information provided by Mr. [redacted] and appreciate the opportunity to respond. In his complaint, Mr. [redacted] states that he was misled by a Vivint representative regarding the term of his agreement, and that he was not notified of the three (3) day Right of Rescission (“ROR”) period. Mr. [redacted] desires cancellation of his System Purchase and Service Agreement (“Agreement”) without penalty. Vivint’s records indicate that prior to the installation of any equipment, Mr. [redacted] completed a telephonic Pre-Installation Survey with Vivint’s Account Creation department. Every customer must complete this Pre-Installation Survey, and if a customer does not pass the survey, Vivint will not enter into an Agreement with the customer and will not install any equipment in the customer’s home. The purpose of the survey is to verify certain information, ensure that the customer understands Vivint’s offer, cancellation policy and confirm the terms and conditions of the Agreement. Our records show that Mr. [redacted] completed the required Pre-Installation Survey on May 26, 2016. During the recorded Pre-Installation Survey, Mr. [redacted] represented that he understood and agreed to the initial term of forty two (42) months. He also represented that he would pay a monthly monitoring fee of $80.99 each month during that term. Further, Mr. [redacted] represented that these terms were clearly outlined on the Agreement and that Vivint’s representative did not make any promises or commitments which were not written on the Agreement. Vivint relied on Mr. [redacted]’s representations to ensure that he understood his commitments to Vivint as outlined in the Agreement. Vivint provides an ROR period immediately following installation of the equipment, during which time Mr. [redacted] would have been able to contact Customer Care to address any concerns from the Pre-Installation Survey and cancel services. Section four of the Agreement states:You may cancel this Agreement at any time prior to midnight of the third business day after the date of this transaction.At this time, cancellation without penalty is not warranted, however, if Mr. [redacted] still desires early cancellation of his Agreement, Vivint will offer to reduce his buyout by 30%. This would lower his buyout amount from $3,320.59 to $2,324.42. Vivint’s records indicate that this matter is currently being resolved to Ms. [redacted]’s satisfaction. Ms. [redacted]’s home damage claim is being resolved through Vivint’s legal department. Ms. [redacted] has been authorized to have a contractor come to her home to assess the damages and estimate the cost of repairs. Documentation Vivint will need to have on file are estimates and contractor invoices. In her complaint, Ms. [redacted] alleges that she was misled by a sales representative regarding the terms of her Agreement, and that she actually signed her contract at the end of 2013 and not July 2014. Ms. [redacted] desires cancellation of her agreement without penalty. Vivint’s records indicate that Ms. [redacted] signed a Purchase and Services Agreement upon installation of her Vivint system, in which she represented that she understood and agreed to the initial term of sixty (60) months. She also represented that she would pay a monthly monitoring fee of $[redacted] each month, plus applicable taxes, during that term. Vivint offers a Right of Rescission period of three (3) business days following installation of the system, during which time Ms. [redacted] could have cancelled her Agreement after having the time to read it. Cancellation of the Agreement without penalty is not warranted at this time.Ms. [redacted] has indicated to Vivint that she is moving, and Vivint applied a credit in the amount of $99.00 to her billing account, to offset any move fee. In her complaint, Ms. [redacted] states that there was damage to her home which resulted from the installation of the Vivint security system. She explains that all this damage has been repaired by Vivint save for damage to an intercom system in her home. Ms. [redacted] requests that Vivint arrange for repairs to this intercom system.Vivint’s records indicate that Ms. [redacted]’s home damage claim was assigned to a Vivint Claim Manager. This representative was unable to locate a contractor willing to provide an estimate or complete repairs to Ms. [redacted]’s intercom system. To proceed with this home damage claim Vivint requires that Ms. [redacted] obtain estimates from two contractors to repair the damage. Once Vivint has received these estimates from Ms. [redacted] they will proceed with resolving Ms. [redacted]’s claim. Alternatively Vivint has offered Ms. [redacted] $250 to resolve this claim. The technician has been unable to resolve his issue so Mr. [redacted] desires the cancellation of his Agreement without penalty. The policy Mr. [redacted] quotes in his rebuttal stating that it is the customer’s responsibility to contact the technician who installed his system directly is incorrect. Vivint never has a customer reach out to a technician nor should a technician be dispatched to a home without an appointment. Vivint’s policy regarding service appointments, not matter the length of time into an Agreement, is for the customer to contact Vivint’s call center and schedule the appointment. The reason for this is Vivint will have record of the different troubleshooting methods that were used to attempt to resolve the technical concerns. Vivint has not official record of these appointments Mr. [redacted] states occurred; as such Vivint has no record what was done in an attempt to resolve the concerns. Repair rather than cancellation is the proper course of action. Vivint would like the opportunity to inspect the panel.A representative from Vivint has recently attempted to contact Mr. [redacted] in an effort to resolve these concerns. In resolution to this matter, Mr. [redacted] may contact Vivint’s representative to schedule an appointment to inspect his equipment. Vivint has also credited Mr. [redacted]' account in the amount of $121.98. In her complaint, Ms. [redacted] states that was improperly charged by Vivint which cause her bank account to be drafted [redacted]. Vivint did agree to refund it, but she has yet to see the refund. Ms. [redacted] desires her Vivint account to be closed without penalty. A representative from Vivint has recently reached out to Ms. [redacted] in an effort to resolve this concern. The representative confirmed Ms. [redacted] received her refund on April 15, 2016.Vivint’s records indicate that when Ms. [redacted]’s system was installed, she was incorrectly invoiced for the cost of the equipment. On March 30, 2016, Ms. [redacted] reported the overcharge to Vivint, and a credit was immediately submitted for approval. Due to how Vivint’s billing system works, credit first needs to be applied; approval typically takes 3 to 5 days. Once a credit is approved, a customer has the option to refund the charge either by sending it directly to a bank account or by sending the customer a check. This process can take 7 to 10 business days, and can take additional time depending on the bank policy regarding deposits and refunds. A refund was sent for approval on April 8, 2016, and was approved on April 11, 2016. Ms. [redacted] confirmed receiving the refund on April 15, 2016.Cancellation without penalty is not warranted at this time. If Ms. [redacted] wishes to cancel her service prematurely, she may payoff the remaining balance on her account- currently [redacted] An offer of a reduced payoff has previously been offered to Ms. [redacted] and Vivint will maintain its stance. If Ms. [redacted] agrees to pay [redacted], 25% off of her current remaining balance, Vivint has agreed to cancel her account. 2008 Date of Addendum: June 10, 2014 To Whom It May Concern: I have reviewed the information provided by Mr. [redacted] and appreciate the opportunity to respond. In his complaint, Mr. [redacted] states that he attempted to cancel his account with Vivint after completing the term of his contract, but that Vivint renewed his Agreement without his authorization. Mr. [redacted] desires cancellation of his Agreement without penalty.At this time, to assist Mr. [redacted], Vivint will cancel his Agreement without penalty, effective immediately. Vivint has waived the past due balance of $48.70 on the account.Vivint’s records show that on August 4, 2008, Mr. [redacted] signed a Purchase and Services Agreement with APXAlarm, which later became Vivint Inc., with an initial term of sixty (60) months. Vivint spoke with Mr. [redacted] regarding his alarm service on June 10, 2014. Mr. [redacted] represented that he was interested in extending the term of his Agreement in exchange for new equipment and a reduced monthly rate. Based upon this representation, Vivint offered a forty-two (42) month extension to which Mr. [redacted] agreed. Indeed, Vivint read the following statement, after which Mr. [redacted] responded affirmatively:You understand that this call is being recorded, and you agree to extend the term of your agreement forty-two months from today. I do not want to have anything to do with this company I want to close them out and go somewhere else they live from the beginning and once you lie from the beginning how can you trust them now do not trust trust company when you hire a third-party to Do Your Dirty Work and when they do wrong and you don't want to recognize what they've done wrong and you're asking me what did you do wrong shame on you it's called too many spoons in the pot and when smallest spoon dealership doesn't want to record I don't want to have anything to do with it but you know what they're just as guilty as the third party because they're the ones that gave them a contract to do their dirty work I want to close them out and go somewhere else do not trust worry once you lie from the beginning you're liable company dealership to me and they lied to me I do not want to be with this coming anymore

She is requesting reparation to her front door and for the equipment to be fixed. At this time, Vivint’s Home Damage department is working with Ms. [redacted] to compensate her for any damages done to her door, and is currently waiting on her response. Vivint is also willing to offer a free appointment to address any equipment concerns Ms. [redacted] has been experiencing. Vivint’s records show that on July 28, 2017, Ms. [redacted] signed a Purchase and Services Agreement with Vivint, with an initial term of sixty (60) months. As stated in the Agreement, Vivint will provide reparation service to the equipment free of charge for one hundred and twenty (120) days after the installation is complete. Vivint’s records indicate that the system was installed on July 28, 2017, so Ms. [redacted] is still eligible for a free technician appointment. In her complaint, Ms. [redacted] states to having equipment complications with her security system that have not been resolved. Ms. [redacted] desires for Vivint to cancel her account without penalty. Vivint’s records show a Vivint Field Service Professional was dispatched to Ms. [redacted]’ home on February 25, 2017. This Field Service Professional replaced the camera and tested the system. Vivint’s records indicate that this matter has been resolved. A previously a representative from Vivint has been in contact Ms. [redacted], in an effort to resolve her concerns. During this conversation, the representative credited Ms. [redacted]’ account one month of service.
