the information provided by Ms. [redacted] and appreciate the opportunity to respond. In her complaint, Ms. [redacted] alleges that her system had not been communicating properly. Ms. [redacted] desires that Vivint cancel her agreement. Vivint’s records indicate that prior to the installation of any equipment; Ms. [redacted] completed a telephonic Pre-Installation Survey with Vivint’s Account Creation department. Every customer must complete this Pre-Installation Survey, and if a customer does not pass the survey, Vivint will not enter into an agreement with the customer and will not install any equipment in the customer’s home. The purpose of the survey is to verify certain information, ensure that the customer understands Vivint’s offer, and confirm the terms and conditions of the Agreement. Our records show that Ms. [redacted] completed the required Pre-Installation Survey on September 11, 2014. During the recorded Pre-Installation Survey, Ms. [redacted] represented that she understood and agreed to the initial term of sixty (60) months. She also represented that she would pay a monthly monitoring fee of $[redacted] each month during that term. Vivint relied on Ms. [redacted]’s representations to ensure that she understood her commitments to Vivint as outlined in the Agreement. Vivint has been providing security services to Ms. [redacted] since the time of installation, on September 12, 2014. Vivint has offered to send a Field Service Professional to Ms. [redacted]’s home to inspect the system as well as three months free of service. Vivint apologizes for any inconvenience Ms. [redacted] may have experienced with her alarm system. In the event a customer experiences issues with their alarm system, repair, rather than cancellation, is the proper course of action. As such, Ms. [redacted] may contact Vivint’s customer support department to schedule a service appointment to test and inspect the system. In resolving this dispute, Vivint will waive any associated service and equipment fees. Should Ms. [redacted] wish to cancel her Vivint agreement prematurely, she may pay off the remaining balance on her account – currently $[redacted], however Vivint will take 25% off the payoff amount, bringing it to $[redacted]. Alternatively, should Ms. [redacted] wish to continue services, Vivint is willing to reduce her monthly rate to $[redacted], plus any applicable taxes. Ms. [redacted] alleges that she was not authorized to extend her Alarm System Purchase and Services Agreement (“Agreement”) because her name was not written on the Agreement. Ms. [redacted] desires cancellation without penalty. Vivint’s records indicate that Ms. [redacted] did sign a Purchase and Service Agreement on June 9, 2009 for a term length of thirty-nine (39) months. Since Ms. [redacted] is on the Agreement, she would be authorized to extend the terms of the Agreement and did so on July 16, 2013 for an additional term length of forty-two (42) months. A representative has reached out to Ms. [redacted] and provided a copy of her Agreement as well as the recorded phone conversation. Although cancellation without penalty is not warranted, Vivint would like to assist Ms. [redacted] by discounting her total purchase amount by seventy (70) percent. Currently, Ms. [redacted] buyout amount would be $[redacted], Vivint is willing to cancel Ms. [redacted] Agreement for $[redacted]. I am rejecting this response because:We have made several attempts via phone as well as in writing. Everytime we seek confirmation the customer care agent does not know about our particular case. There is a recorded phone call with Vivint whereas we were assured we would receive written acknowledgement of cancellation after I complained about the lack of customer service, and the obligation vivint has to their paying customer. I have done everything asked of me, and have wasted m

This is supported also by the constant ignorance vivint resembles whe I repeatedly ask for an account statement starting January 1st, 2015 until date. Which by the way I have not yet received either. I wish for my cancellation to be recognized immediately, as I am running out of time here with the deadline. I also wish to receive a statement of all charges and payments covering the year of 2015.This process was started in September, and now two days before my deadline I'm still arguing with a company that everytime I call has supposedly no notes on my last call!

Additionally, she states that Vivint did not address her concerns with the billing system in regards to making payments on the payoff balance. Vivint’s records indicate a refund was sent to Ms. [redacted]’s credit card on May 23, 2017. Refunds, however, can take up to 10 business days to reflect in a customer’s bank account once it has been approved. Vivint also removed Ms. [redacted]’s payment information from its automatic billing system to prevent further over charges in the future. With this Ms. [redacted] can continue to make payments without the remaining payoff balance being invoiced to attached payment information. A representative from Vivint has recently attempted to contact Ms. [redacted] on June 2, 2017 in an effort to confirm if the refund was received. She may contact this representative directly if she requires any further assistance. : Vivint is scheduled to come and take their equipment out tomorrow so I do accept them removing my equipment and cancelled my contract however what I want to say is that this Representatives response is incorrect. It does have to do with their equipment because it's their wifi router not mine therefore it is their fault. It is their equipment you do the math. This person does not know what he is talking about. I am very appreciative of Vivint letting me out of my contract

In her complaint, Ms. [redacted] explains that she is dissatisfied regarding the sale of the system which occurred in 2014. Ms. [redacted] is now in collections, and desires cancellation of her agreement without penalty. Vivint’s records show that Ms. [redacted] signed a Purchase and Services Agreement upon installation of her Vivint system, in which she represented that she understood and agreed to the initial term of sixty (60) months. She also represented that she would pay a monthly monitoring fee of $69.99 each month, plus applicable taxes, during that term. Vivint’s records further show that Ms. [redacted] stopped making her monthly payments after December 2014. As such, the account was cancelled for non-payment on May 29, 2015, and was sold to an outside collections agency. In his complaint Mr. [redacted] states that Vivint failed to provide him with paper invoices which resulted in him not paying his monthly service fees. As such, his account was transferred to a third party collection agency. Mr. [redacted] has since reinstated his account with Vivint and would like his credit report to not show any adverse effect of being sent to collections. Vivint apologizes for any undue delay in this process. The collection agency has been notified to remove any negative credit report that may have resulted from Mr. [redacted]’s account being transferred to collections. Should Mr. [redacted] wish to continue his monthly payments with a direct invoice he has been approved to do so. In her complaint Ms. [redacted] states that she has moved residences and Vivint will not allow her to cancel her System Purchase and Services Agreement (“Agreement”) without penalty. Ms. [redacted] desires her Agreement cancelled without penalty. Vivint agrees to reduce Ms. [redacted]’s buyout amount by fifty (50) percent as an effort of goodwill. Ms. [redacted]’s remaining balance is $2,519.64, but with Vivint’s discount the total amount required to cancel her Agreement is $1,259.82. Vivint’s records indicate that Ms. [redacted] entered into her Agreement with Vivint on August 16, 2014. that Vivint did not dispatch the authorities when an alarm was triggered on
October 31, 2015. Ms. [redacted] desires the cancellation of the agreement without
penalty. Vivint’s records indicate on
October 31, 2015, Vivint experienced a usual high volume of alarms that caused
a delay in alarm response times. Vivint’s monitoring department made a notation Ms. [redacted] was able to flag down a police officer and have him
return home with her when she received an alert on her phone. As such Vivint
removed Ms. [redacted]’s alarm from the queue of alarms needing police dispatch. Vivint’s
records further indicate that prior to the installation of any equipment; Ms. [redacted]
completed a telephonic Pre-Installation Survey with Vivint’s Account Creation
department. Every customer must complete
this Pre-Installation Survey, and if a customer does not pass the survey,

would like to assist Ms. [redacted]. Vivint records indicate Ms. [redacted] contacted
Vivint on October 19, 2015 and reported she has been experiencing some financial
hardship. To assist Ms. [redacted], Vivint has agreed to lower her monthly
service fee by $[redacted] for the remainder of the Agreement. Should Ms.

cancel her Vivint agreement prematurely, she may pay off the remaining balance

Vivint’s records indicate that Ms. [redacted] signed a System Purchase and Services Agreement on March 14, 2017 with an initial term of sixty (60) months, a monthly services fee of $49.99, plus any applicable taxes, during that term, and a total equipment fee of $1,230.46. Vivint provides a Right of Rescission period immediately following installation of the equipment, during which time a customer may cancel the Agreement for any reason.Vivint’s records show that Ms. [redacted] first notified Vivint of her equipment concerns on May 17, 2017. Vivint was able to reboot Ms. [redacted]’s Vivint panel. Ms. [redacted] again called Vivint on October 4, 2014 and an appointment was scheduled for May 26, 2017. A Vivint technician replaced Ms. [redacted]’s outdoor camera and doorbell camera.
