Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this proposed action would not resolve my complaint From: [redacted] Sent: Thursday, February 12, 8:AM To: drteam Subject: Complaint # [redacted] I have received one email from Revdex.com with two responses from David Weekley and my response to both are as follows: RESPONSE # I have reviewed the response made by David Weekley to Revdex.com and forwarded to me by email on 2/10/at 4:PM regarding complaint # [redacted] and do not accept the responsePlease note the following: With all due respect Attorney [redacted] is mistaken on a number of accountsThe humidifier was installed at the recommendation of David Weakley's hardwood floor installer - [redacted] (please see complaint # [redacted] ,11/5/14, for recommendation by [redacted] , however, no recommendation was made regarding relative humidity as claimed The humidifier was installed by Tier also one of David Weekley’s contractors at the time (I paid Tier directly) Tier recommended and set the humidifier at 65% A short time after the installation there was moisture on several windows and I turned the system off The moisture on the walls (mold) was caused by a partially disconnected vent duct near the wall which leaked hot and cold air onto the wall and into the room David Weekley’s representative suggested that the duct probably became disconnected during the installation of the hardwood floors by [redacted] Sanding the floor was discussed briefly as a potential solution to the problem I rejected the recommendation because : I did not feel I should have to pay to have the floors sandedBased on the degree of cupping and some separation I did not feel it was going to work, and would do nothing for the separationThe suggestion was made with less than full confidence that it would work [redacted] noted they were having similar problems with a number of houses in the communityI would be willing to have the floors sanded and re-stained under the following conditions: If the cost of re-sanding was paid for by David Weekley and/or [redacted] and Tier The cost to include: moving furniture, tenting, sanding, re-staining, cleaning the interior of the house, and any other related and appropriate expensesIf the sanding does not solve the problem David Weekley will replace the hardwood floors and assume the cost of doing soI have not received any offer from David Weekley to pay 1/of the cost to repair or replace the hardwood floor, therefore, I could not have rejected the offerThis was noted in my previous response on 2/6/at 5:PM to Revdex.comIn that I did not cause the damage I do not feel that I am being unreasonable in asking that the hardwood floor be replacedThank you, [redacted] RESPONSE # If David Weekley is willing to pay 1/of the cost of replacing the hardwood floors and [redacted] and Tier each 1/of the cost there would be no need for mediation or arbitration This suggestion was made in a previous response and directly to David Weekley’s representatives when visiting my home All three companies claim the damage was not their fault so this is possibly the best solutionFurthermore, I am not willing to incur any expense related to: mediation/arbitration, travel, attorney fees, etc It through the Revdex.com process a resolution can not be reached the next step of mediation/arbitration is not acceptable and I will pursue legal remedies as previously noted to David Weekley’s representativesThank you, [redacted] Regards,

Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this proposed action would not resolve my complaint [I had only been contacted by David Weekly Homes recently to offer one of their internal inspectors take a lookI would agree to a true independent inspection by a 3rd party professional inspectorI ultimately prefer to have the separated wall and floor noise/movement repaired due to the negative perception it could have if I were to ever sell the homeThe wall is cracked right in front of the home and is noticeable as you approach the homeas is the adjacent rooms flooringMy main concern before a repair would begin, is to ensure there is not a structural, or construction defect that caused the issues in the first place.] Regards, [redacted] ***

We have contacted the customer and offered to inspect the home Our intent is to bring a third party engineer to inspect the home The customer may respond to our local Project manager, Bryan [redacted] , to arrange this inspection Alternately, if the customer wants PWC to inspect the home, he will have to file a demand in accordance with the PWC instructions which were provided to him by PWC Either way, we are making efforts to address and resolve the complaint

Mr [redacted] will respond We will not handle this dispute form Houston

Please file your claim with PWC, the awarranty company, as directed This is the agreed contractual method for resolving your dispute

The home is over years old, these issues are no longer under warranty This is a homeowner maintenance responsibility.MrN [redacted] has offered to have a contractor perform the work at David Weekley Homes pricing, in order to assist the customerWe have exhausted all reasonable efforts to resolve

We received confirmation from Mr [redacted] for an onsite meeting scheduled for this Wednesday the 14th at 12:PM

The complaint has been assigned to the local manager, who will contact the customer direclty

This claim should be filed with our Charlotte Division, not Houston; we have forwarded it to our Charlotte area management in order to expedite a response

Carlton ***, DWH Warranty Manager reports that he already inspected the home and determined that there is no structural issue. PWC is the correct mechanism if you disagree with his conclusion. Thank you

Our local manager has met with the customer and has proposed a resolution
