for May 29, 2015. Vivint was not notified of any further equipment issues until recently. A Vivint Field Service Professional was scheduled for an appointment on June 2, 2017; however, Mr. [redacted] called into cancel.Vivint would like to ensure that Mr. [redacted] is able to utilize his system as intended, and will send a field service professional to his home at no charge. Alternately, Mr. [redacted] has been offered a reduced monthly rate by $10.00 for the remainder of his initial term. Should Mr. [redacted] wishes to take advantage of either of these offers, I would advise him to call Customer Care at 1-800-216-5232, and schedule this appointment. In her complaint, Ms. [redacted] states that Vivint created a 5-year contract without her consent and will not provide a copy of the contract to her. She further states that Vivint’s representative advised that she could cancel service after a year, and that Vivint never installed a thermostat but refused to refund her for it. Ms. [redacted] desires cancellation of her Agreement without penalty. At this time, to assist Ms. [redacted] Vivint has reduced her monthly services fee by 40% for the remainder of the initial term. This will also reduce the payoff balance of her Agreement by 40% should she wish to cancel prematurely.A copy of Ms. [redacted]’s signed Agreement is being provided with this response. Vivint’s records indicate that prior to the installation of any equipment, Ms. [redacted] completed a telephonic Pre-Installation Survey with Vivint’s Account Creation department. She represented that she had received a copy of the Agreement and understood her right to cancel as explained on the Agreement. Vivint relied on Ms. [redacted]’s representations to ensure that she understood her commitments to Vivint as outlined in the Agreement. Vivint was not previously notified of any missing equipment from the time of installation. However, it should be noted that Ms. [redacted] has not been paying for the thermostat function with her system. Rather than the $80.99 agreed upon at the time of installation, she has only been charged $75.99 each month (plus any applicable taxes). Cancellation of Ms. [redacted]’s agreement without penalty is not warranted at this time; however, her monthly services fee has been reduced to $45.59, plus any applicable taxes, for the remaining term of the Agreement. This resolution was meant to give Mr. [redacted] the benefit of the doubt in his claim, not to hide any actions. Vivint maintains its position that Mr. [redacted] was using the services and was aware of the Agreement terms as he represented during his telephonic pre-installation survey with a Vivint representative. Vivint also has a signed electronic Agreement, but because Mr. [redacted] denies that he signed it, and because Vivint cannot know with certainty what happened at the time of sale, Vivint agrees to void the Agreement. Mr. [redacted]’s complaint and fraud claim have been passed on to sales management, and any investigation and discipline will be handled by the appropriate management. Vivint is also willing to refund Mr. [redacted] what he paid for his equipment, if he returns the equipment to Vivint. I am rejecting this response because:One again, very little that was provided by Vivint is true. I have decided they equate to our Government- all lies and unable to reason with them. I AM TOTALLY DISSATISFIED WITH THIS SITUATION. SO,1. Once I return from my trip and endure another missed service appointment on 29 July 2015, I will continue to fight this.2. I am placing the Vivint sign on top of another sign that reads-" Don't use these thieves- their product doesn't work" and I am placing it at the entrance to my business. 3. I am discussing a lawsuit with my attorney.4. I want call log copies- from Vivint of the dozens of times I have called in for false alarms. A point that I have repeatedly made, and their representative ignores.

Ms. [redacted] desires her mother’s account to be cancelled without penalty. Vivint’s records indicate that Ms. [redacted]’s mothers account was denied for special cancellation, since she did not move into a nursing home and was not diagnosed with a debilitating illness that would make the system a burden. Nevertheless in an effort to assist, Vivint is willing to cancel Ms. [redacted]’s mothers account without penalty. Vivint will need to verify with her mother verbally that cancellation is what she desires since she is the account holder. Vivint’s records show that a technician was dispatched to Ms. [redacted]’s home on January 25, 2017 and that her door lock was repaired at that time. Ms. [redacted]’s Agreement and service were cancelled on February 19, 2017. She will not be contacted further by Vivint. At this time, Vivint will also send a check in the amount of $65.26 to Ms. [redacted], to refund the last monthly charge of February 15, 2017 (invoiced before the account was cancelled).Vivint’s records further show that Ms. [redacted] signed an Agreement on February 20, 2013, in which she agreed that service would continue month to month after the initial term of forty-two (42) months, unless cancelled in writing no later than 30 days before the next renewal term (Vivint Purchase and Services Agreement, Section 2.4). A written notice of cancellation was provided by Ms. [redacted] on January 20, 2017, and her account was invoiced for the $49.00 trip fee (for the service visit) and the last monthly services fee in February 2017. Pursuant to the 30-day notice, Ms. [redacted]’s service was cancelled on February 19, 2017.Vivint apologizes for any hardship or inconvenience that Ms. [redacted] may have experienced during this cancellation process.
