information provided by Mr. U[redacted] and appreciate the opportunity to respond. In his complaint, Mr. U[redacted] alleges that he has Vivint’s wireless internet service, and that the service has recently been down for weeks at a time.  Mr. U[redacted] further alleges that he cannot get a service visit scheduled within a week of his requests.  Mr. U[redacted] desires six (6) months of free internet service to compensate for the unreliable service.Unfortunately, Vivint Wireless is unable to locate an account with the information given by Mr. U[redacted].  A representative from Vivint Wireless has recently attempted to contact Mr. U[redacted] by calling the phone number provided on this complaint, in an effort to resolve these concerns.  I would advise Mr. U[redacted] to contact Vivint Wireless at [redacted], for resolution of this matter.If you have further questions or concerns regarding this response, please respond to either our mailing address: 4931 North 300 West, Provo, Utah 84604, or fax number: [redacted], attention Department 160 – Legal. He further explains that he has moved from the home the system was located yet continues to be billed for service. Mr. [redacted] requests cancellation of his account and a refund of all payments since March 2015.At this time Vivint agrees to cancel Mr. [redacted]’s Agreement with no penalty.A Vivint representative has contacted Mr. [redacted]’s wife in an effort to resolve their concerns. Vivint’s records indicate that a notice of cancellation was not received from Mr. [redacted] until October 2017. In regards to Mr. [redacted]’s change of address, had Mr. [redacted] contacted Vivint, Vivint would have had the ability to relocate services to his new home. This change of address would not qualify his account for early termination.Despite this information Vivint has agreed to cancel Mr. [redacted]’s Agreement with no penalty.   To Whom It May Concern: I have reviewed the information provided by Mr. [redacted] and appreciate the opportunity to respond. In his complaint, Mr. [redacted] claims that he was informed his contract would be for a duration of three (3) years with a monthly rate of $35. Instead, he states that he has been charged a $54 monthly rate and was unknowingly locked into a contract for five (5) years. Mr. [redacted] is requesting immediate cancellation without penalty. At this time, Vivint is willing to offer a contract buyout or assistance with a contract takeover.   Vivint’s records show that on September 6, 2013, Mr. [redacted] signed a Purchase and Services Agreement with Vivint, with an initial term of sixty (60) months and a monthly rate of $49.99.  By signing this agreement, Mr. [redacted] represented that he understood and accepted the contract terms and the cancellation policy. Vivint’s records also show that Mr. [redacted] has been paying Vivint the initially agreed $49.99 since his installation date. 2015                         To Whom It May Concern: I have reviewed the information provided by Mr. [redacted] and appreciate the opportunity to respond. In his complaint, Mr. [redacted] states that he has had complications with his security system that have not been resolved after technician visits.  He desires cancellation of his Agreement without penalty, removal of equipment from his home, a refund for the months he paid and did not have service, and repair of his wall from the doorbell installation. At this time, Vivint agrees to waive the remaining months of the Agreement and cancel Mr. [redacted]’s account, effective immediately.Vivint’s records show that Ms. [redacted] signed an Agreement on April 30, 2015 for an initial term of forty-two (42) months and a monthly services fee of $64.99, plus any applicable taxes, during that term.  Mr. [redacted] notified Vivint of some equipment concerns since installation of the system, and technicians were dispatched to his home on June 8, 2015 and February 23, 2016. May Concern: I have reviewed the information provided by Mr. [redacted] and appreciate the opportunity to respond. In Mr. [redacted]’ complaint he explains that he has had issues with the equipment and was told that he could cancel his account after a year of service. As such, Mr. [redacted] requests cancelation of his account.A representative from Vivint has recently attempted to contact Mr. [redacted] via email in an effort to resolve his concerns. Vivint’s records indicate that Mr. [redacted] signed a System Purchase and Services Agreement (“Agreement”) on September 16, 2015. Mr. [redacted] agreed to an original agreement term of forty-eight (48) months. Therefore we are still within the agreement term. Vivint has also never been informed that Mr. [redacted] was experiencing issues with his system. Therefore Vivint has not had an opertunit to fix any of the issues Mr. [redacted] might be experiencing. Because of these facts cancelation of the account without paying the cancelation fees is not warranted.In an effort to assist Mr. [redacted] Vivint is willing to set up a time for a technician to go to his home to fix any issues with the system without any cost to Mr. [redacted]. I am rejecting this response because: I’m a not asking for information regarding my previous tenants. All I’m asking is to know if if they have canceled they’re services for the property located at [redacted] [redacted]. We had to changed the thermostat that was being controlled by my old tenants because it appears that they still had their account active with vivint for my property which they had already vacated since May31, 2017.When we called last week one of the representatives stated that the services for my property were still active. Today when the representative from vivint called he said that he wanted me to fax a document stating that I was the owner. First of all , they needed to had obtain permission from me or my husband, owners of the property to install any equipment in our property and second if we have been calling since June why haven’t they contacted My old Tenants to verify that they had already vacated the property. Another thing is why are they asking me for legal proof that my husband and I own the property when in the first place they should of asked my tenants for my or my husbands written authorization to allow vivint to install any kind of equipment in our property. I just would like some kind of proof that the service for my old tenants at the property listed above has been canceled.

Ms. [redacted] states that the service should have been cancelled at that time. She requests cancellation of her Agreement with no penalty and a refund of payments.Vivint records indicate that Ms. [redacted] did attempted to transfer her service to [redacted] in September of 2016. However, Ms. [redacted] did not sign paperwork and relocated to Taiwan before the transfer could be completed. As the account transfer was not completed Ms. [redacted] is still responsible for her account.A representative from Vivint has recently contacted Ms. [redacted], in an effort to resolve these concerns.  Should Ms. [redacted] wish to cancel her agreement prematurely, her payoff amount would be $3,691.48; however, in an effort to assist Ms. [redacted], Vivint is willing to lower her payoff amount by 25%, bringing the total payoff amount to $2,768.61.  Alternately, Vivint has offered to waive the normal fee if Ms. [redacted] wishes to have her system moved. Ms. [redacted] requests cancellation and a refund.   At this time, Vivint is willing to cancel Ms. [redacted]’s account without penalty. No refund is warranted.   Vivint’s records indicate that prior to the installation of any equipment, Ms. [redacted] completed a telephonic Pre-Installation Survey with Vivint’s Account Creation department.  Every customer must complete this Pre-Installation Survey, and if a customer does not pass the survey, Vivint will not enter into an agreement with the customer and will not install any equipment in the customer’s home.  The purpose of the survey is to verify certain information, ensure that the customer understands Vivint’s offer, and confirm the terms and conditions of the Agreement. Our records show that Ms. [redacted] completed the required Pre-Installation Survey on August 7, 2015.   During the recorded Pre-Installation Survey, Ms. [redacted] represented that she understood and agreed to the initial term of forty-two (42) months.  She also represented that she would pay a monthly monitoring fee of $74.99 each month during that term.  Further, Ms. [redacted] represented that these terms were clearly outlined on the Agreement and that Vivint’s representative did not make any promises or commitments which were not written on the Agreement.  Vivint relied on Ms. [redacted]’s representations to ensure that she understood her commitments to Vivint as outlined in the Agreement.     Ms. [redacted] contacted Vivint on September 7, 2015 to receive assistance with her doorbell camera. According to the contract, it is the customer’s duty to test the system monthly and notify Vivint of any issues. However, Vivint spoke with Mr. [redacted] regarding his alarm service on May 20, 2014.
