The Buyer and I are at an impasseMy business sold 2- Chilean Palm Trees for $64,including delivery to *** **on 5/13/The terms of the sale were as follows: 25% deposit to hold the trees25% due days prior to delivery
and the remaining 50% due at deliveryThe Buyer took years to pay the 2nd 25% due prior to delivery instead of the usual 60-daysIt was after that time that I insisted on a maintenance fee for caring for and keeping alive these very expensive treesIt took the Buyer more years to finally pay for the treesBut in the Buyer said that he was no longer going to pay for the maintenance fees and stopped making payments, expecting me to care for the trees that no one wantedI sent invoices with no responseNow more years later and the Buyer wants to act as if nothing unusual has happened and wants to pay a portion of monies owed to finally take possession of the treesAs I have explained to the Buyer on several occasions, pay what you owe and the trees will be ready for transportAs the cost of transport and the size of the trees has changed I am no longer able to transport the treesIf we end up in court I will also be seeking past interest on the trees which has been accruing for 8+ yearsThe Buyer abandoned the trees and left me with the responsibility of caring for the trees

Buyers Beware! This seller has been paid in full for the trees that according to his reply aren't even due until the trees are deliveredHe stated that 25% was due days prior to delivery & 50% due upon deliveryThey haven't delivered the trees but we have paid in fullWe did not say we were no longer going to pay for the maintenance fees we just turned the fees over to the client and they were to pay directly to the sellerHe has been paid an additional $10,for maintaining trees that have been growing naturally in a field in SacramentoWe have agreed to pay an additional $in maintenance fees
They have NEVER contacted us regarding any late payments or additional dollars due until we requested delivery of these treesHe is now trying to get us to pay an additional $47,for trees that have been paid for
He has never once complained about maintaining the trees, and he has cashed all checks sent to himHe has never once said we had to take delivery of these trees within a certain time frameThis was never part of the agreementAnd now if you read his response he is trying to charge us interest on our own money!

Sellers beware, be very careful selling palm trees to this landscape designerI sold him two Chilean Wine Palms in It took him years to pay 50% at which time he was to make arrangements to take receipt of the trees and pay the balance of $34,Instead this buyer sporadically sent me money for the next yearsI insisted on maintenance fees as I am not accustomed to holding sold merchandiseThis should have been a 60-day transaction instead of years! This buyer stopped paying maintenance fees in and was never to be heard from againNow years later this buyer has decided to appear again and is demanding the treesI said not so fast, we have some past due monies that need to be paid which now include storage feesI essentially had to impound the trees for non-payment of maintenance feesMy position is that the responsibility for the maintenance of the trees lies with the buyerThis buyer should have been more concerned about the trees he paid forHe has threatened to take me to court and I said go aheadIf we have to go to litigation I will be seeking back interest for the years it took this buyer to pay for these treesI do not have a lay-a-way plan such as WalmartThis was to be a 60-day transaction, not a pay as you go whenever and whatever amount you wantI have stopped responding to his threatening letters

This man is a liar and a dishonest business manHe now trying to blame us for his nonperformance per our contract and non deliver of our paid for materialHere are the factsWe never had any agreement on terms for time of delivery, he statement is a lieOur agreement in fact states the balance of trees will be due upon delivery, not 60-days, that is a lieHe managed to cash $10,of maintenance fee checks that he now states he did not have a "layaway plan" for usWe paid for the trees in full and offered to pay for the balance of the maintenance feesHe still will not deliver themHe is trying to extort more money out of usJust read his response and you will see what I meanHe wants "back interest" for years, on what the "back interest" on our own money we paid him or on the trees he still has, LOLDo NOT do business with him you will be sorryNever once did I get a call asking for us to take delivery of these trees while he was cashing our checks for maintenance, never once did I get a late notice from him asking us to pay our bill until we asked for trees to be deliveredHe has been paid in advance per our agreement and paid in full for the materialAsk yourself how can someone "impound property" that has been paid for in full and never delivered? Read his response and do not do business with this company or at the very least do not pay until you receive your material for himI don't think his company is even registered with the Secretary of State in **from what my attorney says
