We have expended all reasonable efforts to resolve.  We would encourage the customer to request mediaiton or arbitration of their dispute.

This was a known issue and should have been disclosed to me before I purchased the home. I will seek legal counsel.

[I had only been contacted by David Weekly Homes recently to offer one of their internal inspectors take a look. I would agree to a true independent inspection by a 3rd party professional inspector. I ultimately prefer to have the separated wall and floor noise/movement repaired due to the negative perception it could have if I were to ever sell the home. The wall is cracked right in front of the home and is noticeable as you approach the home. as is the adjacent rooms flooring. My main concern before a repair would begin, is to ensure there is not a structural, or construction defect that caused the issues in the first place.]

The home is over 11 years old, these issues are no longer under warranty.  This is a homeowner maintenance...

responsibility.Mr. N[redacted] has offered to have a contractor perform the work at David Weekley Homes pricing, in order to assist the customerWe have exhausted all reasonable efforts to resolve.

PWC Warranty may be contacted at 1-800-850-2799; they will determine if covered.  Hope that is the informatin being sought.

According to our records, this home was built over 8 years ago - it closed in early 2007, NOT 2015, as the owner claims.  We will assign a representative to review the matter.

Sent: Tuesday, March 01, 2016 11:43 A   We agreed to reimburse the [redacted] the $895, conditioned upon execution of the attached release.  I did not speak to them directly, so I cannot confirm whether they specifically refused to execute the release, or simply said generally that they were going to sue us, and therefore would not sign anything.  However, our offer still stands.   We will refund the $895 to resolve the matter, but they will have to sign the attached, to something similar, to confirm resolution of her complaint.

Unfortunately, Revdex.com persists in sending all complaints to the Houston Revdex.com.  Since this complaint came from Minnesota, the complaint is being routed back to our Minneapolis/St. Paul Division office to contact the customer.

From: [redacted] Sent: Thursday, February 12, 2015 8:47 AM To: drteam Subject: Complaint # [redacted]   I have received one email from Revdex.com with two responses from David Weekley and my response to both are as follows: RESPONSE # 1 I have reviewed the response made by David Weekley to Revdex.com and forwarded to me by email on 2/10/15 at 4:19 PM regarding complaint #[redacted] and do not accept the response. Please note the following: With all due respect Attorney [redacted] is mistaken on a number of accounts. The humidifier was installed at the recommendation of David Weakley's hardwood floor installer -  [redacted]  (please see  complaint #[redacted],11/5/14, for recommendation by [redacted], however, no recommendation was made regarding  relative humidity  as claimed.  The humidifier was installed by Tier 1 also one of David Weekley’s contractors at the time (I paid Tier 1 directly).  Tier 1 recommended and set the humidifier at 65% .   A short time after the installation there was moisture on several windows and I turned the system off.  The moisture on the walls (mold) was caused by a partially disconnected vent duct near the wall which leaked hot and cold air onto the wall and into the room.  David Weekley’s representative suggested that the duct probably became disconnected during the installation of the hardwood floors by [redacted]. Sanding the floor was discussed briefly as a potential solution to the problem .  I rejected the recommendation  because : I did not feel I should have to pay to have the floors sanded. Based on the degree of cupping and some separation I did not feel it was going to work, and would do nothing for the separation. The suggestion was made with less than full confidence that it would work. [redacted] noted they were having similar problems with a number of houses in the community. I would be willing to have the floors sanded and re-stained under the following conditions: If the cost of re-sanding was paid for by David Weekley and/or [redacted] and Tier 1. The cost to include: moving furniture, tenting, sanding, re-staining, cleaning the interior of the house, and any other related and appropriate expenses. If the sanding does not solve the problem David Weekley will replace the hardwood floors and assume the cost of doing so. I have not received any offer from David Weekley to pay 1/3 of the cost to repair or replace the hardwood floor, therefore, I could not have rejected the offer. This was noted in my previous response on 2/6/15 at 5:57 PM  to Revdex.com. In that I did not cause the damage I do not feel that I am being unreasonable in asking that the hardwood floor be replaced. Thank you, [redacted] RESPONSE # 2 If David Weekley is willing to pay 1/3 of the cost of replacing the hardwood floors and [redacted] and Tier 1 each 1/3 of the cost there would be no need for mediation or arbitration.  This suggestion was made in a previous response and directly to David Weekley’s representatives when visiting my home.  All three companies claim the damage was not their fault so this is possibly the best solution. Furthermore, I am not willing to incur any expense related to: mediation/arbitration, travel, attorney fees, etc.  It through the Revdex.com process a resolution can not be reached the next step of  mediation/arbitration is not acceptable and I will pursue legal remedies as previously noted to David Weekley’s representatives.
