Tell us why here...Dear Ms***:Thank you for your follinquiry regarding Ms***’s complaint, which Midland Credit Management, Inc(“Midland Credit”) received October 20, Midland Credit is the servicer of the above-referenced account on behalf of the current owner, Midland Funding, LLC (“Midland Funding”) Midland Credit appreciates the opportunity to answer your questions.Ms*** continues to express a concern that the debt is time-barred and indicates that the debt can no longer be collected As advised in Midland Credit’s previous response through your office, the statute of limitations on the debt has expired However, the expiration of the statute of limitations does not render the debt invalid While Midland Credit may no longer be able to initiate legal action in the matter, the above-referenced account still remains collectible, due and owing to Midland Credit as servicer for Midland Funding.Ms*** writes that the time for collecting on a debt starts from the date the account originated Please note, both the statute of limitations and the Federal Reporting period for an account are calculated based on factors such as the date the account first became delinquent Midland Credit’s business records indicates that the seven-year Federal Reporting period for the above-referenced debt has not yet expired. Thank you for your follletter inquiry regarding *** *** complaint, which Midland Credit Management, Inc(“Midland Credit”) received October 7, 2015. *** *** has filed similar complaints through the Consumer Financial Protection Bureau (“CFPB”) and Office of the Attorney General, State of California (“AG”)A copy of Midland Credit’s responses to the AG and CFPB, in additional to Midland Credits previous response to the Revdex.com are enclosed. Please note, Midland Credit provided all of the account identifying information in its previous letter response to your office dated September 25, 2015. Midland Credit appreciates the opportunity to answer your questions
*** *** asserts that Midland Credit failed to respond to her written request for validation dated July 11, *** *** also includes a copy of a written correspondence and a copy of a certified return receipt. As stated in its original response, Midland Credit became the servicer of the above-referenced account on behalf of purchaser, Midland Funding, on May 25, 2012. This is nearly months after the date of the letter *** *** claims she sent requesting validation on this account. Additionally, nothing in *** ***’s response to the Revdex.com shows that the letter and the return receipt were a part of the same package. There is also no way for Midland Credit to determine whether or not the return receipt belongs to any letter sent by *** *** as there is no name associated with it.
To that end, Midland Credit is also the servicer of an additional account belonging to another individual with the same address and last name as *** *** (account number ***), which Midland Funding acquired, and Midland Credit began servicing on June 23, Midland Credit’s business records for that account show that Midland Credit received a certified letter from that individual on July 11, 2011, requesting validation and that they no longer be contacted regarding that account. It appears the return receipt which *** *** has attached to her Revdex.com complaint was associated with this letter
*** *** also continues to assert that she has made several attempts and follrequests for validation, and that Midland Credit has also ignored these requests. A review of Midland Credit’s business records indicate that it received the first written request for validation from *** *** on April 11, 2013. Due to the “Cease and Desist” request in *** ***’s correspondence, Midland Credit was unable to respond at that time, and no additional correspondence has been received prior to *** ***’s complaints. Following receipt of *** ***’s first complaint through the Revdex.com, Midland Credit obtained verification information from the seller. A copy of the verification information is enclosed for *** ***’s recordsA review of Midland Credit’s business records indicates that the account information it is furnishing to the three major credit reporting agencies is accurate

Ms*** writes that there is no signed contract with Midland Funding or its servicer, Midland Credit. Consumers are sometimes unclear as to what the term “charge off” means for a debt. When a creditor "charges off" an account, it means that the creditor no longer believes the consumer will pay the bill and has written the debt off of its books. Often, they then sell the debt. Please note that the underlying promissory obligation remains valid, due and owing. Just as the original creditor had the right to legally seek repayment of the promissory obligation, the new third-party purchaser has the right to repayment of the credit account. The above-referenced account remains collectible, due and owing to Midland Credit as servicer for Midland Funding
Ms*** also expresses a concern that she has never done business with Midland Funding and that she is not liable for this debt from the above-referenced account. On August 8, 2014, Midland Credit mailed Ms*** a validation letter. Please note that the letter was mailed to Ms*** via the United States Postal Service. The letter was not returned as “undeliverable,” satisfying the notification requirements of the Fair Debt Collection Practices Act (“FDCPA”). In that letter, Midland Credit provided the required disclosure of rights set forth in the FDCPA.
A review of Midland Credit’s business records indicates that it received a notice of dispute from the credit reporting agencies on May 6, 2016. Although verification information provided by the seller was mailed to Ms*** in response to her dispute on May 25, 2016, a copy of that documentation is again enclosed for her records. Please note that the verification information provided by the seller meets the requirements of the FDCPA. The original contract, complete payment history, and a full set of billing statements are not required under the FDCPA. Additionally, Midland Credit’s business records indicates that the account information it is furnishing to the three major credit reporting agencies is accurate

Ms*** expresses concern that when she contacted Midland Credit to discuss the account, she was told she owes over $1,200.00, but that she never had a card with such a credit limitWhile the credit limit may set the maximum amount of credit given to a consumer, additional interest and fees charged by the original creditor are allowable by law. Ms*** further writes that after setting up a plan and making two payments, she received a letter indicating that the settlement agreement she had reached would not resolve her account, and ultimately cancelled payments. Midland Credit apologizes for any confusion the letter caused for Ms***
Additionally, Ms*** states that she left voice messages but never received any return calls. Please note that Midland Credit has strict guidelines that its representatives must adhere to when leaving messages. This policy assists in preventing the inadvertent disclosure of private consumer information to third parties. Due to these restrictions, no messages were left during attempts to return her calls
A review of Midland Credit’s business records indicate that the payment arrangement was to pay $in February 2017, and five additional payments of $each month until July 2017. In keeping with Midland Credit’s Consumer-First policy, and to provide the highest level of consumer satisfaction, Ms*** account has been referred to Account Manager *** ***. indicates that the seven-year Federal Reporting period for the above-referenced
account expired in March 2017. Accordingly, the three credit-reporting

Miss *** writes that there is no signed contract, nor have they received services from Midland Funding or its servicer, Midland Credit. Please note, Midland Funding does not issue credit. As indicated above, the account originated as a *** *** *** *** account. When a creditor "charges off" an account, it means that the creditor no longer believes the consumer will pay the bill and has written the debt off of its books. Often, they then sell the debt. Please note that the underlying promissory obligation remains valid, due and owing. Just as the original creditor had the right to legally seek repayment of the promissory obligation, the new third-party purchaser has the right to repayment of the credit account. The above-referenced account remains collectible, due and owing to Midland Credit as servicer for Midland Funding
Miss *** states that Midland Credit has failed to provide adequate proof. A review of Midland Credit’s business records indicates that no correspondence was received directly from Miss *** prior to the complaint filed through your office. A further review of Midland Credit’s business records indicates that it began receiving notices of dispute from the credit reporting agencies on June 12, 2016. In response, verification information provided by the seller was mailed to Miss *** on June 29, 2016. A copy of that documentation is again enclosed
