Response:

Due to national security issues, the client in this matter has very strict guidelines for verification of identity. They still believe this consumer is the correct cardholder for this credit card chargeback. As we are at an impasse, AWA Collections will cancel the matter back to the client to pursue. The AWA tradeline will be removed from the consumer’s credit report, and a confirmation letter sent to him.

Please let me know if you need any additional information. Thank you for allowing us to respond in this matter.

AWA Collections

Review: I received a letter from AWA Collections in May of 2014. Shortly after receiving the letter, I called them letting the company know that I was unaware when the car accident claim would be settled, but that my attorney was waiting on a check for Medical Coverage from the insurance. I informed the individual I would make a call to my attorney's office, which I did after getting off the phone. After not receiving any further letters, or any phone calls from AWA Collections I was under the assumption that things were taken care of, until today, July 17, 2014, when my credit report showed this debt in collections. I contacted AWA Collections on July 17, 2014, with the intention of figuring out if by making a payment that same day the account would be removed from my credit report. Whomever I spoke with, would not get off the topic of the company "not holding liens." After not being able to get this individual to get off her rant on "not holding liens" or even being offered the ability to speak to the manager that I first spoke with back in May, I decided to inform the individual that I would not make a payment and did not care to see this account in a collection status on my credit report. This company did not send any further letters or contact me to let me know that no progress had been made after I in good faith let them know what was going on.Desired Settlement: AWA Collections needs to due the required steps prior to posting a collection account in a credit report. You mail letters, you make phone calls, I've done collections previously and worked with outside collection companies, there is proper steps to collect. I in good faith contacted them, explained the situation and never heard anything back. They also need to train employees to not be so stubborn and actually make an attempt to see how the issue can be resolved. If they dont fix the report to my credit score, fine by me, but follow up with a phone call or a second letter after someone contacts you.

Response:

Ms. [redacted] handled the matter directly with the client, and paid the balance. All information will be removed from her credit profile.

Review: August 4th, 2014, I called asking for information on accounts that I owe. I have been told by A W A Collections, “We will not give you anything in written form.” I have asked them to send a letter on what is owed, so that it could be paid off in full. At this time I have to assume these charges are not correct. From the information I currently have, it appears to be fraud or scam.

Myself, [redacted], have called 4 times. I do have these calls recorded, and they are lawful. Tennessee's wiretapping law is a "one-party consent" law. Tenn. Code Ann. § 40-6-303.

On the 4th call on August 4th, 2014, I have been told that I will get the information mailed to me. I have asked for this information before on January 6th 2014 and February 20th,. A W A Collections did not show the other two calls I made that on August 4, 2014. From this call, they are telling me they cannot get me the information in the five day deadline.

There were also many violation of the fare debt collection act. As amended by Public Law 104-208, 110 Stat. 3009 (Sept. 30, 1996)

1. Every collector must send you a written “validation notice” telling you how much money you owe within five days after they first contact you. (validation notice is done in written manor)

2. Give false credit information about you to anyone, including a credit reporting company.

3. (a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing --

(1) the amount of the debt;

(2) the name of the creditor to whom the debt is owed;

A W A Collections is the company that has reported this to the credit bureaus. Therefore, the proof of burden is on them. A W A Collections has been asked in the past about these debts, and have failed to provide the informatioDesired Settlement: At this time, [redacted], needs a letter from A W A Collections saying these debts are no longer owed and cleared this from his credit report. This is a fraud or scam.

Response:

This account was received on 2/8/2011 and the First Notice

with all of the required information was sent out on 2/9/2011. The five day requirement is for the initial letter, not the supporting details. A second letter

was sent on 5/23/2011, with the same information. They were mailed to [redacted] . (Complete address available.) On 1/24/2014, a payment of $25 was received

on this account. On 8/4/2014, the

consumer called AWA Collections wanting to settle the debt. He requested details, however, this medical client will only mail them

directly to the consumer/patient. The

details were requested the same day from the client. On 8/5/2014, AWA Collections confirmed with

the client that they had spoken to the consumer and mailed the details.

Letters were sent within the required timeframe, with the amount

of the debt, the original creditor, and all required verbiage. The consumer has been sent the validation

information from the client, to ensure this is not fraud or a scam. The account is reporting to the credit

bureaus as ‘in dispute.’

Review: Re account number: [redacted]I HEREBY DECLARE MY INTENT TO SUE To whom it may concern, The last correspondence I sent you company on August 23, 2013 pertained to a demand for validation. Your company has failed to provide me validation of the account and at the same time persevered with reporting the account on my credit report. This is a blatant violation of Fair Debt Collection Practices Act (FDCPA Sec 809). Hence, I hereby declare my intent to bring suit against your company under the regulations, due to your continued collection activity and failure to remove the account from my credit report.Desired Settlement: I am allowing you a period of 14 days to remove the account from my credit report, after which I will pursue this matter in California Superior Court. I have brought this matter to the attention of the Attorney Generals Office. You may only correspond with me by mail and are to cease all collection activity pertaining to this account.

Response:

Validatiojn of the debt was originally sent to Ms. [redacted] on 9/12/13. A second set was sent via certified mail on 12/27/13 to the address shown on this complaint. The documents included the signed application for the surety bail bond, indemnity agreement,, and promissory note. Online credit card payments have been made on this account by Ms. [redacted]. All collection activity has ceased, per her request, however the balance remains outstanding.

Review: I am just filing a complaint against the woman I spoke to today because she was rude and disrespectful she hung up on me while I was trying to give her my husbands contact and employer info she just kept saying you need to tell him to call and would not give me her name except saying [redacted] ext [redacted] the number was from orange county [redacted] number. I would be more then happy to go half on the debt if they would contact him first regarding the debt but she didn't even want to get his information from me I was very upset that she would talk to me like dog when I wasn't even being rude to her I feel that this was very unprofessional and she should talk to people with respect she didn't even want to tell me her name she hung up the first time and I had to call again to get her info she would not even provide a last name I don't think is right and demand that management take this seriously. she is failing to do her job by collecting info and anyone who hungs up on you isn't going to help get any collections handledDesired Settlement: I would like sort sort of apology and letter for her rudeness and that she be evaluated for her behavior

Business

Response:

I apologize to [redacted] for the tone of the call. However, [redacted] was trying to provide information for another individual she believed to be responsible for the debt. [redacted] is the responsible party for this debt. She signed as the indemnitor. The collector did provide her name and extension, and a supervisor was available if needed.

Review: A bill showed up on my credit report from this company. After disputing it with the credit bureau, this company stated this is my account. I have never received a bill from AWA Collections nor the company it represents (Cumberland Emer Phys). I requested proof from AWA that this was in fact my account and they stated they would send in a request to Cumberland. I asked by they had to contact the company IF they verified with the credit bureaus that this was my account. The CSR stated they didn't have proof due to privacy. I asked how they were able to verify the information if they didn't have it. The CSR then stated they DID in fact have proof, but could not provide it to me. My credit is being negatively affected by this bill that I believe to be bogus.Desired Settlement: I would like this amount/bill removed from my credit immediately with proof provided.

Business

Response:

The account in question was assigned to AWA Collections 11/9/2012, at which time a first notice was sent to the same address as noted in the complaint. On 11/13/2012, Ms. [redacted] called and spoke to a representative at AWA and confirmed her address. On 12/26/2012, she made an online partial payment through the AWA website. On 7/16/2013, Ms. [redacted] called AWA and requested a letter so she could make a payment, and another letter was sent. On 1/7/2015, Ms. [redacted] called AWA and requested details for the account. AWA Collections verified the name, address, and SSN with the client information. Because this is a medical client and there are privacy concerns, the actual details were mailed to Ms. [redacted] by the client on 1/14/2015. If Ms. [redacted] still has concerns after reviewing the details, she can contact the client directly at they number they provide. The client will advise us of any changes.

Response:

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.

[I received a letter from Cumberland Emergency Physicians for an invoice that was supposed to be cleared as it was a misdiagnosis. Details of the correct diagnosis were provided to the hospital and information from the doctor was available upon request. Now, after years, I'm finding this on my credit when I was never supposed to receive another bill. I do not have any record of ever making an online payment to AWA.]

Review: Account number [redacted] per Experian report does not and has never belonged to me I pride myself on paying my bills when I know about them. This is a mistake of the company and I will not be forced to pay something that does not belong to me. I have requested proof on this account and to date nothing. They have chosen to not correct a clear error and fix the problem. THIS IS NOT MY ACCOUNT FOR $51.

Response:

AWA Collections received a dispute from the consumer on 11/13/13 and requested supporting details from the client (dental services). On 12/9/13, the details were received and mailed to the the consumer at the same address as posted on her complaint. The details included her signed agreement for financial responsibility, as well as the explanation of insurance benefits. Her insurance company paid only a portion of the amount submitted in the claim. She is responsible for the remaining balance, as outlined in the agreement and the patient history, which was also included. She paid for the services provided on 2/2/12, but not the remaining balance due from services provided on 9/25/12. The supporting documents have been mailed again to her address. As they contain personal and private information, they are not attached to this response.

Review: AWA Collections violated the Fair Debt Collection Practices Act 15 USC 1692g and the California Rosenthal Fair Debt Collection Practices Act, I dispute the validity of this bill, I do not owe two bills to the Southern California Automobile Club for $157 and $155 written complaints have been sent to Bureau of Consumer Protection, California Office of the Attorney General, California Insurance Commissioner,Desired Settlement: These debts need to be deleted off of all three major credit bureau.

Business

Response:

There are two accounts in question from the Automobile Club. The first is for the remaining balance on an automobile insurance policy. The second account is for service calls exceeding the number allotted for that membership. Details for both accounts have been mailed to the address shown on the complaint. The address on the details was different at the time of the charges, but has been verified with Ms. [redacted]'s date of birth. If she has questions after reviewing the details, she can contact the Automobile Club of Southern California or AWA Collections.
