May 22, RE: [redacted] – Complaint ID # [redacted] Dear Ms***: Guardian Protection Services, Inc(“Guardian”) is in receipt of the above-referenced complaint from Mr***Guardian is a customer-focused organization and values the opportunity to address any question or concern Mr***’s letter expresses discontent with his sales transaction with Guardian and further requests that his account be cancelled as a resultGuardian has reviewed its records in response to Mr***’s complaint and offers the following in response Our records indicate Mr***’s initial transaction with Guardian occurred on February 20, at which time Mr [redacted] executed a Builder Division Sales and Monitoring Agreement (“Agreement”) in order to engage Guardian’s servicesThe initial term is designated as sixty (60) monthsMr***’s system was activated on March 7, A Notice of Cancellation form was also provided at the time of sale which served to document that Mr [redacted] received three (3) full business days to review and cancel his transaction with no further obligation Mr [redacted] asserts that he submitted the Notice of Cancellation form to Guardian within the designated timeframe to cancel his transactionGuardian conducted a thorough review of Mr***’s account including all telephone calls with Mr***(Please note that due to the nature of Guardian’s business, all customer telephone calls and interactions are recorded.) May 19, RE: [redacted] ***, Case # [redacted] Dear Ms [redacted] Thank you for advising Guardian Protection Services, Inc(“Guardian”) of the above-referenced complaintGuardian greatly values the opportunity to provide response and address Mr***’s concerns For background, please note that Mrand Mrs [redacted] originally met with Guardian in November to review products and services that were available for their new home, which was under construction at the timeGuardian presented various products and services for their consideration, after which Mrand Mrs [redacted] decided to engage Guardian to install electronic security hardware in their new home and provide 24-hour security monitoring servicesIn order to memorialize the specifics of their transaction with Guardian, Mrand Mrs [redacted] executed a Builder Division Sales and Monitoring Agreement (“Agreement”) on November 22, for an initial term of sixty (60) months commencing from the date of the activation of servicesMrand Mrs [redacted] acknowledged the term of the Agreement by affixing their initials beside the separate and bolded clause which specifically states, “This is a month monitoring agreement.” Mrand Mrs [redacted] also executed the Agreement by affixing their signatures at the bottom of the form Mr [redacted] disputes in his letter that he was informed of the initial term during his sales consultation with Guardian’s representativePlease be assured that Mrand Mrs***’s sales consultant is very aware of Guardian’s policies and procedures as they pertain to all aspects of the sales transaction and in no way sold the system under misleading circumstancesGuardian merely presented low-voltage upgrade options from which Mrand Mrs [redacted] selectedAfter making those selections, which are memorialized in writing and acknowledged by Mrand Mrs***, they were provided with three (3) full business days to review, alter or cancel their decisions with respect to any aspect of the transaction with GuardianMrand Mrs [redacted] did not alter or cancel the engagement of Guardian to provide and install security equipment and activate 24-hour monitoring services and therefore Guardian proceeded to fulfill its obligations as set forth in the AgreementIt should be noted that Guardian would not have provided, installed or activated expensive security equipment had Mrand Mrs [redacted] not elected to subscribe to Guardian’s 24-hour monitoring services Upon receipt of your letter, Guardian contacted Mr [redacted] directly to discuss his concernsDuring that conversation, Mr [redacted] expressed that Guardian’s sales representative promised a one (1) year initial termGuardian’s representative explained that Guardian does not offer a one (1) year initial term and perhaps Mr [redacted] had confused the initial term with the builder warranty which is either one (1) or two (2) yearsGuardian’s representative apologized for any confusion and explained that Mr [redacted] had thirty-six (36) months remaining in the initial term of his Agreement therefore he remains ineligible to simply cancelGuardian’s representative further explained that an early termination fee is required to cancel however that amount may be reduced in a genuine effort to assist Mrand Mrs***Guardian’s representative also offered to provide and install additional equipment, such as a keypad or window contactsMr [redacted] declined and stated he wished to move forward with cancellation Respectfully, Guardian has incurred significant cost by providing and installing expensive electronic security equipment with the expectation to recover those costs over the sixty (60) month initial termGuardian has not been provided the opportunity to recoup those costs and is therefore unable to cancel without payment of an early termination fee The terms of Mrand Mrs***’s Agreement allow for cancellation of the account prior to the end of the initial term by remitting payment of an early termination feeIn a genuine effort to resolve Mr***’s concerns, Guardian will agree to waive any collection fees and accept a drastically reduced early termination fee in the amount of $to cancel Mr***’s accountUpon receipt of payment of the sum of $581.57, Guardian will release Mr [redacted] from all remaining obligation under the AgreementGuardian believes the above offer to be fair and reasonable and is hopeful Mr [redacted] will concurThis offer is extended until close of business on June 16, after which it will be rescinded Thank you for advising Guardian of this issueShould you have any questions, please contact me directly at ###-###-####, ext*** Sincerely, Sharon G***, Credit Manager Credit & Collections Department
