at the earlier of the end of the Pricing Period or when all of the Agreement gallons are delivered to you, without further notification to you, and subsequent deliveries to you will be charged at our prevailing retail price for home heating oil that is in effect at the time of delivery. It was during your fourth delivery that all of the agreement gallons were used, therefore your pricing reverted to the retail pricing. With that being said, we are sorry there was any confusion when the account was set up and are happy to credit your last delivery as you requested at a price of $per gallon. When a problem is looked into and reviewed and undisputable facts are uncovered and presented and some one chooses to totally disregard those facts, for their own reasons, after they are explained, I guess at that point it will be decided by the courts

I am rejecting this response because:
Your company had multiple opportunities to explain to me how to remove my account from your automatic deliveryI received the first phone call in Aug./Septand when I told the representative that I no longer wanted your companies services, he did not notify me of the proper procedure to stop deliveryWeeks later I was surprised that I received a 2nd phone call from a different representative asking me to renew my contract againThis was the 2nd time I should have been told what to do to cancel the automatic deliveryBut I was notFinally, after you delivered oil to me on December 28th (which I did not want) I called your company on January 4th to figure out why I was getting oil deliveredThis was the first time I was told that I needed to submit a written statement to cancel automatic deliveryI asked the representative to email me the information I need to cancel the automatic delivery (because I was driving and could not write it down), which she agreed to doI never received that emailI called the company again January 7th, after not receiving the email of instructions and finally took down the informationYour company had multiple opportunities to explain to me how to cancel my automatic deliveriesBecause your representatives did not inform me of the policies of your company, I have to pay for itThat is not acceptable by any standardsIf you do not want to accept a payment of $/ gallon for your delivery (the price I was planning on paying when I needed to have an oil delivery) then I would be happy to set up a time for you to send someone over to pick up the oil that you delivered
The bottom line is that you delivered oil to a customer who thought they had canceled their contract with youYour employees had multiple opportunities to do the right thing and for whatever reason, they did notYou can not hide behind laws that are meant to protect homeowners from freezing just to take advantage of customers who are not familiar with the laws and policies regarding oil delivery

After reviewing the account, the Customer was not on a Capped Pricing PlanThe active plan was a variable rate planThe oil delivery tickets do not reflect each customer’s current pricing as it varies depending on pricing programs

We have credited the customer account today for the amount requested of Our records indicate that we should have made the delivery based upon our log notes and conversations the way we understood it. I see where we had miscommunications

Elgot completed kitchen and bathroom renovations for *** *** ***The latest is the 3rd or 4th complaint about Elgot to the Revdex.com (one of the complaints was from *** ***'s lawyer). *** *** continues to make accusations against Elgot and is damaging Elgot's reputation Elgot's attorney and the client's attorney have had communications about the matter and the case is in litigation.Elgot has been trying to reach a reasonable settlement with *** ***He continues to be unreasonable and does not want to pay more than $5,to settle the matter*** *** owes Elgot in excess of $30,000.Elgot has been family owned and operated for the past years. reference to complaint ID ***, and find this resolution to be the best I will get as we disagree with the contract words "prevailing retail price". I was expecting the prevailing rate to be what the current price is for this area, they are telling me it means their prevailing rate. So, they can say the prevailing rate is anything they want it to be, because it is not stated in the contract how their prevailing rate is calculated. Bottom line, we can close this complaint as we agree to disagree. I told them that I thought they offered this contract as a way to increase customers, after I fulfill my contract obligations, I will be looking for a new oil dealer

In response to the rejection, the first delivery was at the promotional price of $1.499/per gallonThe Customer signed a Capped Pricing agreement which states that the price per gallon would not be greater than $and the last delivery price was $1.99/galThe early termination fee will apply and it will be deducted from the credit balance if termination is requested

The account will transition to a Service Only account; service contract to remain in effect until expiration in August, The customer will not receive additional oil deliveries

I am rejecting this response because:They filled my tanks on 4/20, as per their own record and mineI had turned my heat off for the season PRIOR TO that fill up. In late August, they came to fill my tanks, and said they could not, because the tanks were fullThey left a receipt stating suchI verified by checking the tank floats. A month later, with my heat STILL HAVING BEEN OFF THE WHOLE TIME, they are stating they delivered gallons of oilOil to heat hot water for adult and two children (one who, frankly, doesn't bath as often as he should) in one month CANNOT be gallons. Further, even if this was NOT the case, and if somehow the drivers audible tank fill warning AND the floats read wrong (which is illogical) and I'm contractually obligated to purchase gallons of fuel oil from them at one price, I had notified them that I was NOT going to be renewing my service with them, so why did they allegedly deliver "92.8" gallons OVER the contract amount, for a considerably higher price?
