to Revdex.com Complaint #***, the last oil delivery of gallons will be
re-billed at $per gallon. The
Customer’s account has been terminated per his request

The customer signed up on October 15, 2015. The Cap price of the signed contract is $2.34/gal and the last two deliveries were made at $1.69/ppg. The Customer has received a lower price as the contract statesThe Service contract has been removed from the account as requested

In response to the Rejection, the account has been terminated and the balance is owed

In response to the Customer’s complaint, we have reviewed the account and determined that a refund of the $will be processed

I am rejecting this response because: As per the
agreement "If our prevailing retail price for home heating oil drops below
the Capped Price during the Pricing Period then you will pay our prevailing
retail price for home heating oil." The market price was $when they
delivered my home heating oil and charged me $a gallonIt is unfair that
I am obligated to adhere to the agreement by paying a $termination fee,
while they are not obligated to provide home heating oil at a reasonable market
price as written in the contractThis is called price gouging and is illegal and unethical
If they will not waive the $termination fee it does not make sense for me
to pay it, as I would be paying MORE in a termination fee, then I would be for
their overpriced heating oil as the heating season is just about overIn
regards to the $per gallon price I receivedOriginally I was verbally
promised a price of $a gallon on my first delivery, they actually charged
me $1.49, a $increase from what was agreed upon

I am rejecting this response because: you're not acknowledging my concern or addressing the real issue No where on your website, in the contract that was provided, or during the phone conversation to become a client or have an oil delivery did it state you would come into my home and have a truck driver inspect the tankNor did you advise that you have the right to refuse oil deliveryI have a small child (toddler) in the house and you left me no options for heat after taking days to get here then declining deliveryThis is New England our outcome could've been much worse because of your failure to communicate your company's policy You left me without oil until the following Monday, your company's solution- go get diesel and $to replace an oil tank that wasn't leakingI took time away from work, I had to have other companies come out an inspect the tank for a 5th time and then wait days for an oil delivery The lack of competence and communication in your marketing material contracts and member facing platforms cost meI want the money I spent on oil and to have another opinion reimbursed and your marketing material member facing platforms and contracts updated to advise all consumers that truck drivers enter your home to inspect the tank.

to the Customer’s complaint regarding the capped pricing plan, an early
termination fee will apply. The
customer is receiving the lowest price based on the company’s prevailing price
The “market" is the average of
full service, COD and new customer first fill pricingThe customer will
not receive the COD pricing as this is a full service company

The Capped Pricing plan expired on January 31, The customer is responsible for cancelling Automatic Delivery, as it states within the pricing contractCustomer was offered payment options and a new low Capped Pricing plan

October delivery was a one-time promotional pricing at $1.699, not *** retail
pricingThe January 28, delivery, coincidentally or not, was priced at
$within a day of when I made my complaint to the Revdex.com. Regardless, you still not have addressed the
fact that the *** salesman lead me to believe that ***’s retail pricing was
aligned with *** for which I was told yes it wasTHAT WAS A CLEAR MISREPRESENTATION
It would
have made zero sense for a customer like me to be paying up to a $per
gallon premium solely for auto-deliveryAs I told the *** salesman when we spoke in
August, I had happily been using *** for years without issue after poor pricing
experiences with ***. I am not on a
budget plan. I pay my bill immediately
upon receipt
At this
point I simply want my oil delivery contract immediately terminated without
being charged a pro rated early termination fee. I will eat the $plus for which I overpaid
for oil deliveries under this agreement from August until now.
On
another note, as part of my dealings with *** on this oil delivery contract, I
was offered and paid for a *** service contract at $with no mention of the
face value being $498.95. You can
imagine my concern when that bill was receivedIt left me very concerned of
***’s attempting to auto-renew me next season at a higher than agreed to or
non-discounted rate of $498.95. *** not mentioning this in our email
discussions was clearly an attempt to bait a customer without full disclosure. Since I did pay and enter into this ***
service contract at inception, I expect this to run until 08/31/without
reprisal

response because:The issues have continued after this last adjustmentI have again asked to have a note put on my account not to deliver oil with no response but a hang up on my voicemail.Jiat like last month, I again paid my bill the day it was due yet it didn't post until 6:00am the next dayI am sure this will result a late charge due to their system issues and not my failure to pay on time.I have a cap contract however their pricing continues to be much higher than the other local companiesLast delivery I was charged 1.99/gallon while the local average was 1.59/gallonI believe that this price gouging due to the rapidly dropping price of oil. I do not trust this company or their business practices I do not want them on my property again and I again am requesting to be released from this contract without penalty
