Dear [redacted] ***, This letter is in response to your correspondence dated March 21, regarding complaint ID # [redacted] from [redacted] Vemma Nutrition Company is a direct selling company that markets dietary and nutritional supplements to customers through a network of independent distributors referred to as “Affiliates.” Affiliates are independent contractors eligible to earn weekly commissions based on their volume of sales Ms [redacted] joined Vemma on November 18, At that time she placed an order for a Verve Quad Pack On January 10, Ms [redacted] placed a second order for a Silver Builder PackGenerally people order the builder pack when they are interested in pursuing a direct marketing business with Vemma Ms [redacted] contacted Vemma Affiliate Services on February 19, inquiring about marijuana in our products Ms [redacted] was concerned about some of the ingredients used in Vemma products Ms [redacted] was advised that the Xylitol and Stevia sweeteners used in Vemma products comes from natural cane sugar, and the silica comes from the aloe vera plant Ms [redacted] called again on March 5, stating that there are documents and court findings stating that Vemma is causing harm to those that take itShe wanted to send everything she had back at our cost and get refund of all of her moneyShe was advised of Vemma’s thirty (30) day return policy and was offered free shipping labels for everything she was going to returnTo date we have not received any returns from Ms [redacted] Also, Ms [redacted] did call in on March 6, updating her autodelivery order scheduled to process on March Ms [redacted] did not cancel that orderTherefore she was charged a total of $for that product order Ms [redacted] ’s concerns from her March call were sent to Vemma’s Research and Development department She was contacted via email by Tammy Leeper on Thursday, March 06, and her concerns regarding Vemma’s products were addressed I have included an excerpt below from MsLeeper’s correspondence to Ms [redacted] : Chief Scientific Officer, [redacted] ***, M.D., Ph.D., manages facility operations and ingredient sourcingAll suppliers are vetted, GMP-certified vendorsOur raw materials are identity tested using scientific fingerprint analysis protocols and the Vemma formula is produced in a climate-controlled, ultra-clean filling room that utilizes positive air pressure and filtration to protect against microbial contamination and safeguard the nutrient quality of the productPharmaceutical-grade reverse osmosis filtration is used for the water supply which would effectively remove lead content from the water supply In addition all finished product is tested for purity and potency which includes heavy metals (lead, arsenic, cadmium and mercury) and found to be within the specifications set forth by the EPA and FDA prior to release to our consumers You may review testing results on our corporate website and I have included a link for your reference http://www.vemma.com/science/test-results.cfm We stand behind our products and our money back guaranteeIn accordance with our return policy we have sent to your e-mail address shipping labels for the return of your productUpon receipt and assessment of the returned product, you will be refunded the total amount, less shipping and handling, per our 30-Day Return Policy, found in the Vemma Policies and Procedures Please allow 7-business days, pending processing and approval, for the refund to be reflected on the statement associated with the credit card used for the original transaction We appreciate your patience in this matter We pride ourselves on world class customer service and we will be happy to offer a full product refund for any products Ms [redacted] wishes to return We appreciate the opportunity to respond and address your concerns If you have any questions please feel free to contact me at [redacted] Sincerely, [redacted] Legal Compliance Analyst Vemma Nutrition Company

When my husband and I were introduced to the product of Verve in [redacted] *** we of course were a little hesitant because of the unknown/unaware product and priceAfter sipping a couple of samples, we placed an order to experience the new drinkThe order was received timely in [redacted] My husband and I are admiring the tasty variety of the nutritional taste of VerveThis will now take place of his sugar loaded energy drinks and I don't mind spending the money for the product we experienced

Dear Ms. [redacted] , In response to Ms. [redacted] 's ongoing complaints, a full credit was issued to her on April 21, 2014 and this was documented in our reply to your associate, Britnee ***, on April 23, 2014 (see attached correspondence). Although Ms. [redacted] only returned her partial product order a full credit was given to her as a one time courtesy. In regards to Ms. [redacted] 's complaint regarding lead in our products, our Research and Development Department has already addressed this issue with her and provided her with information regarding the processes we have in place to ensure that we are compliant with all federal and state regulations. Ms. [redacted] states that she feels this is a triangular scam and while I have never heard this term before I am assuming she is referencing a pyramid, therefore we are providing the following information: Vemma was incorporated in September 2004 in the State of Arizona. Vemma’s parent company, New Vision USA, Inc. was established in 1995 by the Boreyko family and is a proud member of the Direct Selling Association. Both New Vision and Vemma strive to be good corporate citizens of the State of Arizona, and at all times comply with any and all applicable laws and regulations. Vemma is a direct-selling marketing company that markets its products through independent distributors known as “Affiliates.” To become an independent distributor, individuals submit a member application to the Company wherein they agree that if the application is accepted they will be able to purchase products from Vemma at wholesale and market the products to the general public. Importantly, there is no fee or cost to become a Vemma Affiliate. When a person becomes a distributor, he or she agrees to conduct the independent distributorship in compliance with Vemma’s policies and procedures, in addition to federal, state and local laws. A distributor may earn compensation in one of two ways as an Affiliate. First, when the distributor purchases the product at wholesale from Vemma and sells it to the general public, he or she retains any profit on the sale. Second, the independent distributor may be paid a commission on product sales directly or indirectly generated by the distributor. Those commissions are paid on product sales by the distributor and product sales by other distributors sponsored in to the distributor’s sales organization. Please note, no commissions are paid for sponsoring or introducing other people into Vemma. No distributor is obligated to participate in Vemma’s marketing plan. Also, if a distributor wishes to receive commissions under the marketing plan, he or she must certify that seventy percent of the products previously purchased have been used for business building purposes or sold to or consumed by end users of the products. I really enjoyed the products I received from this company. My friends promote them and I decided to order some products through them. It also helps that the products were very healthy. I received the products in 3 days at my doorstep. A side story: I went to the doctor with my friend who had Crohn's Disease a couple weeks ago, and the doctor actually told him to keep drinking the products because they were helping his health! Great company and good luck to all those who are making money in the company!

distributors referred to as “Affiliates.” Affiliates are independent contractors eligible to earn weekly commissions based on their volume of salesIn *** complaint it is stated that Vemma Nutrition Company has taken $out of her checking account twice without her authorization. In reviewing *** account information, the account was set up via the internet on February 13, 2015. At that time an order was placed for one Vemma variety pack, totaling $and a monthly autodelivery was established, scheduled to process on or about the 13th of each monthA second order was placed on February 24, for Vemma variety packs totaling $90.18, and a third order processed on March 13, for one Vemma variety pack totaling $50.08. On March 23, we received a call from *** ***, claiming that the credit card being charged for *** orders belonged to him and he wanted to cancel any future orders. Since the credit card belonged to *** the autodelivery was cancelled to assure no further charges. I have been unable to locate any other account under the name of *** ***.Vemma’s account numbers contain digits. The account that *** provided in the complaint states account “***”. As stated above, Mr*** was never a Vemma Affiliate, however on January 27, our records indicate that Mr*** called in and spoke with a Customer Service agent requesting to cancel the auto deliveryUnfortunately he wasn't able to verify the account information so the agent offered to postpone the monthly autodelivery until March which would allow Mror Mrs*** the opportunity to call back with accurate information to verify the account and make changesAt that time Mr*** became irate, advised the agent that he didn't have time for the verification steps and disconnected the callThe agent updated the auto delivery to quarterly to give him additional time to call in before the auto delivery would processUnfortunately, we never received any additional contact from the ***s therefore the order processed on April 19th and was shipped to Ms***Ms*** then contacted us on April 29th and cancelled the auto delivery.On May 28th I reached out to Ms*** and advised of the details in the situation also to let her know that as a onetime courtesy we'd be issuing a 100%credit for her most recent orderAt that time she apologized for the confusion and agreed that she was satisfied with the credit for her April order (see attached correspondence). All Verve tries to do is scam college kids into thinking they are going to makes hundreds of thousands of dollars by "selling" an energy drink, when in reality you're just trying to get people to sign up for a subscription to their company This company is pretty much a pyramid scheme and I'm sure it's only a matter of time before they get shut down Not to mention the brand partners always brag about Vemma being one of the top rated businesses on Revdex.com...makes me laugh every timeWhen talking to a Verve members, they just keep repeating the same useless "facts" and everything they say sounds pre rehearsed so they end up sounding like a bunch of tools and they never give any real answers WARNING stay away from Vemma it can and will infect your high school or college

distributors referred to as "Affiliates." Affiliates are independent contractors eligible to earn weekly commissions based on their volume of sales.In Mr***'s compliant he stated that an autodelivery order was processed after he cancelled it for two monthsMr***'s account was created on November 26, at which time a onetime order was placed and an autodelivery was created. The order processed on the November 27, December and January, February & March 26, April 27, May and June and July 27, We received an emailrequest from Mr*** from the email address***@***.*** on August 15, at which time his auto delivery was cancelled and no additional orders were processed.On august 22, Vemma Nutrition Company received chargebacks stating that the orders were not refundedWe disputed the chargebacks and were awarded the funds based on our evidence that Mr*** was aware of the order on his accountOn September 10, his account was terminated for fraudulent claims based on the chargebacks we received.To date, we have not received any product back on his account therefore to date we have not issued a refundAs a courtesy, we have processed a credit for Mr. ***'s June and July orders and he should see the credit within 7-business days and he will not need to return the product from these two months(June= $& July = $refund totaling: $195.40). This is a significant amount of product and generally only people who are interested in building a Vemma business order this pack. Per Ms***'s complaint she emailed us on April 25, to notify us that she wished to return the Affiliate PackPer Ms***'s admission she was already passed the day return policy, therefore she wanted to return the products under Vemma's buy back policy and resign her account.I reviewed the recorded phone call and unfortunately Ms*** was given inaccurate information by one of our phone agents relating to our buyback policyI believe that based on this misinformation Ms*** did not return any of the products, therefore she was not refunded for anything.Due to the inaccurate information that was provided to Ms***, we are expediting a full credit to her for order ***. I wanted to share my opinion on this company because I feel there are a lot of negative reviews on here from people who were/are still confused about what it is exactly they "brand affiliates" do #Based on hours and hours of research and talking to multiple people either involved or not involved I've come to the conclusion that, there are a lot of misinformed individuals that get into this company not fully understanding what it is that they are getting into once they make that decision to get involved You yourself first and foremost are a consumer of the product You just get compensated for sharing a product and or service that you have grown to love For instance, coffee for example, you go to starbucks and purchase a coffee and you love it......right? Right Well, what do you think your going to do next? If you like something you in turn are going to tell your friends, family, co-workers etc, etc, etc about how much you like it If any one of those people go out and purchase that same product you told them about, you just created a sale to starbucks Word of mouth advertising But, that company will not send you a check in the mail or a free coffee as a compliment for you generating a potential life long customer Vemma on the other hand does exactly that Your building two teams of "networks" of product going out on a month to month basis Thus, causing a residual "source" of income Besides the opportunity there are numerous health benefits attached to just consuming the products Helps with inflammation, energy levels, hair, skin and nail growth Just to name a few My mother who was diagnosed the M.Shas been on these products and have seen miraculous results, doctor/hospital results as proof Also, with and uncle of mine who has heart conditions So for me taking my time out writing this just as a testimony for someone doing their research on the company......please form your own opinion There's going to be positive and negative in anything you do or anyone does in life Just make sure your fully aware and driven towards your end result Not someone else's There are a lot people that come and go then want to blame their poor results because they "may" not have fully committed Don't look at someone else's success and assume it's going to be easy Everything takes time, effort and skill You have to become more to gain more To clear something up.....a lot of the negative have come from partners who have come in and gone and did not physically log into their back office to turn off their auto-delivery So because people have not done so, they were charged for their next shipment and became irritated with the company because they were charged again There are NO sign up fees, membership fees nor cancellation fees If you want out, you simply turn your auto-off and stop ordering product I hope this helped out

I am extremely satisfied with the quality and efficacy of the products, on-time delivery and customer service I have been using the products for a year and a half and will continue using the productsAnother strong reason is the scientific validation on the complete Vemma product and the new product offerings the company brings out each year I would strongly recommend this products to anyone
