Review: I had a credit card with [redacted] Bank)and after getting the card got pneumonia and couldn't work for quite awhile. I got behind on my payments and [redacted] Bank sold the account to Atlantic Credit. I didn't know that the account had been sold and sent [redacted] Bank a cashiers check for $500.00 on 10/21/2015. It cleared my bank on 10/26/15. [redacted] Bank has advised me that the $500.00 was sent to Atlantic Credit on 10/27/15. I called Atlantic Credit several times. Each time I called I was told something different. Some told me that the money had been received and others said it had not. I got ahold of a lady that told me that they take that money and put in an account of theirs and let it draw interest. In the meantime I have not been credited with that money. She told me that they would eventually send the money to me. I don't want the money returned; I want my account credited with that payment. I have talked with an attorney who has advised me that this type of practice is illegal. I have also talked with a state senator who has asked me to keep them advised if this is not resolved quickly. I paid another $500.00 on 12-14-15 and they have taken another $200.00 out of my bank account. My balance should be $700.00 at this time, not $1,200.00. I will pay the $700.00 as soon as the account shows the other $500.00 payment. I want this resolved quickly!Desired Settlement: Credit my account with the $500.00 that I have paid and I will pay the balance.

Response:

I have reviewed the response offer made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.

As I explained in my original complaint there was $500.00 paid to [redacted] Bank and which cleared my bank on 10/26/15. [redacted] Bank has advised me that it was sent to either [redacted] Funding or Mid Atlantic on 10/27/15. My account has never been credited with that payment of $500.00. Someone needs to find that money and credit it to my account. I have actually paid $1,200.00 toward this account. I will not pay more until the account is credited with the correct amount that I have paid.

Review: I recently called a creditor to settle a debt outstanding. The debt was incurred from [redacted]. The Debt collector, Atlantic Credit & Finance Incorporated was called on 12-29-2014 in order to negotiate a settlement. The associate named [redacted] negotiated a debt settlement of $1,000.00 from the base of $1,454.00. After negotiating and paying the amount of $1,000.00 through [redacted] on 12/30/2014 I recieved a letter from Atlantic Credit & finance incorporated dated 12/30/2014 stating that I was in arrears for an additional $489.36. This was not the agreement that was negotiated between the representative associate for the company and myself. I would like the Consumer complaint Agency to investigate this issue as it was not in the contractual agreement for settlement ad I feel this company is operating in a blackmail mode threatening to issue a lien and judgement for an amount that was negotiated out at the time.Desired Settlement: Atlantic Credit and Finance Inc. will be required to honor the agreement settlement they negotiated on the phone with me. I paid the negotiated amount of $1,000.00 on 12/30/2014 in full. I require a letter of settlement from them in order to report this payment in full to the (3) credit reporting agencies [redacted] and [redacted].

I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution would be satisfactory to me.

Regards,

Review: I was first contacted by Atlantic Credit and Finance, Inc by phone on July 15, 2015. The customer service representative, [redacted], failed to introduce himself, or state the nature of his business, and instead assumed a familiar tone while he circled around a central point, which was "I am looking at your account and I can't believe what I see, it's amazing!" He never clarified which account, the call seemed like a cold call, so I asked him kindly to take me off his list, and I ended the call. Later this same day, [redacted] took it upon himself to call my ex husband, and reach out for personal information. I received an alarmed email from my ex husband.

The same day, I received a phone call from a blocked phone number. When I answered the phone, I was greeted with "[redacted], have you spoken to [redacted] today?" ([redacted] is my ex husband). I asked the called to identify himself, and instead he repeated, "[redacted], have you spoken with [redacted]?" When pushed for details, [redacted] clarified who he was. [redacted] then pushed for personal information over the phone regarding my "account." I informed [redacted] that I was/am still unaware of any business that Atlantic Credit and Finance, Inc may have with me, and when he assured me that he sent me a letter, I told him that I have received no written correspondence from his company, would not give personal information over the phone, and asked that his company send a letter detailing any business they believe they have with me via certified mail so that there would be no question of receipt. [redacted] refused and instead pushed for personal information over the phone, at which point I asked to speak with a supervisor. I was put on hold, and [redacted] took over the call.

[redacted] was wildly aggressive, demanding personal information and scoffing at the idea that his company would send a certified letter, telling me "we send thousands of letters per month, we are not going to send you a certified letter." I told him that he would not be able to confirm personal information until I receive a letter detailing his claim to business. [redacted] forcefully told me that I absolutely do understand the nature of his business, and further demanded personal information. I asked him whether he would ever advise his wife or daughter to give personal information over the phone with little to no understanding of why, and he replied "absolutely." I repeated my request for a letter detailing the nature of their concern/business, and told [redacted] that our call was ending, and asked him not to call again. I immediately called my attorney, who advised me to send a no contact/cease and desist.

To date, I have received no letter, and on Monday, July 20th, I received again a phone call from Atlantic Credit and Finance. When I returned the call, it was with the intention of asking, once again, for a certified letter, and to inform Atlantic Credit and Finance, Inc that they are no longer to contact me on my cell phone, or at home, they are not to contact any of my family members or employers. They are not to seek personal information over the phone. I was told by the representative that day that Atlantic Credit and Finance would not send a letter without confirmation of my home address, and the representative immediately began to seek financial details. I ended the call.Desired Settlement: Atlantic Credit and Finance must send a letter detailing the nature of their business, I request that this letter be sent via certified mail so that there can be no dispute that the letter was sent or received. Further, Atlantic Credit and Finance may not contact me again via telephone, and may not contact my family members or employers.
