information provided by Ms. [redacted] and appreciate the opportunity to respond. In her complaint, Ms. [redacted] states that was improperly charged by Vivint which cause her bank account to be drafted [redacted]. Vivint did agree to refund it, but she has yet to see the refund. Ms. [redacted] desires her Vivint account to be closed without penalty. A representative from Vivint has recently reached out to Ms. [redacted] in an effort to resolve this concern. The representative confirmed Ms. [redacted] received her refund on April 15, 2016.Vivint’s records indicate that when Ms. [redacted]’s system was installed, she was incorrectly invoiced for the cost of the equipment. On March 30, 2016, Ms. [redacted] reported the overcharge to Vivint, and a credit was immediately submitted for approval. Due to how Vivint’s billing system works, credit first needs to be applied; approval typically takes 3 to 5 days. Once a credit is approved, a customer has the option to refund the charge either by sending it directly to a bank account or by sending the customer a check. This process can take 7 to 10 business days, and can take additional time depending on the bank policy regarding deposits and refunds. A refund was sent for approval on April 8, 2016, and was approved on April 11, 2016. Ms. [redacted] confirmed receiving the refund on April 15, 2016.Cancellation without penalty is not warranted at this time. If Ms. [redacted] wishes to cancel her service prematurely, she may payoff the remaining balance on her account- currently [redacted] An offer of a reduced payoff has previously been offered to Ms. [redacted] and Vivint will maintain its stance. If Ms. [redacted] agrees to pay [redacted], 25% off of her current remaining balance, Vivint has agreed to cancel her account. Ms. [redacted] requests a refund of $102.70 and cancellation of her account.   At this time, Vivint is willing to refund Ms. [redacted] the amount of $102.70 and cancel her account.   However, it should be noted that the 30-day cancellation policy is listed in Ms. [redacted]’s System Purchase and Services Agreement. Vivint’s records indicate that this matter is currently being resolved to Ms. [redacted]’s satisfaction. Ms. [redacted]’s home damage claim is being resolved through Vivint’s legal department. Ms. [redacted] has been authorized to have a contractor come to her home to assess the damages and estimate the cost of repairs. Documentation Vivint will need to have on file are estimates and contractor invoices. Prior to processing payment (i.e. reimbursement) of any kind, we will need Mrs. [redacted] to sign a Release & Settlement Form. Concern:I have reviewed the information provided by Mr. [redacted] and appreciate the opportunity to respond. In his complaint, Mr. [redacted] alleges that he was misled by a Vivint representative regarding the term of his agreement, and that he recently had to pay for service he did not use for three (3) months.  Mr. [redacted] further alleges that he moved in December 2014 and experienced a delay in scheduling his appointment, and was charged a move fee of $99.00 that he thought would be waived.  Mr. [redacted] desires to be refunded for the extra monies he has paid Vivint, for his agreement term to be three (3) years, and an apology from Vivint.  Vivint’s records indicate that prior to the installation of any equipment, Mr. [redacted] completed a telephonic Pre-Installation Survey with Vivint’s Account Creation department.  Every customer must complete this Pre-Installation Survey, and if a customer does not pass the survey, Vivint will not enter into an agreement with the customer and will not install any equipment in the customer’s home.  The purpose of the survey is to verify certain information, ensure that the customer understands Vivint’s offer, and confirm the terms and conditions of the Agreement. Our records show that Mr. [redacted] completed the required Pre-Installation Survey on January 1, 2014. During the recorded Pre-Installation Survey, Mr. [redacted] represented that he understood and agreed to the initial term of sixty (60) months.  He also represented that he would pay a monthly monitoring fee of $[redacted] each month during that term.  Further, Mr. [redacted] represented that these terms were clearly outlined on the Agreement and that Vivint’s representative did not make any promises or commitments which were not written on the Agreement.  Vivint relied on Mr. [redacted]’s representations to ensure that he understood his commitments to Vivint as outlined in the Agreement.   Mr. [redacted] notified Vivint of his move and initially scheduled an appointment for December 31, 2014.  Vivint completed the move on February 2, 2015, and applied a two (2) month credit for system downtime.  This credit covered monthly service fees for January and February 2015.  Upon completion of Mr. [redacted]’s move, Vivint agreed to waive the $99.00 move fee if Mr. [redacted] extended his agreement for another sixty (60) months.  Mr. [redacted] declined to extend his agreement, and the move fee was charged.  In an effort to assist Mr. [redacted], Vivint has applied a credit of $[redacted] to his billing account, to reimburse this move fee.  This credit will cover monthly service fees for April and May.  Vivint apologizes for any undue delay or inconvenience experienced during this process.  If you have further questions or concerns regarding this response, please respond to either our mailing address: 4931 North 300 West, Provo, Utah 84604, or fax number: ###-###-####, attention Department 160 – Legal. information provided by Mr. [redacted] and appreciate the opportunity to respond. In his complaint, Mr. [redacted] states that he was misled by a Vivint representative regarding the term of his agreement, and that he was not notified of the three (3) day Right of Rescission (“ROR”) period.  Mr. [redacted] desires cancellation of his System Purchase and Service Agreement (“Agreement”) without penalty. Vivint’s records indicate that prior to the installation of any equipment, Mr. [redacted] completed a telephonic Pre-Installation Survey with Vivint’s Account Creation department.  Every customer must complete this Pre-Installation Survey, and if a customer does not pass the survey, Vivint will not enter into an Agreement with the customer and will not install any equipment in the customer’s home.  The purpose of the survey is to verify certain information, ensure that the customer understands Vivint’s offer, cancellation policy and confirm the terms and conditions of the Agreement. Our records show that Mr. [redacted] completed the required Pre-Installation Survey on May 26, 2016. During the recorded Pre-Installation Survey, Mr. [redacted] represented that he understood and agreed to the initial term of forty two (42) months.  He also represented that he would pay a monthly monitoring fee of $80.99 each month during that term.  Further, Mr. [redacted] represented that these terms were clearly outlined on the Agreement and that Vivint’s representative did not make any promises or commitments which were not written on the Agreement.  Vivint relied on Mr. [redacted]’s representations to ensure that he understood his commitments to Vivint as outlined in the Agreement.   Vivint provides an ROR period immediately following installation of the equipment, during which time Mr. [redacted] would have been able to contact Customer Care to address any concerns from the Pre-Installation Survey and cancel services. Section four of the Agreement states:You may cancel this Agreement at any time prior to midnight of the third business day after the date of this transaction.At this time, cancellation without penalty is not warranted, however, if Mr. [redacted] still desires early cancellation of his Agreement, Vivint will offer to reduce his buyout by 30%. This would lower his buyout amount from $3,320.59 to $2,324.42. Whom It May Concern: I have reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond. In Ms. [redacted]’s complaint she explains that Vivint’s thermostat damaged her HVAC system. Ms. [redacted] requests that Vivint pay the $1800.00 to cover the cost of repairs and cancelation of her account with Vivint.Vivint agrees to send Ms. [redacted] a check of $750.00 and cancel Ms. [redacted]’s account with Vivint upon the recovery of the equipment in her home.A representative from Vivint has recently attempted to contact Ms. [redacted] via email in an effort to resolve her concerns. Vivint’s records show that one in house HVAC technician and a HVAC technician that was at Ms. [redacted]’s house saying that Vivint’s thermostat did not have the capacity to direct the 240 VAC that damaged the HVAC system. Vivint’s records further show that the damage was done while another HVAC technician was working on the system in Ms. [redacted]’s home. Due to these facts and because we are not able to get a second opinion Vivint pay the full $1800.00 is not warranted.Despite these facts, and in an effort to assist Ms. [redacted], Vivint agrees to the above resolution. Where Vivint will send Ms. [redacted] a check of $750.00 and cancel her account with Vivint if Ms. [redacted] will allow Vivint to recover the equipment in her home. reviewed the information provided by Mr. T[redacted] and appreciate the opportunity to respond. In his complaint, Mr. T[redacted] alleges that he has had multiple complications with the billing of his Vivint account, and that he has been inconvenienced by these complications.  Mr. T[redacted] desires a refund of all monies paid to Vivint in the past year. Vivint’s records show that, prior to Mr. T[redacted]’s request for a deferment of his payments, his billing account was three (3) months past due.  Vivint charged Mr. T[redacted] for the past due balance, and then refunded that payment to Mr. T[redacted].  Mr. T[redacted] was again charged the past due balance because it was an amount owed to Vivint for service during the term of his Agreement.  In an effort to assist Mr. T[redacted], Vivint refunded him this payment as well.  At this time, Vivint has refunded Mr. T[redacted] and has forgiven the past due balance owed.A representative from Vivint has been in contact with Mr. T[redacted] in regards to this matter.  Mr. T[redacted]’s agreement with Vivint has been cancelled and he has no further contractual obligation to Vivint.  Vivint will not refund Mr. T[redacted] for all months of service rendered, but will also not hold him responsible for the remainder of his Agreement, or for the equipment at his home.  If you have further questions or concerns regarding this response, please respond to either our mailing address: 4931 North 300 West, Provo, Utah 84604, or fax number: [redacted], attention Department 160 – Legal.             Vivint Account #: [redacted]              Date of Agreement: May 30, 2011             Date of Addendum: June 25, 2014                                         To Whom It May Concern:                              I have reviewed the information provided by Mr. [redacted] and appreciate the opportunity to respond.   In his complaint, Mr. [redacted] explains that he does not recall extending the term of his agreement over the phone with Vivint, and that now he is unable to cancel his agreement. Mr. [redacted] desires cancellation of his agreement without penalty.   At this time, Vivint has agreed to immediately cancel Mr. [redacted]’s account. In addition, the requested refund has been submitted and will go back in their account within 7-10 business days.   Vivint’s records show that on May 30, 2011, Mr. [redacted] signed a Purchase and Services Agreement with Vivint, with an initial term of forty-two (42) months. Vivint spoke with Mr. [redacted] regarding his alarm service on June 25, 2014.  Mr. [redacted] represented that he was satisfied with Vivint’s services and that he was interested in extending the term of his agreement.  Based upon this representation, Vivint offered a forty-two (42) month extension to which Mr. [redacted] agreed.  Indeed, Vivint read the following statement, after which Mr. [redacted] responded affirmatively:   You understand that this call is being recorded, and you agree to extend the term of your agreement forty-two months from today.  No other provisions of your agreement have been changed and this amendment constitutes the new agreement between you and Vivint.                           Despite the information above, Mr. [redacted] has no further obligation to Vivint. Ms. [redacted] further alleges she was not informed by the sales representative of the Right of Recession period. She desires for the Agreement to be terminated and the equipment removed from the home without penalty.Before any customer enters into an agreement with Vivint, and prior to the installation of any equipment, the customer must complete a telephonic Pre-Installation Survey with Vivint’s Data Entry Department. If a customer does not pass the Pre-Installation Survey, Vivint will not enter into an agreement with the customer and will not install any equipment in the customer’s home. The purpose of the survey is to verify certain information, ensure that the customer understands Vivint’s offer, and confirm the terms and conditions of the Agreement. During the Pre-Installation Survey, Ms. [redacted] represented that she understood and agreed that her Agreement has an initial term of 42 months and that she would pay a monthly services fee of $[redacted] (plus any applicable taxes) each month during that term. She further represented that these terms and conditions were clearly provided on the front of her Agreement and that Vivint’s representative did not make any promises or commitments to her that were not provided on the Agreement. Vivint relied on Ms. [redacted] representations during this survey and, based upon her representations, Vivint entered into the Agreement with her and installed an alarm system in her home. Additionally, the Notice of Cancellation Vivint provided clearly sets forth the right of rescission period expiring at midnight on April 29, 2015. Ms. [redacted] first contacted Vivint regarding cancellation on April 30, 2015, after the right of rescission period had lapsed.
