An investigation
of this matter
indicates that Midland Credit became the servicer of the
above-referenced account on behalf of purchaser, Midland Funding LLC (“Midland
Funding”), on May 14, 2012.
Information provided by the seller, *** *** ***, at the time of acquisition indicates this account
was originated on March 10, as a ** *** *** and
*** *** account number ending in ***
in the name of *** ***, under the last
four of the social security number ***. Subsequently, the account was charged-off as
an unpaid delinquent-debt on October 7, 2011. The balance at the time of purchase was $825.70. Final payment on the account was received by
Midland Credit on February 6, 2014. *** *** has no further financial
obligation for this account
*** asserts that Midland Credit has updated the dates on his consumer credit
files to reflect this account as new. Please
note that Midland Credit furnishes information on the accounts it acquires
based on the business records maintained by the original lender/seller, and the
payment history of each individual consumer.
While Midland Credit is pleased that it was able to assist *** *** in
reaching a resolution which resolved the balance for the above-referenced
account, it is Midland Credit’s policy to furnish accurate account information. A review of Midland Credit’s business records
indicates that it is accurately furnishing information for the above-referenced
account as “Account paid in full, was a
collection account.”
Midland
Credit has no control over the manner in which each credit reporting agency
decides to display information which is furnished to them. *** *** is encouraged to communicate
directly with the credit bureaus should he have any further concerns. Based on the law and guidelines governing
credit reporting, it would appear that the account information being furnished
is accurate. In addition, if *** *** obtained
his credit report from a compilation source, the information being reported may
appear to vary. The credit bureaus have
advised that it appears this way because they do not directly populate the
fields on credit reports pulled from any source other than directly from the
credit bureau itself

An additional review of Midland Credit's business records does not indicate there was a conversation with *** *** last year in which she requested calls to cease, in fact, Midland Credit did not dial the above referenced phone number prior to January 1, *** ***’s phone number has been added to an exclusion list to prevent it from being called in the future regarding the referenced account

As stated in Midland Credit’s response to Mr*** Consumer Financial Protection Bureau (“CFPB”) complaint, when a creditor "charges off" an account, it means that the creditor no longer believes the consumer will pay the bill and has written the debt off of its books. Often, they then sell the debt. Please note that the underlying promissory obligation remains valid, due and owing. Just as the original creditor had the right to legally seek repayment of the promissory obligation, the new third-party purchaser has the right to repayment of the credit account. A copy of Midland Credit’s previous response which includes the response to the CFPB and the validation documentation is again enclosed, along with a copy of the bill of sale verifying Midland Funding as the rightful owner of the account. A copy of a seller data sheet confirming the account was included in the purchase from the seller is also enclosed. Mr*** indicates that he contacted Midland Credit in an attempt to resolve his concerns but was unsuccessful. Please note that Midland Credit has no record of receiving any calls from Mr***. However, Midland Credit does have record of receiving notices of dispute through the credit reporting agencies where the first notice of dispute was received on February 11, 2017. In response, Midland Credit mailed Mr*** a letter on February 27, 2017, acknowledging his dispute and advising that it had opened an investigation regarding his claim
When verification information was received from the seller, a copy was mailed to Mr*** on March 20, 2017, and an additional copy is enclosed. An investigation of this matter indicates that Midland Credit became the servicer of the above-referenced account on behalf of purchaser, Midland Funding LLC (“Midland Funding”), on October 1, 2015. Information provided by the seller, *** ***, at the time of acquisition indicates this account was originated on January 9, as a *** ***/Care Credit card account number ending in ***, in the name of *** ***, under the last four of the social security number ***. Subsequently, the account was charged-off as an unpaid delinquent-debt on August 19, 2015. The balance at the time of purchase was $790.62.
Ms*** expresses a concern that Midland Credit representatives have previously called her “*** ***” on multiple occasions. Ms*** states that the account is now appearing on her credit report with the name “*** ***,” and she wants to it to be removed from her credit report due to the inaccuracy. She further states that she sent a complaint and never received a response.
As advised above, the referenced account was originated in the name of *** ***. Please note, Midland Credit does not alter or modify any of the original account information provided by the seller, such as the name of the consumer, the date of origination, or the date of occurrence. Midland Credit furnishes account information on the accounts it services based on the business records maintained by the original lender/seller
Midland Credit received an email from Ms*** on January 10, 2017, indicating that she wanted the item removed from her credit report, but would otherwise work with Midland Credit to resolve the account if her named was corrected. Midland Credit did not have enough information at that time to address Ms*** concerns, and the account was referred to a specific Account Manager to assist in resolving Ms*** concernsHowever, due to an administrative oversight, Ms*** was not contacted. Midland Credit apologizes for any inconvenience caused to Ms***
In keeping with its Consumer-First policy, Midland Credit made the business decision to close the account. There will be no further collection activity, furnishing of account information to the credit bureaus, or sale of this account. In addition, the three credit-reporting agencies have been notified to delete Midland Funding’s reference to the collection account in question from Ms***’ consumer credit files. The account in question was assigned to the law firm of *** and ***, *** (“*** and ***”) located at * *** *** *** ** ***. Their phone number is ###-###-####
Ms*** expresses a concern that a judgment not belonging to her is reporting on her consumer credit files. Ms*** also express a concern that *** and *** was unable to assist her with the incorrect reporting of a lien. An investigation of this matter indicates that Midland Credit is the servicer of an account belonging to another consumer with the same name as Ms***. Please be advised that at the time Ms*** contacted *** and ***, they were no longer servicing this account, as it had previously been returned to Midland Credit. *** and *** has been instructed to send Ms*** a letter that confirms she is not the party against whom the judgment in the above matter was entered
Please note that the judgment is not reported by Midland Funding. Rather it is being reported by the credit reporting agencies as a matter of public record. When Ms*** receives the letter from *** and *** that confirms she is the wrong party, she is encouraged to furnish this letter directly to the credit bureaus and advise them that the judgment is not against her
