This complaint is against the *** location - not ***, but *** is not listed. Years ago I joined Wow. The staff is nice. The gym is clean enough. I moved to *** and there is no wow there. I was told I can cancel in writing and because there is not a wow near me my contract would be broken. I left a letter at the desk on my last day. Years laterI was told that I was pst due. I was outraged. I was told I need to cancel in writing and delivery need to be verified. I sent the cancelation letter with tracking. A few days later I was contacted by the *** location and the gentleman (very nice young man) told be that the accountant wanted him to tell me that they received my letter, but because it wasn’t certified they won’t cancel my membership and I will continue to get charged. I was dumbfounded. The purpose of a certified letter is to verify that it was received, correct? So I have a tracking number that verifies delivery, and a personal phone call verifiying that the letter was received, but they are refusing to honor it and will continue to charge me based on a technicality of certified or not? Even though the underlying purpose of a certified delivery (confirmation of receipt) is met? I have canceled gym memberships in the past without any issues. This is incredibly unethical. Workout enthusiasts beware - it’s worth a drive to *** - cleaner, affordable, better trainers and better classes!!!!

I signed up because it's right down the street from one of my businesses, and a few other locations are near other businesses that I manage. Also wanted to try it out before launching an employee gym membership progran. Unlike other people I will not judge the place Because it's unorganized, after all it's a gym and a lot of people go in and out. However, I had the membership for 2 month went twice. The first time I went no one asked for ID, the second time we assumed that they don't check ID so we didn't need to go back get ID since my gym partner forgot His.

When I asked to cancel my membership I was informed that I will be charged again on the 14 of the following month, which I said I wouldn't pay and will put a stopped payment for your business on my account. I was informed that I will be placed on collection (made me laugh, cause I do not owe you) which I told her, I was glad to hear that I am nicthing about $40. It's principle if your own staff can't enforce your rules and change them when they feel like, how you expect others to follow them?
SIDE NOTE...not every black men that walk in your building is a delinquent, no matter what you *** preference is. If I bother you by coming to your business maybe you shouldn't give me a membership.

I have two sons, one signed up for WOW and the other never entered the building despite signing him up also. The have been a member for a while now but both live away at college. I walked into the WOW fitness center to ask for the membership to be cancelled, since both are living away at college. I was told I needed to put it in writing and mail it in. I sent a certified letter with confirmation that they received the letter. As of today I am still be charged for the membership. On 10/19, I was charged $82.95 and on 11/1, I was charged $10.64. Why am I still being charged? I have completed the letter as requested. Both boys are no longer in *** and away at college.

This member sent in a Certified Letter received 10/15/18. As per their contract, the processing time is 30 days and they were cancelled on 11/12/18. WOW Cancellation Policy available on our Website is:

If your 12 month contract is up: You may cancel your membership by sending a certified letter to the gym location in which you initially joined stating your intent to cancel. Please include your name, address and phone number to verify your account with our records. You are responsible for the dues in the month in which you cancel plus the following month, during which you may use all services included in your membership.

All charges are appropriate - dues for October & November that include the 2 Enhancement Fees of $39 plus tax as per their contracts.

FREQUENTLY ASKED QUESTIONS

Why do I have to pay for an additional month when I cancel? As stated in your original membership agreement, you are responsible for the dues in the month in which you cancel plus the following month. We work with an outside billing agency that requires 30 days for any changes to your membership to be applied. You may continue to use the club during this final month.

Why do I need to cancel at the club where I initially joined? The club location where you initially joined is considered your home club. Any membership changes can only be processed at your home club as this is where your membership information is stored.

Why do I need to send a cancellation letter certified?We require that you send a cancellation letter certified to prevent any delays from processing your cancellation. When you send a letter certified, you receive a receipt from the post office that the club received your letter, providing you with assurance that it was processed.

What proof do you need that I have moved in order to process my cancellation? We require a piece of mail that has gone through the postal system with your name and new address on it. Examples include bills, junk mail, etc. You may also provide us with a copy of a lease or mortgage or a copy of your driver’s license as proof of your relocation. A change of address with the post office is not sufficient information to cancel.

Why was I charged for more than 12 months? As stated in your membership agreement, your membership continues on a month to month basis after your anniversary date. As a month to month member you may choose to cancel your membership at any time and you will be billed for the month in which you cancel plus one more month.

Will I be billed the maintenance fee when I cancel? As stated in your membership agreement, if your maintenance fee is payable during a month in which you are billed for dues, you will also be billed for the maintenance fee.

There is no mention of an enhanced fee charge of $39 x 2.

I am rejecting this response because:

First response states: that the enhancement charge was on the website under termination of contract. IT WASN'T. My last response included the website's policy on termination of contract. This response now states it was in the contract. Which is it? Why does the response keep change. I do not appreciation dishonest companies. At this point, I will reluctantly pay the enhancement fee, so I do no have to deal with the company, which I no longer have any respect for.

Upon signing up for the gym I was told that I get one free training session. I trained with the physical training manager who spoke with me about purchasing a package. I expressed hesitation becaus I did not wish to commit to three months or 24 sessions. I told him that I had worked with trainers before and that I need to be sure that they are knowledgeable about the body since I have a *** injury. I didn’t want to be contracted into working with a trainer that wouldn’t be conscious of this injury. He gave me an email address *** and told me that all I had to do was sent an email before the next payment was due in order to get out of the contract. When I sent this email, the person who responded told me that no one would ever tell me such a lie. I had three days cancel and now those three days are up. He told me no one would ever lie to me and that I cannot get out of the contract unless I paid all three months upfront. He also told me that they have lawyers who draw up their contracts in compliance with *** state law. Now I’m stuck becaue I was given false information.

I would like to withdraw my complaint, I have resolved the issue with the business.

I tried to cancel my membership and was advised that I could not unless moved 25+ miles from the gym. When I had signed up, I was advised that I could cancel at any time through the appropriate manner; sending certified letter. Which I did but was still denied. I then asked for a copy of my contract. The first person I spoke to told me to call back in the morning to speak with the manager. I called and spoke to the manager someone claiming to the be the manager who advised that the only person that could provide a copy of the contract was the accountant. I asked for the accountant's name and contact information which was not provided but I was told I could call back the following afternoon to try and catch the accountant. When I asked what time he would be in, the manager advised that he did not know as the accountant makes his owns hours. I asked how I was supposed to get a hold of this person if they had no idea when he would be in. I was told to keep trying. I asked for an email address for the company which I was given *** to which I have emailed a request for a copy of my contract sent on 3/27/18 at 8:21 am to which I have not received a response.

This member, *** joined on 8/16/17 with 2 other members for a *** for 3 people. *** is the primary member who is billed for the dues. *** paid the dues from 8/16/17 until 10/20/17, then was delinquent until March, 2018 when she started paying our Collection Company. The balance owed now is $20.64. The account is still active because she has not completed her contact year that she signed for. The contract she signed and initialed explains the 1 year obligation as does our Website that all members have access to and a member e-mail that members can send their questions or concerns to. Only a relocation or a medical problem is acceptable to terminate in less than their year. The anniversary of her contract is 8/16/18 and she cannot cancel until then.

When *** joined , she received a copy of her contract. *** can come into the *** gym and our Manager Alan or Gabby will give her a copy of her contract.

I responded to a Complaint today ID #*** and directed *** to go to WOW *** for a copy of her contract. Please inform her not to do that but to call WOW at and ask the General Manager of *** Bryon to arrange to have a copy of her contract at the *** WOW where she has her membership for her to pick up. He will call her when he has the contract. They are not stored on site.

I gad sent a certified letter to the gym in the end of October/early November canceling my account. I had moved a thousand miles away to ***. Since then I got out into collections and get harassing phone calls. 8 tried contacting the *** gym, for 2 days they did not answer their phone so I called the *** gym. Staff was very rude. I fight with them over the phone for about a week and then I get a call back saying all accounts arecanceled. Then I get charged again the next month, I reached out to 3 different *** employees and all lied and said I was canceled or could not help me, they deny to let you speak to anyone in upper management or billing. Also sent 2 emails and they were not responded to. Finally march 30th I spoke to allen who insured me he would look into the problem and call me back monday. He never did. I called Wednesday and he said he didn't call me because nothing had changed. Said I will be canceled as of april 15th, I don't believe them because it could not be done instantly. Also this entire time I was fighting them they knew I had moved, they had my *** address which is literally a thousand miles away in their database the entire time. In their policy it says you will be canceled if you move more than 25 miles away. I want this resolved. They force customers to comply with their policy but bend their polocy for themselves. I am sick of the nasty rude behavior of employees on the phone and non compliance and lack of care from upper management

This is another issue of a member not complying to the requirements of the contract they sign. We cancel contracts only with Certified Letters that are signed by the member when they send it and by us when we receive it. The proof is in the receipts. We have no record of a Certified Letter and asked for a receipt which the member does not have. That is the only means of avoiding these issues and this member has refused to get us the receipt or a Certified Letter and keeps calling with threats like this complaint and legal action.

We have e-mails going back and forth as below and this is our final response. Her account is still active, we have no record of a Certified Letter nor proof of relocation that is required by by her signed contract. She has a balance of $93.81 and cannot produce a receipt of any Certified Letter. She joined this year and her response is she did not keep the receipt. This is why we insist on a mutually signed Certified Letter. If she is willing to pay her current balance of $93.81, we will cancel her account early with no further billing without the letter and proof of relocation.

We do not solve issues on the telephone. We have no record of a Certified Letter, the only way to cancel and a contract requirement. You must provide us a copy of your Certified Letter receipt which you sign for when you sent it.

I am pleased with the monthly cost and that classes are offered at the *** location. Once I received my key tag I asked where things were - the blonde behind the counter stayed behind the counter and pointed "cardio" "weights" "classes" and that was my tour. Okay, fine, not great customer service, but I can figure it out it doesn't take a genius. Then I went upstairs to the cardio area and was taken back by the amount of dirt and grime on the machines! It is disgusting! I've never seen such a dirty gym before and I've been to many. There is gum, literally stepped on gum on the ground, there are stains all over the carpeting under the cardio machines that I can only guess is sweat. I took a class and there was literally water dripping from the ceiling - it wasn't raining or snowing. The bathrooms are even worse - the floor is uneven & missing tiles and the sinks are stained with crud in the caulking areas I guess this is the reason for the lack of tour before signing their contract? P.S. The workers do nothing but sit behind the counter on their phones. This facility is taking advantage of customers who are looking to improve their health at a reasonable price and hide behind the fact that they are low cost and therefore you get what you get. This is not just a no frills wear and tear gym - this is a major health problem. Absolutely disgusting and of course what can you do when you're locked in for 12 months. Just awful - owners should be absolutely ashamed with themselves.

I signed up for this "fitness center" over a year ago, three months into my membership I got a job that made it difficult to attend this location so I called and tried to cancel my co tract. I was told by their personnel that I needed to pay out the rest of the year and my contract would end. Now we are three payments into the new year and they are still billing me and they tell me I need to talk to their Billing company. So I call *** and *** sends me right back to the gym that I signed up in saying they can't help me. I finally told them that I was frustrated and someone needs to cancel my contract. The gym personnel told me only then that I need a certified letter and they will process it within 40 days. Meanwhile I have not attended the gym in 301 days. This is absolutely ridiculous.

In June we stopped in at wow to cancel our membership. We were told we had to send a letter to cancel. It seems absurd as I was standing right there. We sent a letter. It is now October and I am still being charged. I called again and am now told I need to send a certified letter. This is not the way to run a business. I was charged 80.00 this week for some type of fee and will probably be charged again in November before I can get a certified letter out and resolved.

This is another case of a member refusing to respond to the requirements of her contract. Our cancellation policy is in her contract and on our web site as follows:

I personally instructed Darnell P how to instruct members to cancel and if they still had a problem to send their concern to our member e-mail. *** did not respond to the instructions and just put in a complaint to the Revdex.com.

Her Accounts are still active, #*** and #*** and will remain active until we receive a Certified Letter from *** as per her contract.

I joined under their "No Fee, cancel anytime" membership. At the end of one year, I cancelled my membership on September 4, 2017 exactly as instructed, by certified letter. I paid for the month that I cancelled (September 2017). The instructions indicated that I would be charged monthly dues fro the next month because it would take time for automatic billing to catch up. So, I was charged monthly dues on October 5th as well. Then, a full 6 weeks after I cancelled my membership, I was charged an additional $83 for yearly "Maintenance Fee". I disputed this charge by phone but was told that since they took out dues in Oct (30 days after I cancelled) that I would have to pay for next years Maintenance fee. I believe this fee is unjustified since it fell well beyond the 30 days notice POST-Cancellation.

The Enhancement Fee billed to *** was properly billed in October the month following her cancellation. The fee which is part of the dues and contract that each member signs is not for the next year, it is an annual fee billed to every member each year of their membership that we apply to keep the equipment for our members second to none.
