Revdex.com:I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action may not resolve my complaint.  For your reference, details of the situation appear below.I am not satisfied with this resolution because it's not a resolution.  I have been contacted by Ms. [redacted] (by email), requesting that I contact her by phone.  After several attempts to call her, and an email requesting a good time for me to call, I still have yet to speak to her.  I just sent another email to her giving her all my phone numbers, and since I live in Japan, I even informed her of the best times to contact me at those numbers.  I will continue to try to contact her while I wait for her to contact me.  If I don't have any success, I will contact the gentleman identified in their response.Regards,[redacted]

Platinum point vacation ownership on April 28, 2014.  They purchased 90,000 Platinum points to be used on an every “odd” year basis starting in 2015.  The maintenance fee obligation for their 2015 usage year was paid in July of 2014 so their points for 2015 could be released for deposit with Interval International for exchange purposes.   We have had quite a bit of communication with the owners in reference to the usage of their ownership.  The notes of contacts with our Owner Services team are very specific that they wanted to get their time deposited so they could use their exchange benefits for travel.  We have never had a challenge with usage of Interval International for exchange travel brought to our attention for help with resolution.  There were no challenges listed within the ownership until we were contacted by you on September 4, 2014.  You are now requesting that we rescind this ownership.   You are requesting to rescind this ownership contract and refund monies paid to Welk, it is not Welk’s policy to cancel contracts that have passed beyond the rescission period required under Missouri law.  We do not have a contract rescission option for this ownership commitment.  I am happy to provide any owner contract documents that are needed.    We understand that our owners are given a large amount of information on the date of sale.  That is why we legally allow them five days to read their contract after the date it is signed.  Included in the documents were specific procedures on how to utilize their vacation ownership, as well as directions to cancel that same ownership.  If they wanted to cancel within that timeframe they had the right to do so.  The instructions are specific that it must be done within the defined timeframe.    The first year of ownership may seem difficult, especially when dealing with several different departments.  Please know that we are here to assist and guide our owners through their ownership to make sure they are enjoying it to its full potential.  We will customize the ownership to fit their vacation needs, based on what was purchased.   Our Owner Services team can help with best practices for successful usage of the Interval International exchange program or planning a vacation at any of our Welk Resort locations.  This vacation ownership was purchased with the intent on using it for vacation travel.    Please feel free to reach out to me directly regarding any further questions or concerns regarding this matter.   Sincerely,       [redacted] Director of Consumer Affairs Welk Resorts [redacted].[redacted]

address the points brought forth in your complaint.    I am sorry if there were any misunderstandings during your sales presentation.  Welk is highly rated for owner/guest experiences and for the high trade value through the exchange companies.  We take great pride in assisting our owners planning memorial vacations.   Our records show that you both became Welk owners on March 31, 2012 when you purchased 120,000 Platinum owner points to be used on an every even year basis.  You chose to upgrade your ownership to 240,000 Platinum owner points to be used on an every even year basis on May 23, 2012.  The first usage year for each of your ownership contracts was 2012.   Please allow me to clarify your exchange opportunities with Interval International.  Your ownership options include depositing a week with Interval International in exchange for a week anywhere in the world.  When depositing with Interval, you will also receive a second week of vacation (any size villa requested, based upon availability) as a “Resort Accommodation Certificate” (bonus week).  When you deposit your ownership with Interval, they will extend the expiration of the deposited week for two additional years.  The bonus week from Interval International is good for one year.    Additionally, I would like to clarify your Interval International “Gold” membership.  Welk pays for the first year of “Gold” membership with Interval.  This upgraded membership includes discounts on vacation exchanges, vacation “Getaways”, hotels, car rental, cruises and much more.  The “Getaways” are extra vacation opportunities at a discounted rental rate and are unlimited.  To take advantage of those discounts, you would contact Interval International directly.  All this information is outlined in the Interval International Membership packet that was mailed to you with their Resort Directory.    Interval International has thousands of resort choices worldwide and Welk demands a very high trade value. The process is that you choose a resort destination, have several date choices and call Interval International.  They will check availability.  If nothing is available at that moment, they will start a “pending search” by collecting the exchange fee.  Their system searches 24 hours a day, seven days a week.  As soon as a match is found, they will generate an instant confirmation.  More than 73% of our owners receive a confirmation within 48 hours.   The opportunity to book an exchange reservation is based upon villa availability.   If there is no villa available for your requested vacation time and location, there is nothing Welk can do to make space available.   We will work diligently to assist in the exchange process on your behalf at a resort of your choosing to fit your vacation needs.  Welk does not control availability at another resort within the Interval International exchange program.    Welk does not have a buy-back program.  I suspect you are confused about the developers Right Of First Refusal (ROFR), which is exercised or waived after you have accepted an offer from a third party.  This means once you have a buyer, your escrow company will contact Welk and we have the option to match the offer or pay more.  You would be required to have the buyer first and open escrow for the process to begin.    The disclaimers that you reviewed when you purchased specifically cover that all the information has been personally reviewed by you, that you have received copies of all documents and that there are no other representations that are not covered in writing.  We review this information with you with the sole purpose of eliminating possible misunderstandings or confusion.   We understand how there may be misunderstandings in terms and conditions given verbally; therefore we cover everything thoroughly in our documents and disclosures.  We know that you are given a large amount of information.  That is why we legally allow you seven days to read your contract after the date you signed.  If you wanted to cancel within that time you had the right to do so.  Included in your documents were specific procedures on how to utilize your vacation ownership, as well as directions to cancel that same ownership.  The instructions are specific that it must be done in writing within the defined timeframe.  Unfortunately, since you have passed your legal rescission period, we cannot simply cancel your contract.   As for your request to terminate your contract, it is not Welk’s policy to cancel contracts that have passed beyond the rescission period required under California law.  I do not have a contract rescission option for your ownership commitment.  Welk does not have a “take-back” program that would allow you to simply return your ownership to Welk.   Your mortgage commitment and owner obligated maintenance fee commitments both need to be kept current.  Regrettably, if you are unwilling to keep your ownership obligations current, collection activity and default proceedings may begin.    Please feel free to reach out to me directly regarding any further questions or concerns you may have regarding this matter.   Sincerely,     [redacted] Director of Consumer Affairs Welk Resorts [redacted]

and for the high trade value through the exchange companies.  We take great pride in assisting our owners planning memorable vacations.    I show you originally became Welk owners on 2005 when you purchased a fix week ownership with annual usage. You both decided to overlay your ownership on June 27, 2014 to convert your fixed week ownership into points to be used in our Welk Platinum Point system.  The Overlay program allows you a number of travel options throughout the Welk family of resorts.  You are no longer restricted to your fixed week at your home resort.  You have the option to stay at any of our resort locations within the Platinum point program.  Your Platinum points allow you to decide the resort location, number of nights and villa size for your stay.    Your fixed week ownership allowed you to deposit a 2 bedroom equivalent with Interval International for exchange usage.  You can now use your points to deposit in one-bedroom equivalents.  This will allow you the opportunity to upgrade for free to a two-bedroom unit when using the Interval International instant confirmation process.  If there is a two-bedroom villa available when you book your one-bedroom exchange, Interval International will allow you to upgrade to that villa.  Your Platinum point overlay will allow you to deposit two separate weeks, as one-bedroom villas, with Interval International for travel.  You will also receive a bonus week for each week deposited.    You have the option of depositing a week with Interval International in exchange for a week anywhere in the world.  When depositing with Interval, you will also receive a second week of vacation (any size villa requested, based upon availability) as a “Resort Accommodation Certificate” (bonus week).  When you deposit your week with Interval, they will extend the expiration of your deposited week for two additional years.  The bonus week from Interval International is good for one year.    Interval International has thousands of resort choices worldwide and Welk demands a very high trade value.  The process is that you choose a resort destination, have several date choices and call Interval International.  They will check availability.  If nothing is available at that moment, they will start a “pending search” by collecting the exchange fee.  Their system searches 24 hours a day, seven days a week.  As soon as a match is found, they will generate an instant confirmation.  More than 73% of our owners receive a confirmation within 48 hours.      You can also use their “Short Stay” Gold Membership option that allows up to three short stays for every Welk week deposited.  You also have the option of depositing your time with Interval International or RCI.  Since we are dually affiliated, you still have the option to deposit to RCI as a Welk owner.  If you prefer their system, we can deposit weeks with RCI instead of Interval.  If you still have an active membership with RCI, we can help you get your points deposited for usage with RCI.    Your decision to purchase an overlay to the Platinum point program has opened up a number of travel opportunities that were not previously available to you with your fixed week ownership.  I am happy to have a member of our Owner Services team assist you with any usage challenges or concerns you might be having.  We want you to get the most out of your vacation ownership.    Please feel free to reach out to me with any further questions or concerns you may have regarding this matter.   Sincerely,     [redacted] Director of Consumer Affairs Welk Resorts [redacted]@welkgroup.com

Welk Platinum Owners [redacted] and [redacted] Welk Platinum point ownership number: [redacted]   Dear Ms. [redacted],   I am in receipt of your rebuttal to my response.  I understand your request for your mother’s and Aunt’s ownership to be cancelled.    We are an ethical company and cover everything thoroughly in our documents. Our documents cover in detail their ownership commitment.  Included in their documents were specific procedures on how to utilize their vacation ownership as well as the specific steps to be used to cancel their ownership contract. All of the documentation is provided to prior to leaving on the date of sale.  Welk does not have a “take-back” program.  The option for cancellation is covered specifically in enlarged bold print on the purchase contract and is included in the documents that are sent home at the time of purchase.  The timeframe and rights of cancellation are clearly covered.   I do show a conversation Mrs. [redacted] had with our Vacation Owner Association in June of 2014 regarding challenges with usage.  I show our Owner Services team assisted with a deposit for the usage of exchange for Mrs. [redacted] and Mrs. [redacted].  There are numerous conversations regarding depositing time and paying maintenance fees early to be able to travel on exchange.  Time was deposited with Interval International and a pending request was placed for exchange travel to Hawaii.  Interval International has been actively reaching out to them on a consistent basis over the past few months with exchange opportunities that match their existing pending requests for travel to Hawaii.  Those messages have gone unreturned.    I was not present at their sales presentation so I cannot assume what was said and what was taken away from the conversation.  We use the signed documentation as the documents of record because it effectively eliminates the issue of any verbal promises that may lead to a misunderstanding regarding their ownership.  Contracts are created, signed and explained to protect both parties in a transaction.  Not only did they meet and talk to the Sales Person and Sales Manager, the Escrow Analyst also went through the documents with them during their purchase.  We review this information with our owners for the sole purpose of eliminating possible misunderstandings or confusion.    They could have legally canceled anytime, and for any reason, within their legally allowed rescission period.  Since they have passed their legal rescission period, contract cancellation is not an option.  There is not a release or give-back option for their ownership contract.  I do not have an option that will allow them to simply return their ownership.     Please feel free to reach out to me with any further question or concerns regarding this matter     Sincerely,     [redacted] Director of Consumer Affairs Welk Resorts [redacted].[redacted]

  You originally became a Welk Platinum point owner on May 20, 2011 when you purchased 240,000 Platinum points to be used on an every “odd” year basis.  The first usage year for this ownership was 2011.   On July 29, 2011 you chose to upgrade to 480,000 Platinum points to be used on an every “odd” year basis with the first usage year being 2013.  On June 26, 2012 you decide to upgrade to 300,000 Platinum points on an annual basis. You made the decision to cancel this contract.  On June 29, 2012 you upgraded to 300,000 Platinum points to be used on an annual basis with a first usage year of 2013.  On September 16, 2013 you again decided to upgrade to 360,000 Platinum points to be used on an annual basis with the first usage year being 2013.  Your current ownership is 360,000 Platinum points with annual usage.   The purchase agreement negotiation, based upon the owner needs, pricing, discounts and incentives, takes additional time.  Every contract is negotiated personally and pricing, discounts and incentives can change daily.  You are only obligated to stay for the 90 minute sales presentation to receive your initial free gifts.  You always have the right to leave at any time.  The decision to purchase each of the above listed contracts was yours.   I have reviewed your full owner records.  I show only a few contacts with our Owner Services team regarding Interval International deposits.  I also show that we referred you to Interval International to try to use one of your deposits to stay at our Desert Oasis property because we had no available inventory.  You have no challenges listed in your ownership in reference to usage during youe almost four years as a Welk Platinum point owner.    Your complaint details your challenges with your decision to accept a tour package through Interval International and the requirement to attend a timeshare presentation with Diamond Resorts. Welk would not control your experience with either Interval International or Diamond Resorts.  Diamond Resorts and Interval international are both third party companies in relation to Welk Resort Group.  Your negative experience with another company is not a valid reason for Welk to nullify your Welk vacation ownership contract.      Interval International is our exchange partner.  You have the option of depositing a week with Interval International in exchange for a week anywhere in the world.  Your ownership with Welk includes the annual membership fee with Interval.  When depositing with Interval, you will also receive a second week of vacation (any size villa requested, based upon availability) as a “Resort Accommodation Certificate” (bonus week).  When you deposit your week with Interval, they will extend the expiration of your deposited week for two additional years.  The bonus week from Interval International is good for one year.    Interval International has thousands of resort choices worldwide and Welk demands a very high trade value. The process is that you choose a resort destination, have several date choices and call Interval International.  They will check availability.  If nothing is available at that moment, they will start a “pending search” by collecting the exchange fee.  Their system searches 24 hours a day, seven days a week.  As soon as a match is found, they will generate an instant confirmation.  More than 70% of our owners receive a confirmation within 24 hours.    You can also use their “Short Stay” Gold Membership option that allows up to three short stays for every Welk week deposited.  The fees for exchange were covered specifically in your ownership documents.  I do not show you have ever contacted our Owner Services team in reference to any challenges in using the Interval International exchange program.   The disclaimers that you reviewed with each purchase specifically cover that all the information has been personally reviewed by you, that you have received copies of all documents and that there are no other representations that are not covered in writing.  We review this information with you with the sole purpose of eliminating possible misunderstandings or confusion.   Welk does have an Owner Rental program.  Our program allows you to put days/weeks into a rental pool to assist when you cannot travel or use.   Our owners have used the program successfully to supplement their monthly and annual fees.   Rental rates are based on unit size, season and weekend versus mid-week.  The processing fees for Welk to advertise and rent your property are approximately 40%.  The remaining roughly 60% is paid to you the owner. Our Owner Services team is here to help you with best practices for successful usage of our Owner Rental program.  You would have to choose the dates for your inventory to be placed into the Owner Rental program.  Our Owner Services team is happy to help you with any questions you might have.  If your nights do not rent, you do have the option of coming to the resort and using them personally.   We are an ethical company and cover everything thoroughly in our documents.  Every contract is negotiated personally and pricing, discounts and incentives can change daily.  We take our service levels and company ethics very seriously.  Contracts are created, signed and explained to protect both parties in a transaction.  Not only did you meet and talk to the Sales Person and Sales Manager, the Escrow Analyst also went through the documents with you independently during each of your purchase transactions.    Included in your documents were specific procedures on how to utilize your vacation ownership as well as the specific steps to be used to cancel your ownership contract. I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer fied with resolutionI do not accept this offer as I was ripped off and taken advantage of and that contract was signed under duress making it void. I have picked up 2 small claims packets to fill out for $5000 each. I will be turning those in within the next few days. If we lose in small claims, I already have an attorney for multiple civil suites to bury you in paperwork for months to come with appeal after appeal. I'll make sure I cost you 10 times what our contract is worth in legal fees.  It's in your hands but I will be serving a corporate officer with 2 lawsuites within a few days.

Dear Mr. [redacted],   I am in receipt of your Revdex.com rebuttal to our response to your complaint.  We have responded to each of your concerns.  The only acceptable resolution for you is cancellation of your ownership.    As I have made clear in each of my four responses to you, Welk does not have a cancellation option for an ownership contract that has passed the legal rescission period.  I do not have any further options available to you other that trying to place your time with our Owner Rental program or choosing to use your time.  You have the option of using your time at the resort, using our Owner Rental program or exchanging your time with our exchange partner Interval International.  Welk does not have a take-back option for your ownership.   We will continue to assist you to the best of our abilities with your ownership use, exchange and rental as applicable, but we will not nullify our contract with you.  Welk Resort will not be issuing you a refund or cancelling your ownership contract.  Cancellation or rescission of your ownership obligation is not an option.  We have gone back and forth repeatedly on this issue.  Our stance in reference to contractual rescission will not change.   Our expectation is that you honor your Welk ownership commitment.   Please feel free to reach out to me with any further questions or concerns in reference to this matter.   Sincerely,     H[redacted] Director of Consumer Affairs Welk Resorts [redacted]

If an owner chooses to upgrade their ownership they will sign a new ownership contract. The terms and conditions of that ownership contract will be in effect. There is a rescission window for their new contract. If the owner decided to rescind their upgraded ownership their original ownership contract would still be in place. Please let me know if this answers your question.

Our records show that you became a Welk owner when you purchased a 120,000 Platinum Point vacation ownership with Welk Resorts on July 20, 2013.  The first usage year for your ownership contract was 2014. I show your owner obligated mortgage commitment was last paid in June of 2014.  Your maintenance fee obligation for your 2014 usage year is currently outstanding and due. 
 
I am sorry if there were any misunderstandings during your sales presentation.  Welk is highly rated for owner/guest experiences and for the high trade value through the exchange companies.  We take great pride in assisting our owners planning memorial vacations.
 
I apologize if you felt pressured, or felt that the sale process took an excessive amount of time.  The sales presentation is 90 minutes.  The purchase agreement negotiation, based upon the owner needs, pricing, discounts and incentives, takes additional time.  Every contract is negotiated personally and pricing, discounts and incentives can change daily.  You are only obligated to stay for the 90 minute sales presentation to receive your initial free gifts.  The choice to purchase your Welk vacation ownership was yours.  You always have the right to leave at any time.
 
I have read through all of your ownership notes.  There is no usage history for your ownership.  You have never contacted us to attempt to use your ownership.  Our records show no contact in regards to a gifting challenge.  I am more than happy to assist you with the redemption of your gift vouchers.  We want you to use your gifts.  There are specific steps that need to be taken when redeeming your gift vouchers.  The redemption process, terms and conditions are outlined in the information given with the vouchers.
 
Our redemption partner successfully sends thousands and thousands of our guests on wonderful gifted excursions on an annual basis.  Again, if you are having an issue getting this done please reach out to me directly at my e-mail listed below and I will have our gifting department assist you in getting your vouchers redeemed.
 
 
 
Please allow me to clarify your exchange opportunities with Interval International.  Your ownership options include depositing a week with Interval International in exchange for a week anywhere in the world.  When depositing with Interval, you will also receive a second week of vacation (any size villa requested, based upon availability) as a “Resort Accommodation Certificate” (bonus week).  When you deposit your ownership with Interval, they will extend the expiration of the deposited week for two additional years.  For each week that you deposit with Interval international you will receive one bonus week.  The bonus week from Interval International is good for one year. 
 
Interval International has thousands of resort choices worldwide and Welk demands a very high trade value.  The process is that you choose a resort destination, have several date choices and call Interval International.  They will check availability.  If nothing is available at that moment, they will start a “pending search” by collecting the exchange fee.  Their system searches 24 hours a day, seven days a week.  As soon as a match is found, they will generate an instant confirmation.  More than 73% of our owners receive a confirmation within 48 hours.  All exchange usage is on a space available basis.  This is clearly covered in your ownership documents. 
 
The exchange fee for usage of a deposited week with Interval International will range from $169.00 - $189.00.  When you use an Interval International bonus week the fees will range from $249.00 to $449.00 based on the size of the villa.  These are two separate fees for two separate events. The fees are associated with your deposited Interval International week and the fees for usage of your bonus week that you receive with each Interval International deposit.  These fees are not combined.  They are separate fees depending on which Interval exchange option you want to use.  The fees for exchange travel are specifically covered in your ownership documents.
 
We understand how there may be misunderstandings in terms and conditions given verbally; therefore we cover everything thoroughly in our documents and disclosures.  We know that you are given a large amount of information.  That is why we legally allow you seven days to read your contract after the date you signed.  If you wanted to cancel within that time you had the right to do so.  Included in your documents were specific procedures on how to utilize your vacation ownership, as well as directions to cancel that same ownership.  The instructions are specific that it must be done in writing within the defined timeframe.  Unfortunately, since you have passed your legal rescission period, we cannot simply cancel your contract.
 
As for your request to terminate your contract and a refund of the funds paid for your deposit, it is not Welk’s policy to cancel contracts that have passed beyond the rescission period required under California law. 
As stated in my previous communications with you, I do not have a contract rescission option for your ownership commitment.  Welk does not have a “take-back” program that would allow you to simply return your ownership to Welk.
