Complaint: [redacted]
I am rejecting this response because:  I signed an ipad type computer under the misguidance that there was a 30 day period to end services.  THREE days was never said or spoken and I did not read anything due to the computer font was really small and again I was misguided to believe that there was a 30 day grace period, we have NEVER heard of nor conducted business with anyone who only offers 3 days to retract a contract. We are very disappointed as we have NOTHING to gain by lying about what we were told from the beginning and your records should indicate that the system has not been used since January due to all the problems we had initially and failure of your company to show grace upon a 100% disabled veteran and his family.  A month of free service for a system we do not even use is an insult as we only want to terminate a service that was never worth starting.  If we are ever asked by anyone about our experience with Vivint it will not be positive.  With disappointment and sorrow,[redacted](PLEASE note that in our honesty we even updated credit card information so that we can continue to pay out and be billed for YOUR service that we do not use.  We could only hope that such integrity would be shown by your company for our family too.)
Sincerely,
[redacted]

2009        To Whom It May Concern:I have reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond. In her complaint, Ms. [redacted] states that she has paid her bill every month, but Vivint is saying that she missed a month and she is being forced to pay for a month twice.  Ms. [redacted] desires a refund and an apology.  Vivint apologizes for any misunderstanding regarding Ms. [redacted]’s monthly invoices.  Vivint’s records show that a credit for one month of service was applied to Ms. [redacted]’s account to resolve this matter on February 25, 2018.  This credit covered February’s service fee.Vivint confirms that Ms. [redacted] paid her service fee each month until February (which the credit covered).  The payments were generally sent at the first part of each month, but in December the payment was not processed until December 15th, and in January the payment was not processed until January 29th.  For this reason, the invoices sent to Ms. [redacted] those months may have been printed and sent before the payment was made.  Vivint sends Ms. [redacted] her statement each month on the 15th.Ms. [redacted] has recently made her payment for March, and her Vivint billing account has a zero balance and will be invoiced for the next month on March 15th.  If you have further questions or concerns regarding this response, please respond to either our mailing address: 4931 North 300 West, Provo, Utah 84604, or fax number: (801) 765-5759, attention Department 160 – Legal. Ms. [redacted] and appreciate the opportunity to respond. In her complaint, Ms. [redacted] states that she signed paperwork guaranteeing that no initial fee would be charged.             Vivint Account #: [redacted]              Date of Agreement: July 4, 2008                                                              To Whom It May Concern: I have reviewed the information provided by Mr. [redacted] and appreciate the opportunity to respond. In his complaint, he alleges that a particular sensor has not been communicating with Vivint’s system for an unknown period of time. Mr. [redacted] is requesting cancellation of his service and a refund. On February 2, 2016, Mr. [redacted] called Vivint to express his concern about one of his sensors that was not communicating properly. This is the first time that Mr. [redacted] notified Vivint of this issue. Typically, if the system is experiencing this type of malfunction, the customer will get a call or notification on the panel that will inform them of the problem. Vivint apologizes that Mr. [redacted] was never made aware of this issue. A representative from Vivint has recently attempted to contact Mr. [redacted] via phone and email. reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond. In her complaint, Ms. [redacted] alleges that she requested cancellation of the account due to equipment concerns, but Vivint will not cancel the account. Ms. [redacted] desires the cancellation of the account without penalty.    Vivint’s records indicate that prior to the installation of any equipment; Ms. [redacted] completed a telephonic Pre-Installation Survey with Vivint’s Account Creation department. Every customer must complete this Pre-Installation Survey, and if a customer does not pass the survey, Vivint will not enter into an agreement with the customer and will not install any equipment in the customer’s home. The purpose of the survey is to verify certain information, ensure that the customer understands Vivint’s offer, and confirm the terms and conditions of the Agreement. Our records show that Ms. [redacted] completed the required Pre-Installation Survey on September 2, 2015. During the recorded Pre-Installation Survey, Ms. [redacted] represented that she understood and agreed to the initial term of forty-two (42) months. She also represented that she would pay a monthly monitoring fee of $[redacted] each month during that term. Further, Ms. [redacted] represented that these terms were clearly outlined on the Agreement and that Vivint’s representative did not make any promises or commitments which were not written on the Agreement. Vivint relied on Ms. [redacted]’s representations to ensure that she understood her commitments to Vivint as outlined in the Agreement. In section 4 it states, “You may cancel this agreement at any time prior to midnight of the third business day after the date of this transaction.” Vivint did not receive a request to cancel Ms. [redacted]’s account within these three business days.Ms. [redacted] notified Vivint of an issue with her doorbell camera on September 18, 2015. Vivint scheduled an appointment for October 19, 2015. When the service technician arrived at Ms. [redacted]’s home for the appointment, no was home. Cancellation is not warranted at this time. Should Ms. [redacted] wish to cancel her Vivint agreement prematurely, she may pay off the remaining balance on her account – currently $[redacted], however Vivint will take 25% off the payoff amount, bringing it to $[redacted]. Alternatively, should Ms. [redacted] wish to continue services, Vivint is willing to schedule a service appointment for free. If Ms. [redacted] wishes to take advantage of either offer, I would advise her to contact Vivint’s Customer Loyalty department at ###-###-####. If you have further questions or concerns regarding this response, please respond to either our mailing address: 4931 North 300 West, Provo, Utah 84604, or fax number: ###-###-####, attention Department 160 – Legal. Concern: I have reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond. In Ms. [redacted]’s complaint she explains that she has experienced some confusion regarding her monthly bill and how long her contract is. Ms. [redacted] requests that her monthly bill be decreased and from $68.99 to $28.99 and her contract length lowered. A representative from Vivint has recently attempted to contact Ms. [redacted] via email in an effort to resolve her concerns. Vivint’s records indicate that Ms. [redacted]’s original contract was for 42 months with a monthly payment of $68.99. When Ms. [redacted] extended the contract Vivint offered to put some credits on Ms. [redacted]’s account for a number of months. When those months were over the monthly payment went back to the original amount. In an effort to assist Ms. [redacted] Vivint has removed 12 months off of the contract term. Ms. [redacted] may contact the Vivint representative who reached out to her directly if she has any questions or concerns.   If you have further questions or concerns regarding this response, please respond to either our mailing address: 4931 North 300 West, Provo, Utah 84604, or fax number: (801) 765-5759, attention Department 160 – Legal. Section 5 of this Agreement states:After the initial one hundred and twenty (120) day period, we will, so long as we are providing services pursuant to this Agreement, provide a replacement for any defective part without charge, but you will pay a visit charge for each service call at our then-prevailing visit fee, plus any applicable taxes.Vivint’s records show that Mr. [redacted] first notified Vivint of his equipment concerns on September 7, 2014, and Vivint’s Scheduling department found an appointment for October 7, 2014; however Mr. [redacted] informed the Vivint technician that he no longer needed the appointment at that time.  Mr. [redacted] again called Vivint on April 15, 2015, and an appointment was scheduled for April 17, 2015.  Vivint was not notified of any further equipment issues until recently.  Despite this information, Vivint agrees to the above resolution.  Mr. [redacted] will not be charged for service until July 2015.Vivint would like to ensure that Mr. [redacted] is able to utilize his system as intended, and will send a field service professional to her home at no charge. If you have further questions or concerns regarding this response, please respond to either our mailing address: 4931 North 300 West, Provo, Utah 84604, or fax number: (801) 765-5759, attention Department 160 – Legal.
