RE: THE [redacted] COMPLAINTDEAR [redacted] ,We are responding to the [redacted] Complaint dated 07/01/First, we would like to again state that did not receive this complaint until you emailed to us directly in January 2017,Mrand Mrs [redacted] contracted us to install a driveway at their home in Two years later, in 2014, they complained that their driveway was crumbling, We have attached a copy of the original contract for your use and reviewFirst of all, we do not offer any warranty on our concrete work, it is very difficult to warrant any concrete due to the numerous variables that can adversely affect the integrity of the concreteWe have attached a copy of the signed proposal that states "There is no guarantee that concrete will not crack, spall or chipConcrete contains waterWhen it dries it shrinksContractor will install wire mesh to help prevent any cracking.” I must remind you that two (2) years after we installed the driveway, the [redacted] started to see the surface crumbleTwo (2) years after we installed the driveway, we visited the project area on numerous occasionsWe hypothesized that the material supplied by [redacted] was defective or that excessive road salt had destroyed the surfaceWe invited representatives from both [redacted] ( [redacted] ) and the Portland Supplier [redacted] )After a site visit, [redacted] assumed liability for the defective materialAt that same time, [redacted] agreed to supply new material at no cost for the reworkThey would not reimburse us for the demolition, any labor, wire mesh, trucking, stone and use of our equipmentWe attempted to file a claim with our insurance company and were deniedWe did not receive any insurance money for this rework projectThe fact the [redacted] stated that we ran away with the money is extremely offensive, We could not afford to incur all of the other costs, as listed previously, to complete this rework projectWe verbally communicated this to Mr [redacted] In March of 2015, we formally offered to split the rework costs with the [redacted] in a proposal dated 03/01/Apparently, the [redacted] did not approve of our offer because here we are almost five (5) years later.Please note, we had discovered and resolved this same "defective material” issue on other projectsThe other customers agreed to work with us and split the costs of such rework.Our offer as stated in the 03/01/proposal still standsWe would like to complete the rework and split the costs with the [redacted] This proposal price will have to be adjusted for inflation, we would like to move forward as we proposed two (2) years agoShould you have any questions or concerns, please do not hesitate to contact us; we are eager to resolve this issue.Thank you for your time and consideration.Leslie [redacted] S [redacted] President

Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this does not resolve my complaint For your reference, details of the offer I reviewed appear below.We have not been contacted by Westmoreland Concrete with an offer We received a response from the Attorney General with a preliminary proposal that was reasonable but it was not adjusted for inflation The Pennsylvania Attorney Generals Office called me this morning They received an email from Westmoreland Concrete asking why we did not contact them It is our understanding that we are to get a proposal from Westmoreland Concrete first and that has not happened The Attorney General said they would get in touch with them to help move things along We are waiting for a response form the Attorney General or Westmoreland Concrete.We believe Westmoreland Concrete is acting in good faith and there is a communication problem Hopefully, this matter will be resolved shortly Feel free to forward our response to Westmoreland Concrete We would like to get the matter resolved as I am sure they would Regards, [redacted]

We appreciate the [redacted] 's written response to our correspondence We do not have record of the [redacted] 's phone calls or voicemail messagesWe are unable to refute the [redacted] 's claims that unanswered phone calls and messages exist We assumed that the [redacted] did not want to proceed with the proposed re-work because the offer was not FREE We assumed that they had received the proposal and did not not want to proceed We could not have offered to do the "repair" work totally for free The concrete and cement supply companies [redacted] and its supplier) assumed liability for the defective product that they sold and supplied I agree that we said that the product portion of the proposed rework would be free This is why we offered to split the costs of the rework with the [redacted] 's To clarify further, the actual costs of the rework is double that of the proposal that we sent to the [redacted] 's in March 2015, thus we would incur the same expense as the [redacted] 's I need to repeat a point that we stated in our first response: We could not and still cannot afford to absorb all of the costs associated with the numerous re-work projects that resulted from the defective product that [redacted] supplied I also need to repeat another point that we made in our first response: We offered other customers the same proposal that we offered the [redacted] 's and they agreed to split the costs with us Two years ago, we installed new concrete for all of the customers that split the rework costs with us We don't know what more that we can do to appease the [redacted] 'sWe visited their project, we have answered phone calls, and offered to replace that driveway at a reduced cost It has been years We respectfully request that the Revdex.com help us resolve this issue We are also in communication the Attorney General's office regarding the [redacted] 's complaintWe have offered the response the the Attorney General as we have to the Revdex.com We are anxious to help the [redacted] 's, but we need the [redacted] 's to meet us half way We will be able to adjust the March proposal for inflation, and start the rework as as soon as the weather and our schedule permits

Terrible experience with Westmoreland Concrete The concrete surface started to flake within years Mike S [redacted] (the owner) promised to fix the problem several times over a year period and never showed up Rude, untrustworthy and does not honor their guarantee

We are disappointed that the *** have not accepted our very generous offer We have attempted to meet them half way even though *** *** and its supplier have accepted responsibility for the defective product We are hoping that the Pennsylvania Attorney General's Office will help us resolve this matter We appreciate the Revdex.com facilitation of communication, but it seems the Revdex.com has not been able to help us up until this point

home in 2012. Two years later, in 2014, they complained that their driveway was crumbling, We have attached a copy of the original contract for your use and review. First of all, we do not offer any warranty on our concrete work, it is very difficult to warrant any concrete due to the numerous variables that can adversely affect the integrity of the concrete. We have attached a copy of the signed 2012 proposal that states "There is no guarantee that concrete will not crack, spall or chip. Concrete contains water. When it dries it shrinks. Contractor will install wire mesh to help prevent any cracking.” I must remind you that two (2) years after we installed the driveway, the [redacted] started to see the surface crumble. Two (2) years after we installed the driveway, we visited the project area on numerous occasions. We hypothesized that the material supplied by [redacted] was defective or that excessive road salt had destroyed the surface. We invited representatives from both [redacted] ([redacted]) and the Portland Supplier [redacted]). After a site visit, [redacted] assumed liability for the defective material. At that same time, [redacted] agreed to supply new material at no cost for the rework. They would not reimburse us for the demolition, any labor, wire mesh, trucking, stone and use of our equipment. I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below. Because they would not return our repeated calls we recently contacted the State Attorney Generals office to help resolve this issue with the contractor.  They finally responded to the Attorney General within the past week.  This is after they promised to fix the problem four different times at no cost to us over the course of two years.  It appears the only reason they responded was the threat of the Attorney General being involved.We did not see the proposal they attached in their response to you until last week.  Who knows when it was actually typed?  We never stated they ran away with the money.  We said they may have taken the money because we had no evidence that their insurance claim was denied.  When they finally verbally said they would repair it but at a cost to us it was over two years (and four broken promises of repair at no cost) since the original complaint.  As you can see they ignored your letters for over six months.  We are still in contact with the Attorney General and trying to see how to proceed.This issue has not been resolved. Regards,[redacted]
